Municipal Building = 4000 Main Present: Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Reaves, Councimember Bowers, Councilmember Britton and Councimemberscnupp CALLT TO ORDER 1. Mayor Margolis called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION 2A. The City Counci shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) to consult with and seek legal advice from the City Attorney regarding the Waterview Golf Course and the golf course lease with American Golf Corporation. Convened into closed session at 8:15 p.m. Reconvened into open session at 9:06 p.m. (45 minutes) **After Regular Session** INVOCATION The invocation was led by Mayor Pro Tem Shinder. Presentation of Comprenensive Monthly Financial Report(CMFR) for the period ending September Budget Officer Alison Brown presented this item. 3B. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Mayor Margolis made the following announcements: Rowlett facilities will be closed on December 22, 25 and January 1 for the holidays. City of Rowlett 11515 FCC will not collect garbage and recycling on the following days: Monday, December 25 and Monday, January 1 - services will be postponed by one day during this time. All emergency The community survey for the Downtown Rowlett Strategic Plan is live, now through February 12, 2024. Rowlett residents, businesses, property owners, and visitors are invited to provide their insights on several topics that will help shape the future of Downtown Rowlett. CONSENT AGENDA Items 5E and 5F were removedi from the Consent Agenda to be considered individually. 5A. Consider action approving the minutes. Consider action to approve minutes from the following City Council meeting(s): December 5, 2023 City Council Meeting. This item was approved on the Consent Agenda. 5B. Receive the Investment Report. Hear presentation on the fourth quarter investment report for September 30, 2023. This item was approved on the Consent Agenda. City of Rowlett 11516 5C. Consider action amending the authorized representatives for the City's TexPool account. Consider a resolution amending authorized representatives to access, transmit funds, issue letters of instruction, and take all other actions deemed necessary or appropriate for the investment of funds with the Texas Local Government Investment Pool (TexPool). This item was approved on the Consent Agenda as RES-140-23. 5D. Consider action approving a payment to the Texas Commission on Environmental Quality. Consider action to approve a payment to the Texas Commission on Environmental Quality (TCEQ) for Services to Drinking Water System of the City of Rowlett in the amount of $65,917.25. This item was approved on the Consent. Agenda as RES-141-23. 5E. Consider action approving an Escrow Agreement with Cambridge Homes. Consider action to approve a resolution authorizing the Mayor to execute an Escrow Agreement between the City of Rowlett, Texas, and Cambridge Land Lake Park, LLCi in the amount of $83,323 as financial guaranty to secure the installation of public improvements to serve the Lake Park single-family residential development. This item was removed from the Consent Agenda tol be considered individually. Jeff Cohen, Director of Engineering, presented this item. Discussion was had concerning erosion, drainage, and the impact to the adjacent neighborhood. Council requested for the 270-day project completion time specified within the agreement be changed to 180 days. Peter Gomez with Cambridge Homes agreed to the change since the 180- day completion would not begin until the City of Dallas approves the construction within the take Ar motion was made by Mayor Pro Tem Shinder, seconded byl Deputy Mayor Prol Tem Winget, to approve the item as presented. An amendment to the motion was made by Deputy Mayor Pro Tem Winget, seconded by Councilmember Schupp, to change Section 1.4 paragraph B of the agreement from 270 days to 180 days for completion. Consider action to adopt an ordinance amending the Fiscal Year 2023 Adopted Budget. This item was removed from the Consent Agenda to be considered individually. The motion passed with a unanimous vote of those members present. This item was approved as ORD-039-23. 5G. Consider action to approve a resolution approving the grant of an easement to Atmos Energy. Consider action to approve a resolution accepting an offer from Atmos Energy to purchase, and granting an easement in, city-owned property located at 4700 President George Bush Turnpike the amount of $65,711 for the purpose of a surface easement and a temporary workspace to expand gas transmission facilities and authorizing the Mayor to execute necessary documents. Consider action to approve a resolution authorizing the Mayor to execute a Construction Manager At Risk contract with Speed Fab-Crete Corporation and accepting the Guaranteed Maximum Price proposal in the amount of $10,632,740.00, with a contingency of $225,000.00, for construction services for the construction of the Rowlett Sapphire Bay Public Safety Facility located at 1301 City Engineer Jeff Cohen presented this item. Comments were made regarding the need for Station A motion was made by Mayor Pro Tem Shinder, seconded by Deputy Mayor Pro Tem, to approve the item as presented. The motion passed with a unanimous vote of those MEMBERS OF THE CITY COUNCIL MAY REQUEST TOPICSTO BE PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING.
