RECOMMENDED ACTION: Approve the Joint Resolution-Ordinance establishing the BZA. In2 2011, Sedgwick County and the City of Wichita jointly reviewed possible efficiencies that could be realized by combining services and functions in community development departments that would result incost savings and superior service to citizens and stakeholders. Bothgoverning bodies have approved the creation of a Metropolitan Area Building and Construction Department ("MABCD"). As part of this overall effort, County and City staff reviewed the feasibility of combining the currently separate Boards of Zoning Appeals now maintained by each unit of government. BZAS hear requests for variances from zoning standards and make decisions based on the same criteria set in state law. They also hear appeals of interpretations of the zoning code by the Zoning Administrator. Contractors often require variances for zoning, or seek review of the Zoning Administrator's interpretations. It was determined that a single board could perform these functions just as effectively as two separate boards, Int the course of that review, it was proposed to use the membership of the Metropolitan Area Planning Commission (MAPC) as the membership for the combined BZA. This proposal was intended to simplify the appointment process and to take advantage of an existing, board with appropriate knowledge and expertise. It also offers additional administrative cost savings and more opportunities for BZA Analysis: The functions of a Planning Commission and a BZA are distinct, SO it is necessary for both boards to exist. Against Women Grant Fiscal Year 2013; Submitted October 2012 PRIOR ACCOMPLISHMENIS The Office of the District Attorney for the Eighteenth Judicial District previously applied for and received funding for a project under the Federal S.T.O.P. Violence Against Women Act (VAWA). The District Attorney is seeking continuation of these funds for 2013. The existing project has increased utilization of direct and referred services for women who are the victims of domestic violence, sexual assault or stalking crimes. Funding has enabled the District Attorney to focus staff time and attention on the intensive needs of these victims, a concerted effort that would not otherwise have been possible. It has also allowed the compilation of statistical data that has and continues to assist in understanding the nature of such offenses and offenders; the effectiveness of pre-trial and post-trial safeguards and sanctions; and the important correlation between victim cooperation and positive prosecutorial outcomes. Between July 1, 2011 and June 30, 2012 the grant-funded case coordinator was assigned 417 new cases. Those new cases involved 433 victims of whom 343 were victims of domestic violence, 54 victims of sexual assault and 36 victims of stalking. The number served did not significantly vary from the information reported in the prior application. While this project has not completed the current funding cycle, its success is evident based upon its past performance. All victims were referred to various organizations for support services. The Wichita Area Sexual Assault Center (WASAC) and the two local abuse shelters are among the many agencies to which women have been referred. Victims are also being referred to agencies that can provide direct legal services, housing assistance, drug treatment and/or counseling. When applicable, information is provided to the victim on the process of 'For example, referrals have been made to COMCARE, Legal Services of Wichita, Three Trees and Parents of Murdered Children. Office of the District Attorney, 18th Judicial District Attorney Application for S.T.O.P Violence Against Women Grant Fiscal Year 2013; Submitted October 2012 obtaining a protection from abuse/stalking order and are referred to District Court when warranted. Additionally, office space and areas for victim consultation has been secured within the courthouse to accommodate a staff member from the YWCA Women's Crisis Center/Safehouse and a staff member from Catholic Charities Harbor House. These individuals work with victims as advocates in criminal cases prosecuted by this office, providing them with counseling services or upon request additional support as needed. The District Attorney staff works very closely with advocates from the Wichita Police Department whose involvement begins at the time of the incident and remains throughout the prosecutorial process. The case coordinator meets as needed with the staff of WASAC to coordinate victim services. The coordinator attends the monthly meetings of the Wichta/Sedgwick County Domestic Violence Coalition. The monthly meetings provide a forum for service providers to stay abreast of proposed legislative changes, changes to current laws, news and concerns of victims of sexual assault and domestic violence and to learn of new resources for victim referrals. Additionally, in October of last year, the coordinator was able to attend the annual Kansas Coalition Against Sexual and Domestic Violence which provides up-to-date educational information and networking opportunities. The Coordinator also was able to attend the Attorney General's Conference in April of this year. Providing immediate and sustained contact with victims of domestic violence, stalking and sexual assault is critical. Anecdotally, it has appeared that there was a direct correlation between victim contact, victim cooperation and positive case outcome. Case statistics bear out this reality. Of the 401 victims that have had their cases (386 defendants) reach a final disposition (sentencing, dismissal or acquittal), July 1, 2011 to June 30, 2012, the 2 Office of the District Attorney, 18th Judicial District Attorney Application for S.T.O.P Violence. The cooperation rate of victims of domestic