ORDINANCE NO. 2017-02 AN ORDINANCE OF THE CITY OF TOLAR, TEXAS, DECLARING UNOPPOSED CANDIDATES IN THE NOVEMBER 7, 2017 GENERAL CITY ELECTION ELECTED TO OFFICE; PROVIDING A SEVERABILITY CLAUSE; AND WHEREAS, the General City Election was called for November 7,2017 for the purpose of electing a Mayor WHEREAS, the City Secretary has certified in writing that there is no proposition on the ballot, that no person has made a declaration of writcejA candidacy, and that each candidate on the ballot is unopposed for WHEREAS, under these circumstances, Subchapter C of Chapter 2 of the Election Code authorizes the City PROVIDING AN EFFECTIVE DATE. and two Council Member to serve on the City Council in the City ofTolar, Texas; and election to office; and Council to declare the candidates elected to office and cancel the election. BEITORDAINED BY THE CITY COUNCIL OF THE CITY OF TOLAR, TEXAS THAT: Section 1. The following candidates, who were unopposed ini the November 4, 2014 General City Election are declared elected to office November 5, 2014 and shall be issued Certificates of Election following the time the election would have been canvassed: Council member Place 1 Council member Place 2 Council member Place 3 Matt Hutsell Sally Grimes Chip Foster Section 2. The November 7, 2017 General City Election is canceled, and the City Secretary is directed to cause a copy of this Ordinance to be posted on Election Day at each polling place that would have been used Section 3. It is declared to be the intent ofthe City Council that the phrases, clauses, sentences, paragraphs, and sections oft this Ordinance are severable, and ifany phrase, clause, sentence, paragraph, or section oft this Ordinance is declared invalid by the judgment or decree of a court of competent jurisdiction, the invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this Ordinance, int the election. since the City Council would have enacted them without the invalid portion. Section 4. This Ordinance shall take effect upon its final passage, and iti is SO ordained. PASSED, APPROVED, and ADOPTED this 18Hh day of September, 2017.
