Municipal Building - 4000 Main Present: Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Bowers, Councilmember Britton and Councilmember Schupp Absent: Mayor Margolis CALL TO ORDER 1. Mayor Pro Tem Shinder called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 ConsalatonwinAtomo), tos seekl legal advice from the City Attorney regardingi pending litigation involving the Greenway-Miller and Rowlett-Miller eminent domain case and pending condemnation matters. (30 minutes) Held after the Regular Session. Convened into the Executive Session at 8:09 p.m. Reconvened into open session at 8:42 p.m. INVOCATION The invocation was led by Deputy Mayor Pro Tem Jeff Winget. PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by Boy Scout Troop 646. 3. PRESENTATIONS 3A. Presentation of a Proclamation recognizing December 10th as International Human Rights Day and a request to light the downtown water tower in yellow. Councimember Bowers presented this item to members of the Rowlett Diversity, Equity and Inclusion Committee along with Planning Manager Alex Koenig. City of Rowlett 11510 3B. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Councilmember Schupp made the following announcements. Early Voting for Councilmember Place 1 Run-off Election ends today, December 5. Election Dayi is on Saturday, December 9. Election Day voting will take place at 6602 Dalrock Road, 4004 Main Street and several other voting sites throughout Rowlett. Arts in Education grants are available to public and private schools int the City of Rowlett and Cultural Arts grants are available to non-profit art organizations. The Parks and Recreation Department will bel hosting the Senior Holiday Luncheon on December 12th at 12:00 p.m. There will be food, fun and live entertainment provided by Derrick Culpepper. Mayor Pro Tem Shinder presented the Animal Spotlight-L Layla, a pitbull mixed breed. Mayor Pro Tem Shinder announced the Rowlett City Council once again brought home the Smartest City Award at the Garland Independent School District Education Foundation annual Tinsel & Trivia event. This is the fourth year in a row Rowlett Council has won. Consider action approving the minutes. City of Rowlett 11511 Consider action to approve minutes from the following City Council meeting(s): November 27, 2023 City Council Special Work Session and the November 28, 2023 City Council Special Meeting. This item was approved on the Consent Agenda. 5B. Consider actionapproving the execution of an Improvement Agreement. Consider action to approve a resolution authorizing the Mayor to execute an Improvement Agreement between the City of Rowlett, Texas, and Jackson-Shaw Company, that provides for a surety bond int the amount of $3,775,900 as financial guaranty, to ensure and secure the installation of public improvements to serve the Lakeview Business District commercial development. This item was removed from the Consent Agenda to be considered individually. Mayor Pro Tem Shinder read this item into the record. Engineering Director Jeff Cohen presented this item and provided information on the project. Mr. Cohen showed the background starting in April 2022 through December 2022. Jackson-Shaw proposes to secure public infrastructure with financial guaranty. To expedite development, Jackson-Shaw plans to construct commercial buildings at the same time as the required 1,100LF An motion was made by Councilmember Britton, seconded by Councimember Schupp. This section of the Merritt Road Interconnector. item was adopted as RES-138-23. The motion passed with a 5-0 vote. Passed the Consent Agenda A motion was made by Councilmember Schupp, seconded by Councilmember Britton, including all the preceding item(s) marked as having been approved on the Consent Agenda. The motion carried with a unanimous vote of those members present. 6. INDIVIDUAL CONSIDERATION 6A. Conduct a public hearing and take action on a request by TXI Harmony Apartments LLC, for Major Warrants to Article 5.4.11(b) of the Form-Based Code to allow a monument sign and Article 5.4.1 Wall Signs to increase the maximum size from 30 square feet to 137 square feet for a wall sign. The property is zoned Form-Based Urban Village (FB-UV) District and is located at 10001 and 11010 Harmony Hill Lane, south/east of the intersection of Merritt Road and the President George Bush Turnpike (PGBT), being Lot 1, Block B and Lot 1, Block A of Harmony Hill Addition in the City of Rowlett, Dallas County, Texas. The motion passed with a 5-0 vote. 6B. Conduct a public hearing and take action on a request by Joe Soliz, regarding an amendment to a Special Use Permit to allow ani increase in height and size for an: accessory: structure ina a residential zoning district that is over 500 square feeti ins size on property zoned Single-Family Residential (SF- 9) District. The 1.65-acre property is located at 4818 Chiesa Road, southeast of the intersection of Chiesa Road and Pennridge Circle, Lot 1 Block 1 of the Soliz Estate Plat, in the City of Rowlett, Dallas County, Texas.
