Municipal Building = 4000 Main Present: Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget, Councilmember Reaves, Councilmember Bowers, Councilmember Britton and Councilmember Schupp CALL TO ORDER 1. Mayor Margolis called the meeting to order at 6:15 p.m. 2. EXECUTIVE SESSION 2A. The City Council shall convene into Executive Session pursuant to Texas Government Code, $551.074 (Personnel Matters) to deliberate the appointment, employment, evaluation, reassignment, duties, discipline or dismissal of the City Attorney and take any necessary action related thereto. (15 minutes) 2B. The City Council shall convene into Executive Session pursuant to Texas Government Code $551.071 (Consultation with Attorney) and $551.087 (Economic Development), to discuss and receive legal advice on an Economic Development Incentive Agreement with Allofour Heritage House, LLC and to discuss commercial or financial information that the governmental body has received from a business prospect that the governmental body seeks to have locate, stay, or expand in or near the territory of the governmental body and with which the governmental body is conducting economic development negotiations with, and take any necessary action related thereto. (THIS ITEM WILL BE DISCUSSED AFTER THE REGULAR SESSION). (20 minutes) This item was held after the Work Session. Reconvened back into Executive Session ate 6:44 p.m. 3. WORK SESSION Ethics. 3A. Request for Appointment of a Subcommittee to Review and Recommend Revisions to Code of Mayor Pro Tem Shinder and Deputy Mayor Pro Tem Winget requested a City Council Code of Ethics Review Subcommittee be formed to review and recommend revisions to the Code of Ethics as a separate part of the Boards and Commissions Handbook. Mayor Margolis made comments and suggested tol look att the Code of Ethics holistically. Mayor Margolis appointed Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget and himself to the Subcommittee. This Subcommittee will come back with a draft for discussion at a later date. Cit of Rowlett 11544 4. PLEDGES OF ALLEGIANCE The Pledges of Allegiance were led by the City Councilimembers. 5. PRESENTATIONS 5A. Rowlett Veterans Recognition Program presentation of certificate to Veteran Andrew Dorcas. Mayor Margolis and Chris Kizziar with Veterans Resource & Outreach Center (VROC) along with Lorie Coates of Quilts of Valor, presented Mr. Dorcas with a certificate from the City Council and a quilt of valor. Officer Dorcas, a Rowlett Police Officer, served honorably in the military for 31 years. 5B. Presentation of an award to Council from The Salvation Army for participating in the Mayors Red Kettle Challenge. Sergeant Tolan from The Salvation Army presented a Salvation Army bell to the City Council for their participation in the Mayors Red Kettle Challenge on December 9, 2023. Mayor Margolis, Mayor Pro Tem Shinder, Deputy Mayor Pro Tem Winget and Councilmembers Britton and Schupp accepted the award. Recreation Department. 5C. Presentation of the Texas Amateur Athletic Federation (TAAF) Awards to the Rowlett Parks and Councimember Schupp, along with Mark Lord, Executive Director of TAAF, presented the Susan Gerard Young Professionals Award to Rheagan Shaw. Recreation Supervisor Erin Mudryaccepted the Member City of the Year Award, awarded to Rowlett for the second time in six years. 5D. Update from the City Council and Management: Financial Position, Major Projects, Operational Issues, Upcoming Dates of Interest and Items of Community Interest. Preston with Trail Creek Partners, Ltd. confirmed to the Mayor and Council that the maintenance of the assets of crushed granite trails along with open space improvements and responsibilties of the maintenance of these assets will shift back to the HOA. Trail Creek Partners, Ltd. will correct the 2019 paper trail to assure the responsibilities Amotion was made by Councilmember Schupp approving al Resolution for an improvement agreement to accept a performance bond in the amount of $4,046,117.00 as financial guaranty to secure completion of infrastructure and authorizing plat approval and release, and the issuance of building permits, for the Trails of Cottonwood Creek Subdivision; authorizing the Mayor to execute the agreement; and providing an effective date. Conduct a public hearing and take action to approve an ordinance granting a request by Tyler Scott, Kimley-Horn, on behalf of property owners Hopewell Development Il, LP to amend a Planned Development Standard within an existing Planned Development (PD)witha a base: zoning of General Commercial/Retalil (C-2) District. The property is located northwest of the cul-de-sac of Enterprise Drive, consisting of Lot 6, Block 1, Rowlett Business Park, a portion of Lot 3, Block 1, Boyd & Kneggs Business Park Replat, and Tract 6 of the U Matthusen Abstract 1017 also described as all of Tract 1 tot the Doreen Sue Liuzzi & Doreen Sue Luizzi Family Trust Inst. No. 201700024931, in Community Development Director Ross Altobelli presented this item. The applicant is seeking to amend the Planned Development (PD) District to increase the maximum number of semi- trallers/18-wheelers from two to eight per day. Amending the PD will accommodate the intended end users of the project and satisfy potential investors in the project. Of 17 Public Notices mailed, no responses were received within the 200-foot Legal Notice of the project and one negative response was received within the 500-foot range. Staff found that the proposed PD Amendment does not materially change the use, density, or character of the development. The Planning and Zoning Commission recommended approval of the PD. Amendment unanimously at the February 13, 2024 meeting. Council asked questions of Mr. Altobelli and the applicant. A motion was made by Deputy Mayor Pro Tem Winget, seconded by Councilmember Reaves, to approve an amendment to the Planned Development to increase the maximum City of Rowlett 11548 amount of sem-ralers/bwneler trucks coming and going to the site to no more than eight per day as well as installing signage on the property that requires truck access to be from the northwest exit and not the southeast and all truck traffic to be routed to the Mayor Pro Tem Shinder spoke about the previous Council making the original amendment placing the two-semi-truck limit on this property and doesn't see where anything has changed that would make that impact less of an issue now than it was then. Developer agreed to the two-truck limit when approved previously on July 11, 2023. Mayor Pro Tem Shinders stated she would not be voting Deputy Mayor Pro Tem Winget stated that he supports this item. A developer should have the opportunity to present to Council a request for an adjustment, course correct and to amend an item. Eight trucks are not a substantial impact throughout the day.
