Park project, Phase 2. The bulk of this effort would involve the development of a realistic construction budget for site improvements. The consultant's fees are determined by a percentage based on the current construction budget estimate of $440,440. Since the zoning change wasi not approved, the P&Z Commission had to act on the plat as a: function oflaw through the' Texas Local Government Code and recommended denial oft the Preliminary Plat. Adel provided a summary oft the Development Process and stated that the' TLGC Chapter 212 requires the Council act on the plat within 30 days oft the Commission action according toi the shot clock. Regarding the two conditions toi the zoning change application tabling: 1. Sanitary Sewer: Publicly available sewer: is located atl Halford and Smirl approximately 700' north of the subdivision in' TXDOT right-of-way. The applicant has requested a Variance to Section 158.09(C)(1) to allow the use of OSSFi in lieu ofproviding an approach sanitary sewer line, force main, and lift station; and: 2. Councilman Weaver stated that "zoning" is one of the most important steps the city makes and commended the P&Zforits] prudent request tol have all criticalinformation prior toi makingazoning decision and was therefore not surprised that P&Z took into consideration drainage and sanitary sewer before making a zoning decision, even if those steps are normally addressed in the platting stage. Councilman Krause stated that the requirements oft the shot clock are pushing to make this decision SO quickly which is why we are doing what we are doing tonight. Mayor Elam indicated the city has granted sewer variances in the past but they've been for lots much larger than 1 acre, for example 7 acre lots, and: furtheri indicated it was veryunlikely the citywould grant a sewer variance on 1acre lots, the lots would need tol be significantly larger to be considered. On April 10, 2023, notice of public hearing was published in the Dallas Morning News and on the city website. Notices were mailed to neighbors within 500'. Two notices were returned, one in opposition and one: in favor. The property is on 1.018 acres ini the Providence Addition. The applicant states they are requesting the Fence Variance because a fence of 4' is not sufficient for privacy and security; unusually small front yard for the neighborhood; and the driveway curvature and width require thej placement 5' ini front ofthel house. Perthe Fences"; Section 157.08(A), the City Council may allow a fence variance after a Public Hearing ifit determines that the enforcement ofa provision in Chapter 157 "Fences" meets one of the following four conditions: 1. Enforcing the provision is not in the best interest of the pubic; 2. Enforcing the provision constitutes waste or inefficient use of land or other resources; 3. Enforcing the provision creates an undue hardship on the applicant for a permit; or 4. Enforcing the provision does not serve its intended purpose, is not effective or necessary. Based on these four conditions, staffs recommendation is to approve the height Variance to Section 157.02 (C) foras 5' tall fence, but staffi is unable to recommend approval of the Variance to Section 157.02 (E) that requires at least 75% open area per linear foot based on design atl least 75% open area per. linear foot. Mayor Elam opened the public hearing at 6:58p.m. Karla Smith, 904 St. Anne Court. provided a presentation of slides in support of the request stating that where the home is positioned, allows vulnerability to security and privacy. The driveway is very close to the street and located in a cul-de-sac where four houses are higher in Wedell Smith, 904 St Anne Court - clarified that the proposed fence will tiei from thel back: fence elevation and look down onto the property. Weaver stated that consideration of fence height variances have been consistent over the past few years and have been allowed in rare instances where the proposed fence is on or behind the build line and not encroach SO closely to the front property line as in this case. Weaver agreed with the need fori the gate's proposed location due to driveway width, but recommended the proposed fence follow the curvature of the driveway and parking pad which would place it close to the build line whilt still achieving the applicant's security goal. Weaver was not comfortable with the variance to the 75% open area stating that this ordinancel hasl been inj place for al long time forai reason. Page 4of7 4.d Discussion Regarding a Draft Ordinance Adopting a Model Water Resource and Emergency Management Plan (Drought Contingency Plan) and other water system regulations for The CityofHeath tol Promote Responsible Use ofWater: and to Provide a Staged Plan for Implementation ofWater Use Restrictions During' Times ofDrought, Director of Public Works, Matt Holzapfel stated that Staff is seeking City Council comments and direction regarding proposed changes and additions to the existing City Code on proposed changes to the Water Resource and Emergency Management Plan (Drought Contingency Plan) and other water system regulations. Mr. Holzapfel explained that The State of Texas water resource: regulatory agencies Texas Commission on Environmental Quality (TCEQ) and the Texas Water Development Board (TWDB) have numerous regulations for water suppliers regarding the implementation of Water Conservation Plans, and Water Resource and Emergency Management Plans (Drought Contingency Plan). Mr. Holzapfel further explained that the North Texas Municipal Water District (NTMWD) has implemented these plans for their service area and has produced a model plan for adoption by members and customers. The City of Rockwall as a member oft the NTMWD developed a modified version oft the NTMWD model plan titled "Water Resource and Emergency! Management Plan" and adopted this plan on April 15, 2019, and August 5, 2019, which is codified ini the Rockwall City Code, Sections 44-432. The City of Heath adopted both the NTMWD and City of Rockwall's Water Resource and Emergency Management Plans (Drought Continency Plan) on October, 18, 2011, Ordinance 111018, City Code Section 51.02 