Municipal Building - 4000 Main  Present: Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Bowers, Councilmember Britton and Councilmember Schupp  1.  CALL TO ORDER  Mayor Margolis called the meeting to order at 6:00 p.m.  2.  EXECUTIVE SESSION (6:00 P.M.)  2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) and Texas Government Code, $551.072 (Deliberations Regarding Real Property) to seek legal advice from the City Attorney and to discuss and deliberate regarding the Development Agreement with YOLO, LLC and the purchase of property located at  3913 Main Street. (15 minutes) In at 6:02 p.m. Outat 6:11 p.m.  2B. The Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) to seek legal advice from the City Attorney and to consider litigation against Comfort Suites Lake Ray Hubbard relating to hotel occupancy taxes. (10 minutes)  In at 6:11 p.m. Outa at 6:23 p.m.  2C. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.074 (Personnel Matters) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of the City Secretary and take any necessary action related thereto. City ofF Rowlett  11460    City Council will deliberate on and may receive public input on the following items: 3A. Presentation of the Fiscal Year 2024 (FY2024) Proposed Budget. (60 minutes)  David Hall, City Manager, presented the Fiscal Year 2024 Proposed Budget. He spoke regarding items that helped to shape this year's budget, including the City's future financial condition, employee retention and attraction, keeping pace with City growth, and utility rates. Spoke about the General Fund, the Utility Fund, the Drainage Fund, Employee Benefits Fund, other  governmental funds, and the Five-Year Capital Improvement Plan. Remarks were received from the Councimembers. DISCUSS CONSENT AGENDA ITEMS  4. Delivery of the Fiscal Year 2024 (FY2024) Proposed Budget.  David Hall, City Manager, presented this item. He spoke regarding the General Fund, the Utility  Fund, the Drainage Fund, and the Five-Year Capital Improvement Plan.  Mayor Margolis thanked staff for their work.  5B. Presentation of proclamation recognizing August 21st as Senior Citizen Day.  Councilmember Britton presented this proclamation to the Senior Advisory Board and thanked the  Rowlett Diversity, Equity and Inclusion Commission for sponsoring this item. Teddy is your guy if you are looking for at furry friend to take on adventures! He may be 65 pounds, but he would love to be your lap dog. He is about 3 years old. Teddy gets along great with other dogs and cats, but we do recommend having a meet and greet with your other furry friends. Teddy would make a great addition to anyf family and will always keep a smile on your face. Remember - all adoptions include spay/neuter, microchip and up-to-date vaccinations. For more information on Teddy or any of the other adoptable animals, please contact Animal Services at 972-412-6219 or come by the shelter at 4402 Industrial Street. They're open from 10 a.m. to 5 p.m. Tuesday through Saturday. Our animal shelter is still in CODE RED - for both cats and dogs. This means that all the kennels are full! If you've been tossing around the idea of adoption or fostering, now would be a great time to make it happen. Consider action ordering a special election to fill a vacancy.  Consider action to approve an ordinance ordering a Special Election to Fill Vacancy for the remainder of the unexpired term of office of Councilmember Place One. Such election will be held - in conjunction with the General Election on November 7, 2023 and any possible resulting run-off  election to be held on Tuesday, December 12, 2023.  This item was approved on the Consent. Agenda as ORD-023-23.  7C. Consider action approving fiber optic network connection for a newly acquired City  building.  Consider action to approve a resolution authorizing a purchase order to the City's fiber optic network partner, in an amount not to exceed $144,068, to connect a newly acquired building to the  City's network.  This item was approved on the Consent Agenda as RES-090-23. Agreement to acquire property located at 3913 Main Street.  7D. Consider action approving an agreement incident to an Economic Development Program  Consider action to approve a resolution authorizing an agreement incident to an Economic Development Program Agreement with YOCO, LLC, in the amount of $96,275.03, to acquire property located at 3913 Main Street, Lot 2A, Block B of the Municipal Complex Addition and  authorizing the Mayor to execute the agreement on the City's behalf. This item was approved on the Consent Agenda as RES-091-23.  