Consider action to approve a resolution approving a change order to the contract for the Herfurth Park Phase 1 Project with North Rock Construction, LLC, in the amount of $130,063, resulting in a total project budget of $735,061, and authorizing the Mayor to execute the necessary documents. This item was approved on the Consent Agenda as RES-109-23. 5H. Consider action approving a contract for construction of the Garner/Fuqua Trail. Consider action to approve a resolution accepting the bid of and awarding a contract to FNH Construction, Inc., in the amount of $629,584 with a ten percent (10%) contingency amount of $62,958.40 and up to $7,500 for an early completion bonus, resulting in a total project budget of $700,042.40, for construction of the Garner/Fuqua Trail, and authorizing the Mayor to execute the necessary documents for said services. Conduct a public hearing on the proposed budget for Fiscal Year 2024 and Council vote to delay approval oft the budget until September 20, 2023. Allison Brown, Budget Officer, presented this item (Items 6A and 6B combined). Comments were received regarding the Safer Grant impact on the budget upon its expiration, and the lack of communication with the former administration. City of Rowlett 11481 The public hearing opened and closed at 8:06 p.m. with no one speaking. A motion was made by Mayor Pro Tem Shinder, seconded by Councimember Schupp, to officially postpone the vote to adopt the Fiscal Year 2024 budget until Wednesday, September 20, 2023. Conduct a public hearing on the ad valorem tax rate for Fiscal Year 2024 and announce the date, time and place oft the meeting at which the vote will occur (September 20, 2023). Consider action to approve a resolution adopting an amendment to the Master Fee Schedule of the City of Rowlett to establish a new inspection fee structure for Civil Construction Permits based Jeff Cohen, Interim Director of Public' Works/Director of Engineering, presented thisi item. He: stated Chapter 212, Section 212.906 of the Texas Local Government Code (TLGC), governing the assessment of construction inspection fees by municipalities, was amended and the TLGC regulation requires municipalities to assess construction inspection fees based on cost to the municipality. He spoke regarding the fee structure and the proposed fee equation. A motion was made by Deputy Mayor Pro Tem Winget, seconded by Councilmember Bowers, to approve the resolution as presented.
