Municipal Building - 4000 Main Present: Mayor Margolis, Mayor Pro Tem Winget, Deputy Mayor Pro Tem Shinder, Councilmember Galuardi, Councilmember Grubisich (arrived 8:45 p.m.), Councilmember Britton and Councilmember Bell 1. CALL TO ORDER Mayor Margolis called the meeting to order at 5:00 p.m. 2. EXECUTIVE SESSION (DISCUSSED AFTER THE REGULAR SESSION) 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, Sec. 551.071 (Consultation with City Attorney), to consult with and receive legal advice from the City Attorney regarding the Sapphire Bay Marina and the Sapphire Bay Marina Development Agreement. (30 minutes) In at 10:10 p.m. Out at 11:09 p.m. 2B. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney), to seek legal advice fromi the City Attorney regarding the Amended Economic Development Program Agreement with Yoco, LLC. (30 minutes) Inat 11:09 p.m. Outat 11:37 p.m. 3. WORK SESSION (5:00 P.M.) *Times listed are approximate. City Council may receive public input on thei following items: 3A. Annual presentation of the Golf Advisory Board to City Council. (30 minutes) Brad Marshall, Chair, introduced the Board members who were in attendance: Lawrence Glick, Carter Holston, Jonathan Andron, Michael Daffin, Larry Young, Brent Dorenbecker and Calvin Causey. Other members, Becky Sebastian and Anthony Scott were unable to attend. Mr. Marshall reviewed the progress of the Board and the Golf Club over the past year - projects completed and in progress, metrics for the Golf Club - # of rounds played, # of tournaments, etc.; the Board's goals for the upcoming year; the Golf Club's importance to the Waterview community and the City; an explanation of "brown space" and a long-range Master Plan for the Golf Club. Council discussion regarding a future discussion regarding the overall vision of the Golf Club. City of Rowlett 11409 3B. Presentation and discussion regarding proposedamendments: tot the cell tower lease agreement contract. (45 minutes) Dale Jackson - Assistant Director of Community Development/Chief Building Official and Munal Mauladad - Managing Director of Community Development and Engineering, provided al history ofthe current leases and an overview, which included - current locations, issues with the current lease contract, proposed master lease and the financial impact. After further discussion, it was the consensus of Council to set a $4,500 per month rate with CPI inflationary increases. 3C. Presentation of options for billing insurance companies to recover the cost of responding to motor vehicle accidents (MVAs)and/or other type incidents. (30 minutes) Fire Chief Neil Howard and Rachel Williams with Emergifire presented the proposal for fire response billing, which included - eligible recovered costs and to whom the bills are submitted. The sister company, Emergicon, currently provides ambulance/EMS services billing for the City. Council discussion regarding customizing which services are billed and the possibility of only billing "at fault" parties. It was the consensus of Council to proceed with this process. Staff will negotiate with Emergifire and present a detailed program to Council at ai future meeting. 3D. Present and discuss an update to the drainage utility fee based on impervious area for residential and nonresidential metered accounts. (45 minutes) Jeff Cohen, Director of Engineering, reviewed the previous discussions, eligible properties for exemptions and financial and budgeti implications. Afteri further discussion, itwas the consensus of Council to exempt up to 25% of ERU for church properties. 4. Next Thursday, May 25th at 10:00 a.m, we will hold the annual Memorial Day ceremony at Veteran's What about those who are currently serving? Some may not know that in1999, Congress designated May as National Military Appreciation Month to ensure our nation was given the chance to publicly show their appreciation for troops past and present. As a part of that, this coming Saturday, May 20, is Armed Forces Day. This is a time to say' "thank you to all those active and reserve members oft the Army, Navy, Air Force, Marines, and Coast Guard who give Ifyou're not able to make it to tomorrow's swearing-in and reception for the new and outgoing councimembers, you'll get a second chance next Thursday, May 25th at 4pm at the Rowlett Area Chamber, which is hosting a meet and greet to welcome new council members and wish those leaving a farewell. Before those two events, I'd like to be the first to publicly say "thank you" to Councilmembers Grubisich and Bell for their six years of service up here on the dais. Consider action to approve a resolution accepting the bid of and authorizing staff to issue a purchase order to purchase equipment from IDS (Industrial Disposal Supply) utilizing BuyBoard Contract #676-22 int thei total amount of $72,8151 for a sewer easement cleaning machine for vac - trucks. Consider action to approve a resolution approving an Alternative Landscaping Plan under Section 77-504.1 of the Rowlett Development Code to modify the incompatibility buffer landscaping requirements on property zoned General Commercial/Retail (C-2) District. The approximately 4.34-acre site is located west of the intersection of Rowlett Road and Big A Road being Lot? 7R, Block A oft the Briarwood Armstrong Addition Replat, in the City of Rowlett, Dallas Alex Koenig, Planning and Urban Design Manager, presented the information for this item. A motion was made by Councilmember Grubisich, seconded by Councilmember Galuardi, to DENY the item as presented. The motion passed with a vote of6i in favor and County, Texas. 1opposed (Bell). This item was NOT APPROVED. 8B. Consider action to approve a resolution approving the sale of two City-owned undeveloped parcels located at 4559 Martha Lane and 7995 Dalrock Road to the Rowlett Housing Finance Angela Smith, Deputy City Manager, presented the information for this item. Rick Sheffield, Executive Director - RHFC, presented additional information. Council discussion regarding amending the contract language to ensure intended purpose is met; steps and process leading up to this agreement; and clarification of possible motion language from the City Attorney. Ar motion was made by Councilmember Grubisich, seconded by Councilmember Britton, to approve the item with a reverter clause requiring development for veterans within two years after closing.
