Municipal Building - 4000 Main Present: Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Bowers, Councilmember Britton and Councilmember Schupp 1. CALL TO ORDER Mayor Margolis called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) to seek legal advice from the City Attorney regarding the proposed settlement of the national class action suit against 3M Corporation and DuPont de Nemours. (15 minutes) Executive Session followed the Regular Session. Convened into Executive Session at 8:01 p.m. Reconvened into open session at 8:15 p.m. INVOCATION The invocation was led by Pastor Craig Schill, Lake Cities Community Church. PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by Boy Scout Troop 646. 3. PRESENTATIONS 3A. Presentation of proclamation recognizing November as National Military Families' Month. Councimember Michael Schupp presented this item. Mayor Pro Tem Deb Shinder, Deputy Mayor Pro Tem Jeff Winget and Councilmember Elise Bowers represented military family members. 3B. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. City of Rowlett 11506 Councilmember Elise Bowers made the following announcements. Early Voting for Councilmember Place 1 Run-off Election started on November 27 and will go through December 5 with Election Day on Saturday, December 9. Early Voting and Election Day The Holiday Main Street Festival and Parade is this Saturday, December 2nd from 5 p.m. - 8 p.m. at the Downtown Green. In addition to the parade, which begins at 6:00 p.m., there willl be vendors, food trucks, a kid's zone, live performances and pictures with Santa. Consider action to approve minutes from the following City Council meeting(s): November 7, 2023 City Council Meeting and the November 20, 2023 Special City Council Meeting. This item was approved on the Consent. Agenda. 5B. Consider action approving the purchase of a combination vacuum and hydraulic, jet truck. Consider action to approve a resolution authorizing the City Manager to execute a purchase order to CLS Equipment Co., Inc. in the amount of $487,871.75 for the purchase of a Vac-Con Inc. combination vacuum and hydraulic jet truck to replace an aging unit that is frequently out-of-service for repairs. This item was removed from the Consent Agenda. City of Rowlett 11507 5C. Consider action approving an interlocal agreement to cooperatively purchase goods and services. Consider action to approve a resolution entering into an Interlocal Agreement with Collin County, Texas ("Collin County") which will allow the City of Rowlett to cooperatively purchase goods and services under their competitively bid contracts. This item was approved on the Consent Agenda as RES-132-23. 5D. Consider actionapproving a tree removal permit. Consider action to approve ai request by Spiars Engineering, Inc. on behalf ofp property owner Oden Hughes, LLC. for approval of a Tree Removal Permit on a property zoned Form-Based Urban Village (FB-UV). The 22.48-acre site is located approximately 1600 feet south of Main Street west of President George Bush Highway in the City of Rowlett, Dallas County, Texas. This item was removed from the Consent Agenda to be considered individually. Alex Koenig, Planning Manager, presented this item and provided background of the project. He spoke regarding the protected trees, mitigation credits and presented protected trees. Mayor convened the City Council into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) to seek legal advice from the City Attorney regarding consideration of a Tree Removal Permit for subject property located at President George Bush Highway and Main Street. Council will convene in City Hall Conference Room and return to the Council convened into Executive Session at 7:26 p.m. and resumed Regular Session at 7:42 p.m. A motion was made by Deputy Mayor Pro Tem Jeff Winget, seconded by Councilmember Michael Schupp, to approve the resolution. This item was adopted as RES-133-23. The Council Chambers. No action was taken. motion passed with a 6-0 vote. 5E. Consider action approving a tree removal permit. Consider action to approve a request by Duane Cannon on behalf of property owner the Cornerstone Assembly of God for approval of a Tree Removal Permit on a property zoned Limited Office (0-1) and Single-Family Residential (SF-10). The approximately 12.054 acre site is located approximately 1,400f feet north ofthei intersection of! Datrock and Miller Roads, int the City of Rowlett, Dallas County, Texas. This item was approved on the Consent Agenda as RES-134-23. 5F. Consider action approving a cooperation agreement with the Rowlett Chamber of Commerce. Consider an action to approve a resolution entering into a three-year Cooperation Agreement with the Rowlett Chamber of Commerce effective November 21, 2023. City of Rowlett 11508 This item was approved on the Consent. Agenda as RES-135-23. Passed the Consent Agenda AI motion was made by Mayor Pro Tem Deb Shinder, seconded by Deputy Mayor Pro Tem Jeff Winget, including all the preceding item(s) marked as having been approved on the Consent Agenda. The motion carried with a unanimous vote of those members present. 6. INDIVIDUAL CONSIDERATION 6A. Consider action to approve ar resolution casting the City's vote fort the election of the fourth member of the Board of Directors of the Dallas Central Appraisal District. Mayor Blake Margolis presented this item and supports Ms. Carrie F. Gordon. Mayor Pro Team Deb Shinder spoke of her support for Carrie F. Gordon. Council voted unanimously in support of A motion was made by Mayor Pro Tem Deb Shinder, seconded by Councilmember Michael Schupp, to approve the resolution. This item was adopted as RES-136-23. The motion Ms. Gordon. passed with a 6-0 vote. 6B. Consider and take action on a request by Gregory Cole for an Alternative Landscaping Plan under Section 77-504.1 of the Rowlett Development Code to allow a natural buffer as screening under section 77-207 (D)(2)(b) of the RDC for property adjacent to the DART rail line. The property is zoned Industrial Overlay (IO) District. The approximately 1.35-acre site is located on 4811 &4821 Grisham Drive, being Lot 3&4 of Toler Industrial Park 3, in the City of Rowlett, Dallas County, Alex Koenig, Planning Manager, presented this item and provided background. Deputy Mayor Pro Tem asked the applicant to come forward to speak directly to Mr. Gregory Cole and conveyed his AI motion was made by Deputy Mayor Pro Tem Jeff Winget, seconded by Councilmember Michael Schupp, to approve the resolution.