7E. Consider action approving the purchase of a trailer for the Police Department.  Consider action to approve a resolution to execute a purchase order with North Texas Trailers in an amount noti to exceed $59,998, for the purchase of a 2023 Wells Cargol Motortrac Custom Trailer for the Rowlett Police Department utilizing BuyBoard Contract 687-22, quote #24878. This item was approved on the Consent Agenda as RES-092-23.  7F. Consider action approving an amendment to the Code of Ordinances regarding animal  regulations.  Consider and take action to adopt an ordinance amending Chapter 6, Articles I-VIII of the Code This item was pulled from the Consent Agenda and will be brought back before the City  Ordinances regarding Animal Regulations. Council at a future meeting.  7G. Consider action approving an amendment to the Code of Ordinances regarding the  electrical code.  City of Rowlett  11463    Consider action to approve an ordinance amending the City of Rowlett Code of Ordinances Chapter 78, Article III - Electrical Code, by adopting the 2023 National Electrical Code (NEC) with  amendments.  This item was approved on the Consent Agenda as ORD-025-23.  7H. Consider action approving professional services agreements for real estate appraisal  services.  Consider action to approve a resolution approving Professional Services Agreements (PSAs) with Angel Valuation Services, LP, Atrium Real Estate Services, CBRE, Inc., Integra Realty Resources Fort Worth, JJKRGroup, Inc. dba Pyles Whatley, and Texas Appraisal Team, LLC, respectively, to  provide real estate appraisal services.  This item was approved on the Consent Agenda as RES-093-23.  Passed the Consent Agenda  Amotion was made by Deputy Mayor Pro Tem' Winget, seconded by Mayor Pro Tem Shinder, including all the preceding item(s) marked as having been approved on the Consent Agenda. The motion carried with a unanimous vote of those members present.  8.  INDIVIDUAL CONSIDERATION  8A. Consider action to approve a resolution calling for a public hearing on the Fiscal Year 2024 proposed budget and tax rate for Tuesday September 19, 2023, and to consider approval of a Wendy Badgett, Director of Financial Services, presented the information for this item. Ar motion was made by Deputy Mayor Pro Tem Winget, seconded by Counciimember Schupp, to approve a resolution setting the maximum proposed tax rate at $0.716886 and calling for a public hearing on the Fiscal Year 2024 budget and tax rate to be held on Tuesday, September 19,2023at7 7:00 p.m. The motion cariedwthaunmamnimous vote oft those  maximum tax rate of $0.716886 fori the 2023 tax year.  members present.  This item was approved on the Consent Agenda as RES-094-23.  9.  MEMBERS OF THE CITY COUNCIL MAY REQUEST TOPICSTOBEI PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING. Amotion was made by Deputy Mayor Pro Tem' Winget, seconded by Mayor Pro Tem Shinder, to accept the resignation of City Secretary, Laura Hallmark, and agree to accept the terms An amended motion was made by Deputy Mayor Pro Tem Winget, seconded by Mayor Pro Tem Shinder, to accept the mutually agreed upon separation agreement between the City of Rowlett and City Secretary, Laura Hallmark, and agree to accept the terms of the severance agreement. This motioned carried with a 5-1 vote Councimember Britton abstained). Mayor Margolis stated in accordance with the City Charter language, it states in Section 5.01, the City Council shall appoint the City Secretary, upon by four (4) affirmative votes of the City Council. The City Council shall consider the City Manager's recommendations David Hall, City Manager, recommended Executive Assistant, Evette Whitehead as the Ar motion was made by Deputy Mayor Pro Tem' Winget, seconded by Mayor Pro Tem Shinder, to approve the appointment of Evette Whitehead as Interim City Secretary and give the Mayor the authority to execute an employment agreement on behalf of the City to be ratified by the City Council at the September 5, 2023 Council meeting. The motion carried with a  of the severance agreement.  regarding the appointment of the City Secretary.  Interim City Secretary.  unanimous vote of those members present. Ms. Hallmark provided some closing remarks.  10.