and on July 14, 2020, Ordinance 200714A, City Code, Section 51.08. Holzapfel provided these three plans. Mr. Holzapfel explained that in the proposed ordinance staff suggests additional water restriction Stage triggers related toj percentage of the 6-million gallon maximum daily water use limit that is imposed on the City by its supplier and Water Restrictions or Water Emergency. listed the additional water restriction strategies for Stage 3 only, as follows: Ability toi impose a daily water use limit on all customers; Initiate "Load Sheading" by turning offi irrigation meters in the City; Prohibition of construction water use; Moratorium onj planting oflandscaping and turf; and Doubling of water rates fori the highest ratei tiers (over 50,000 gallons per month). The proposed changes to the ordinance will provide clarity to the enforcement process. The draft ordinance has been reviewed by City legal counsel. During discussion with City Council, Councilmember Jim Chester recommended only using percentages of the City supply capacity to trigger stages rather than strict gallons per day triggers. He suggested this would give the City flexibilityto: adjust these. levels as circumstances changed the Citywater supply capacity. Mr.Holzapfel agreed this suggested change was a great idea and would indeed give the City greater operational flexibility as supply capacity changed. Several City Councimembers expressed concern with the process and notification prior to turning off water supply to customers. Mr. Holzapfel stated that under normal circumstances staff would follow established internal policies, procedures and notification requirements. However, he stated that in an emergency advanced notice may be minimal and may only be: sent out through social media, etc. Mr. Holzapfel indicated that additional language would be inserted into the ordinance to clarify that any routine cut off of service to water customers would follow established policy and procedures and subject to City Manager approval. Staff requests council and public comments and direction regarding the proposed changes to the Water Resource and Emergency Management Plan (Drought Contingency Plan) and other water system regulations. Staffwill bring thei revised ordinance for council approval toi the May gth meeting. 4.e Discussion and Action Regarding a Resolution authorizing the City Manager to execute a contract between the City ofHeath and Peloton Land Solutions for the 2023 Director of Planning Aaron Adel stated that the Comprehensive Plan Steering Committee interviewed Peloton Land Solutions on April 6, 2023 as the consultant selected to update the 2018 Heath Comprehensive Plan. The 2018 Comprehensive Plan states that the Comprehensive Plan should undergo a thorough review and update every five years. City Council approved $80,000 for this service and the proposal was $90,000 from Peloton. Peloton will perform the following services for this task: Prepare project schedule andj provide schedule updates as needed; Provide monthly progress reports forreview by the City's Project Manager. The Comprehensive Plan Update. City Council Minutes - Aprill 25 Regular. Meeting. Page5of7 Project is anticipated to take eight to 121 months, with the schedule being flexible to accommodate changes. Peloton will provide our services as expeditiously as practicable with the goal of meeting ai mutually agreed upon schedule, once authorized by the City toj proceed. Invoices for all work completed during the period will be submitted monthly (with a progress report) for work performed; Prepare for and attend monthly coordination calls on Microsoft Teams with the project team. Up to 10 coordination meetings will be held; Compile notes for the coordination meetings; Provide direction to key team members and coordinate project tasks, events, and outreach, Communication; Planning Foundation; an Comprehensive Plan Update Development resulting in al Draft Plan for review, Public Hearing, and final adoption from the City Council This process is estimated twelve months for completion. Staff recommends approval of the Professional Councilman Weaver stated that the Council previously approved up to $80,000 for this service and asked for clarification and detail of the costs for the proposed $90,000. His overall concern was that this project is supposed to be at tweak oft the 2018 Comprehensive Plan, not ai major rework and was therefore expecting the proposal to be al lot less than $80,000, and that the scope of the project appears to be expanding. As the work has proceeded, we have worked with the franchise utilities in the area and utility contractor constructing storm sewer, water, and sanitary sewer improvements from Rush Creek Drive across the Causeway and on to the southern connection of Scenic to Hubbard. A concern has been expressed about the ability to save as many trees as possible particularly between Scenic to Scenic along the west side ofthe right-of-way. Wel have revisited the need for the proposed. 31-foot wide street and have determined the capacity to move traffic would not be significantly reduced ifan alternative 27-foot street is constructed. By doing SO, thei new edge ofp pavement could ber moved four feet further away from the existing tree line along the west side of! Hubbard from Scenic to Scenic and would give us al better chance to retain thet trees ini that area. In addition, there are no new driveways between Rush Creek Drive and the end ofthe Causeway SO1 no new traffic would be generated along that areai reducing the need for the wider section in that area as well. This will reduce the ability to park vehicles along the causeway. Hubbard Drive would remain a 37-foot wide street from Rush Creek Drive to. FM' 740 and would transition to a 27-foot wide street before entering the causeway. Ultimately the roadway will need to be 37' wide to be in compliance with the currently approved Thoroughfare Plan which is a referenced document in Staffrecommends: approval oft the modification to the 27-foot wide pavement width from Rush Creek Drive Rush Creek Drive to Scenic (south). the Comprehensive Plan. to Scenic, South.
