RESOLUTION NO. 2023-02 A RESOLUTION OF THE CITY OF TOLAR TO DISAPPROVE THE PROPOSED 2024 BUDGET FOR THE HOOD CENTRAL APPRAISAL DISTRICT AND TO REQUEST THE REFUND OF ALL EXCESS RESERVE FUNDS COLLECTED WITH ANY INTEREST EARNED BY THEHOOD CENTRAL. APPRAISALDISTRICT FROMTHE TAXING ENTITIES TO BE DISTRIBUTED BACK TO THE ORIGINAL TAXING JURISDICTIONS THAT PAID THEM BASED ON THE SAME PERCENTAGES AS WHEN THEY WERE PAID. WHEREAS, Section 6.06 oft the' Texas Tax Code requires the chiefappraiser shall prepare aj proposed budget for the operations of the district for the following tax year and shall submit copies to each taxing unit participating in the district and to the district board of directors before June 15; and WHEREAS, the Chief Appraiser shall include in the budget a list showing each proposed position, the proposed salary for the position, all benefits proposed for the position, each proposed capital expenditure, and an estimate of the amount of the budget that will be allocated to each taxing unit; and WHEREAS, the Hood Central Appraisal District (HCAD) Board of Directors held a public hearing to consider the budget and Mayor Jarratt attended the public hearing with comments; and WHEREAS, the HCAD board completed its hearings, made amendments to the proposed WHEREAS, if governing bodies of a majority of the taxing units entitled to vote on the appointment of board members adopt resolutions disapproving a budget and file them with the secretary oft the board within 30 days after its adoption, the budget does not take effect, and the budget it desired, and approved al budget on July 19th, and board shall adopt a new budget within 30 days of the disapproval; and WHEREAS, If the total amount of the payments made or due to be made by the taxing units participating in an appraisal district exceeds the amount actually spent or obligated to be spent during the fiscal year for which the payments were made, the chief appraiser shall credit the excess amount against each taxing unit's allocated payments for the following year in proportion to the amount of each unit's budget allocation for the fiscal year for which the payments were made. Ifai taxing unit that paid its allocated amount is not allocated aj portion ofthe district's budget for the following fiscal year, the chief appraiser shall refund to the taxing unit its proportionate share of the excess funds not later than the 150th day after the end oft the fiscal year for which the payments were made. NOW,THEREFORE, BEITI RESOLVED! BYTHE CITYCOUNCILOFTHECITY OF TOLAR, TEXASTHAT: SECTION1. The Hood Central Appraisal District (HCAD) is hereby notified and informed that the proposed 2024 budget is disapproved by the Tolar City Council and the City Secretary will deliver this resolution to the HCAD Board of] Directors Secretary as formal notification. The proposed budget does not represent the budget that was adopted by the HCAD Board ofDirectors as voted upon on. July 16, 2023, and should not be approved by the taxing entities that fund this budget. SECTION2. Thel HCAD 2022 annual audit identifies an excess of funds that have been accumulated by the HCAD totaling $2,312,690 and these funds are hereby requested to be distributed to the taxing Jurisdictions in the same pro rate share as when they were collected. SECTION3. This Resolution shall take effect and be in full force immediately from and afteri its date ofadoption shown below. PASSED AND APPROVED this 7th day of August 2023.
