Municipal Building = 4000 Main Present: Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Reaves, Councilmember Bowers, Councilmember Britton and Councilmember Schupp CALL TO ORDER 1. Mayor Margolis called the meeting to order at 7:00 p.m. 2. EXECUTIVE SESSION Convened into Executive Session at 7:01 p.m. 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.071 (Consultation with Attorney) to consult with and seek legal advice from the City Attorney regarding status and potential settlement of the Greenway-Miller/Rowlet-Miller condemnation lawsuit. (15 minutes) Convened into closed session at 7:17 p.m. and open session at 7:30 p.m. 2B. The City Council shall convene into Executive Session pursuant to Texas Govemment Code, $551.074 (Personnel) and 551.071 (Consultation with Attorney) to deliberate on and seek legal advice from the City Attorney regarding an ethics complaint filed against Councimember Britton. Convened into closed session at 8:23 p.m. and open session at 9:16 p.m. No action was taken; however, the complaint will remain open to be considered later but not beyond July 21, 2024. (15 minutes) INVOCATION The invocation was led by Brian Hiatt, Cornerstone Church. PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by Boy Scout Troop 646. 3. PRESENTATIONS City of Rowlett 11529 3A. Presentation of a Proclamation recognizing the Month of February as Black History Month and a request to light the downtown water tower in red, green, and yellow. Mayor Margolis, along with members of the Rowlett Diversity, Equity and Inclusion Commission presented this item. 3B. Present certificate to Leadership Rowlett Class 32. Mayor Margolis presented a certificate for this item to the graduating class. 3C. Presentation of Comprehensive Monthly Financial Report (CMFR) for the period ending December 31,2023. Alison Brown, Budget Officer, presented this item. 3D. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Mayor Margolis made the following announcements. Early voting for the March 5, 2024 Primary Election starts Tuesday, February 20 and ends on Friday, March 1, 2024. Check rowlett.com for all information regarding early voting. The Rowlett Library hosts Elementals programs for kids ages 5-8 on Wednesdays at 4 pm and STEAM Squad programs for kids ages 9-16 on Thursdays at 6 pm. Both programs provide fun concepts with at focus of science, technology, engineering, art, or math. To learn more: about library Citizens Police Academy begins on February 15 and we currently have 23 people enrolled. The Academy will run for 10 weeks and ends on April 18. This program gives citizens a better idea of Mayor Pro Tem Shinder presented the Pet Spotlight featuring Beethoven. She stated the Friends of Rowlett Animals were recognized as the Best Non-Profit Organization at the Rowlett Chamber of Commerce Awards Banquet. The groundbreaking ceremony fort the Sapphire Bay Public Facility Deputy Mayor Pro Tem Winget announced the Rowlett Youth Advisory Council's food drive will be Councimember Britton recognized former Councimember Pamela Bell as the First Woman of Councilmember Schupp announced the formation of the East Fork Steering Committee. City of Rowlett 11530 Stephanie Barrett, Rowlett Chamber of Commerce Member Finance Director, recognized Deputy Mayor Pro Tem Winget as the winner of the Best Phongeprer/aecgapher at the Rowlett Chamber of Commerce Awards Banquet, and Claudia Frausto, Senior. Administrative Assistant for Economic Development, as Ambassador oft the Year. 4. CITIZENS' INPUT One online public input email was received for this meeting. Item 5B was removed from the Consent Agenda to be considered individually. 5A. Consider actiona approving the minutes. Consider action to approve minutes from the following City Council meeting(s): January 16, 2024 City Council Meeting, January 23, 2024 Special City Council Meeting, and January 25, 2024 Special Work Session Meeting. This item was approved on the Consent. Agenda. Code and Boards and Commissions Handbook. 5B. Consider action to amend the Economic Development Advisory Board provisions in the Consider action to approve an ordinance amending the Code of Ordinances and the City's Boards and Commissions Handbook to modify provisions relating to the Economic Development Advisory Board (EDAB). This item was removed from the Consent Agenda. Brittney Farr, Director of Economic and Community Engagement, presented this item. Concerns were voiced regarding the ordinance language. Staff stated the ordinance language would be revised to make it more clear and would be provided to the Board and Commission Handbook subcommittee to integrate into the update handbook. This item was tabled. 5C. Receive the investment Report. Hear presentation on the first quarter investment report for December 31, 2023. This item was approved on the Consent Agenda. City of Rowlett 11531 Passed the Consent Agenda Ar motion was made by Deputy Mayor Pro Tem' Winget, seconded by Mayor Pro Tem Shinder, including all the proceeding item(s) marked as having been approved on the Consent Agenda. The motion carried with a unanimous vote of those members present. 6. INDIVIDUAL CONSIDERATION 6A. Consider action to approve a resolution authorizing settlement of the Rowlett V. Greenway-Miller condemnation case and to acquire land and construction easements fort the right-of-way expansion and construction of dedicated turn lanes at the northwest corner of the intersection of the President George Bush Turnpike and Miller Road in the amount of $281,731.60 in the amount of certified appraisals; authorizing the mayor to sign necessary documents, and the city manager to issue appropriate purchase orders. David Berman, City Attorney, spoke regarding this item. Ar motion was made by Mayor Pro Tem Shinder, seconded by Councilmember Britton, to approve a resolution authorizing settlement of the Rowlett V. Greenway-Miller condemnation case and to acquire land and construction easements for the right-of-way expansion and construction of dedicated turn lanes at the northwest corner of the intersection of the President George Bush Turnpike and Miller Road in the amount of $290,200.20 in the amount of certified appraisals. The motion passed with a unanimous vote MEMBERS OF THE CITY COUNCIL MAYI REQUEST TOPICS TOBE PLACED ON AN AGENDA FOR A SUBSEQUENT MEETING. ANY DELIBERATION OR DECISION SHALL BE LIMITED TO A PROPOSAL TO PLACE TOPIC ON THE AGENDA FOR A SUBSEQUENT MEETING. Mayor Pro Tem Shinder requested an item be placed on a future work session to discuss a TAKE ANY NECESSARY OR APPROPRIATE ACTION ON CLOSEDIEXECUTIVE SESSION of those members present.