violence was 65.7%, sexual assault victim cooperation rate was 89.6% and stalking victim cooperation rate was 89.1%. These rates are up slightly from the application data previously reported. The Victim Satisfaction Survey has proven to be a valuable tool to analyze and modify services. Victims are asked to rank six (6) services provided by grant personnel on a scale oflto 10. During the previous four (4) quarters, there were 327 surveys mailed out and 23 were returned. This equates to a 7% return rate. The rate of returned surveys increased slightly from the prior year. We continue to encourage victims to complete and return the surveys and have implemented a follow-up system with the hope of improving the return ratio. As the domestic violence and sexual assault crimes continue, SO do our needs for resources to maximize the likelihood of successful prosecution and to assist victims of these crimes in healing and moving forward with their lives. This project has been evaluated by grant monitoring staff of the Governor's Office of the State of Kansas. Evaluations have been positive, reflecting support for this project since its inception. An evaluation of the 386 cases closed between July 1, 2011 and June 30, 2012, revealed the following information: Referrals were made in every case involving domestic violence. The victims were given information via telephone, personal contact and/or the mail regarding local shelter and Cooperation was ranked by assessing points for contact, cooperation and appearances throughout various phases of the prosecution. A high score of five points is possible (contact and cooperation for the period between first appearance and preliminary hearing, appearance for preliminary hearing if requested, contact and cooperation between preliminary hearing and jury trial, appearances as needed before final disposition, and maintaining cooperation and contact through final disposition). The cooperation rate does not include homicide cases. 3 Office of the District Attorney, 18"h Judicial District Attorney Application for S.T.O.P Violence. Against Women Grant Fiscal Year 2013; Submitted October 2012 support group services. In every case involving sexual assault, victims were informed of services provided by WASAC. In cases involving a death, families are provided with contact information to Three Trees and/or Parents of Murdered Children. Additional referrals to direct service providers were made as needs were made known. Through follow-up contact and/or information provided by the service provider, it was determined that of the 312 victims who received referrals during this period, 131 made contact with at least one of the referred agencies. Atotal of 108 cases had children present at the time of the assault (27% of the disposed cases); 95 cases were domestic violence; 5 were sexual assault offenses; and 8 were stalking. At total of 134 victims obtained Protection From Abuse (PFA) or Protection From Stalking (PFS) orders. 90 were victims of domestic violence, 11 were victims of sexual assault, and 33 were victims of stalking. No contact orders were issued in 100% of domestic violence, sexual assault and stalking cases. State law mandates a 72-hour no contact order for all person crimes. Local practice keeps no contact orders in effect throughout the case unless otherwise ordered by the court. Drugs and/or alcohol were involved in 77 domestic violence cases, 13 sexual assault cases and 2 stalking (23.8% of the disposed cases). Forty-five (45) percent of the cases involve at least one weapon. The most common weapon is al knife or similar cutting instrument followed closely by firearms. Unfortunately, these statistics reveal the continued danger posed to the community due to crimes of domestic violence, sexual assault and stalking. 4 Office of the District Attorney, 18th Judicial District Attorney Application for S.T.O.P Violence. Against Women Grant Fiscal Year 2013; Submitted October 2012 PROBLEM STATEMENT AND NEEDS ASSESSMENT The Office of the District Attorney serves a metropolitan area of approximately 490,000 citizens. There were 3,819 criminal cases filed in district court during 2010, 3,533 criminal filings during 2011 and approximately 3,300 cases are expected to be filed in 2012. Over the last decade, there has been a significant increase in case filings and the criminal justice system is overburden as a result of the increased case filings. A large percentage of cases involve domestic violence, stalking, and sexual assault, usually 10-15% of the total. The severity of the criminal dilemma related to domestic violence, sexual assault and stalking within the Wichita area supports the need for the positions requested herein. According to a recently published Kansas Bureau of Investigations report, "2010, A Report On Domestic Violence and Rape Statistics In Kansas",covering the reporting period of 2008-2 2010; For the fourth year in a row, reported rapes decreased state-wide, down 2.5%, with a .38 rate ofincidents per 1,000 population; The number of reported rapes within Sedgwick County increased slightly between 2009 and 2010, with ai rate of .60 reported incidents per 1,000 population; State-wide reported domestic violence decreased slightly, by .2%, with an 8.3 rate of incidents per 1,000 population, resulting in 23,828 incidents and 14,194 subsequent arrests; State-wide domestic violence homicides decreased by 8.6% to 32 deaths reported in 2010. However, the percentage of domestic violence related homicides were at the highest level since 1993, an alarming 30.5%; Reported domestic violence incidents decreased slightly within Sedgwick County, with 14.25 per 1,000 population, down from 15.9 per 1,000 population in 2009. Against Women Grant Fiscal Year 2013; Submitted October 2012 7,226 domestic violence incidents reported in Sedgwick County in 2010, 7,534 reported in 2009, and 6,929 in 2008; The number of Protection From Abuse and Protection From Stalking orders filed in Sedgwick county reflects a dramatic and steady increase over the last one (1) to two (2) decades. For successful, pro-active prosecution, it is vital to have the cooperation of victims and witnesses. As our experience has shown, there appears to be a direct correlation between victim contact, victim cooperation and positive case outcome. 3 Domestic violence, sexual assault and stalking crimes are notoriously difficult to successfully prosecute in many cases. For prosecutors, preparation of these cases is extremely challenging. Defenses raised at trial - such as a consent defense in a sexual assault case, or self- defense/mutual combat defense in a domestic violence case - present difficult questions of fact for jurors to resolve and questions of law for courts to decide. In these cases, the need to gather and present evidence to corroborate the victim = forensic or relationship evidence - is paramount. Domestic violence cases serve as good examples of cases that require intensive pretrial preparations to present a compelling case for a jury conviction. One of the challenges in domestic violence case preparation is the lack of victim cooperation. Victim reluctance to cooperate with prosecution often is spawned by fear and lack of knowledge of the criminal justice process coupled with a lack of confidence in available resources. Previous grant awards for additional staff resulted in early and increased victim contact with a direct correlation to an increase in prosecutorial victories. Because of these realities, one (1) full-time case coordinator is needed to assist prosecutors with these types of cases. Currently the case coordinator is responsible for providing immediate and regular contact with victims to assist them in their commitment to the pending criminal prosecution. Establishing a rapport with the victim can directly affect victim commitment to the criminal justice process and in turn, can influence case outcome. The case coordinator supplies each victim appropriate referrals to those agencies that can provide needed services and support. The coordinator meets on a regular basis with social service providers which provide a mechanism to remain current of scarce resources and to establish and maintain solid working relationships that result in increased use of existing programs. Self-reported satisfaction of services is directly attributable to having compassionate staff dedicated strictly to assisting victims of domestic violence and sexual assault cases. Distribution methods have been enhanced and additional follow-up procedures have been put into place in an attempt to increase the return ratio. 4. Optimize success of prosecutorial efforts by utilizing the services of a case coordinator to assist attorneys in pre-trial preparations and case management. Additionally, will assess the victims' satisfaction with the services provided by use of a written victim survey and personal contact and encourage victim input and suggestions for program improvement. Such assessment would enable us to refine our procedures and services toi more fully accommodate victim needs. PROPOSED GRANT PROJECT STAFFING PATTERN One full-time case coordinator is required to perform duties necessary to accomplish the stated goals and objectives. COORDINATED COMMUNITIY RESPONSE INFORMATION The Case Coordination Division is an integral part of the District Attorney's Office. It works closely with law enforcement and the public. UNDERSERVED POPULATIONS At the heart of this proposal is the recognition that there exists a group of women in the community who are not served by the traditional social service agencies. These individuals represent the underserved population this proposal targets. This office is cognizant of the need to garner resources that will enable these women to circumvent the barriers that exist to their receiving needed assistance. The plan is to develop and continue to define those diverse elements among this subset that include special need victims i.e., disabled, physical, mentaly/emotionaly challenged, physicalymedicaly challenged, older women, gay and lesbian communities, racial ethnic groups and non-English speaking individuals. This program will track referrals made to specialized social service agencies and organizations such as Wichita/Sedgwick County Domestic Violence Coalition, law enforcement, Women's Sexual Assault Center, Catholic Charities Harbor House and the YWCA, that provide avenues to interpreters and other sources of support tailored towards individuals with unique needs. Survivors of homicide victims are referred to Parents of Murdered Children and' Three Trees for services specific to their unique needs. DISSEMINATION OF CRIME VICTIMS' RIGHTS INFORMATION When a criminal case is filed by the District Attorney's Office, relevant case information is provided to the Case Coordination Division. Case Coordinators provide victims with documents including the State of Kansas Victim Compensation Fund brochure and a victim packet consisting of restitution information/forms, An Informational Guide for Crime Victims and Witnesses (or An Injormational Guide for the Juvenile Justice System), both of which include the Kansas Victims' Bill of Rights and other pertinent victim and witness information. Additionally, a Spanish version of the An Informational Guide for Crime Victims and Witnesses is distributed when applicable. Case coordinators and prosecutors use the What's My Job In Court activity book for children as an educational tool. Information completed on the restitution forms assist the District Attorney's Office in maintaining contact with victims and ensures the accuracy of information previously provided. This also includes the Victim Impact Statement where victims may express how the crime has impacted his/her life. The court reviews this statement prior to imposition of sentence. The District Attorney encourages law enforcement officials to refer victims, their families and Witnesses to this office to ensure they receive appropriate victims' rights information. Also, this office provides referral information to the victims even in cases where criminal charges have not been filed. On October 1, 2012 the Sedgwick County Sheriff's Office was notified of a grant award in the form of a Cooperative Agreement from the Department of Justice to continue funding of the operations of the Internet Crimes Against Children (ICAC) Taskforce. The taskforce includes two detectives, one from the Sheriff's Office and the other from the Wichita Police Department (WPD). This agreement provides the mechanism whereby the County can reimburse the City of Wichita for the grant related costs of the WPD detective that were included in the approved grant award budget. Based on the approved budget the County will reimburse the City of Wichita no more than $107,076.83 for costs related to the ICAC Taskforce operations for the period 4/1/2012 through 6/30/2013. This Agreement is made and entered into this day of 2012, by and between Witnesseth: WHEREAS, this Agreement is made under the authority of K.S.A. 12-2908, which authorizes municipalities to contract with other municipalities to perform any governmental service, activity or undertaking that each is authorized by law to perform; and WHEREAS, COUNTY is the recipient ofa grant award from the United States Department of Justice for funding the Internet Crimes Against Children (ICAC) program operated by the Exploited and Missing Children' s Unit (EMCU); and WHEREAS, included in the award budget is a City of Wichita Police Department detective salary and benefits and vehicle service charges totaling $107,076.83; and WHEREAS, the COUNTY agrees to provide the CITY $107,076.83 from the ICAC award to cover staff and vehicle costs as identified the grant application budget excerpt (Attachment A): and the ICAC funds; and WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate WHEREAS, each governing body finds that the performance of this Agreement is in the best interests ofboth parties, that the undertaking will benefit the public, and that the division of costs fairly compensates the performing party for the services or functions under this agreement. NOW' THEREFORE, the COUNTY and CITY agree as follows: Section 1. COUNTY agrees to pay CITY a total of$ 107,076.83 ofICAC funds. Section 2. CITY agrees to use $ 107,076.83 for the staff and vehicle costs related to the Internet Crimes Against Children Project until 6-30-2013. Section 3. Nothing in the performance ofthis Agreement shall impose any liability for claims against COUNTY other than claims for which liability may be imposed by the Kansas Tort Claims Act. Section 4. Nothing in the performance of this Agreement shall impose any liability for claims against CITY other than claims for which liability may be imposed by the Kansas Tort Claims Act. Section 5. Each party to this agreement will be responsible for its own actions in providing services under this agreement and shall not be liable for any civil liability that may arise from the furnishing ofthe services by the other party. Section 6. The parties to this Agreement do not intend for any third party to obtain a right by virtue of this Agreement. Section 7. By entering into this Agreement, the parties do not intend to create any obligations express or implied other than those set out herein; further, this Agreement shall not create any rights in any party not a signatory hereto. Recommended Action: Approve the amendment to the CIP. The Plum Shelter project was originally included in the 2002 CIP. The project replaces a facility at Sedgwick County park that was demolished as a result of extensive termite damage.The project was initially delayed while Project Services and Park staff developed a strategy that ensured code compliance and encouraged in-house park staff to obtain licenses that would allow them to accomplish portions of the construction projects when appropriate and when their schedule permitted. Initial funding in the project was used to develop a generic design for future enclosed Since the remaining budget in the project was insufficient to initiate the redesigned project, the Division of Culture Entertainment and Recreation began directing their share of the liquor tax revenue in its Special Park and Recreation fund to this project beginning in 2006. While expenditure authority was increased in 2006, 2007 and 2008 consistent with the revenue received, that did not occur in 2009, 2010 and 2011 since the amount was insufficient to initiate the project. This year, as the revenue approached the needed amount to accomplish the project, Park staff had the original architect engineer update the cost estimate. After adjusting that estimate for materials already on hand and labor cost savings, Park staff and Facility Project Services together determined that This action requests approval of an increase in expenditure authority in the project by $127,618.94, an amount equal to its share of revenue received in 2009, 2010, 2011 and the first three quarters of 2012. The revised project total would then equal $236,955.94. As indicated earlier, Park and Project Services staff confirm this total is now sufficient to cover the estimated cost of the project and will enable park staff to schedule and initiate the project as their schedule permits. County staff will accomplish basic construction on the projects. Other project requirements such as heating and cooling, concrete work or plumbing are put out for bid.
