THE: STATE OF TEXAS S COUNTY OF SUTTON S CITY OF SONORA $ On this the 20"h day of December, 2021 the City Council for the City of Sonora met in Regular Session in the Council Chambers of City Hall with the following to wit: MEMBERS OF THE CITY COUNCIL: Mayor Juanita Gomez Darrell Barker, Councilmember Harold Martinez, Councilmember Lionel Cervantez, Jr., Councilmember Mike Sanchez., Councilmember Art Fuentes, City Manager Belia Fay, City Secretary Betty Hernandez STAFF: OTHERS ATTENDING WERE: Elaine Donaldson and Tammy Fisher CALL TO ORDER: Mayor Gomez called the meeting to order at 6:00 p.m. and led the Invocation followed by The Pledge of Allegiance to The United States Flag and The Texas Flag. PRESENTATIONS. RECOGNITIONS AND UPDATES WERE PRESENTED: City Manager Art Fuentes reported that the advertisement for a Chief of Police will be posted/published in. January. He further reported that one of the police officers had some injuries following aj pursuit on foot, but he is working light duty. CONSENT AGENDA: Councilmember Barker made the motion to approve the minutes for the November 15, 2021 Motion was seconded by Councilmember Sanchez and motion carried unanimously. DISCUSSIONAND ACTIONI ITEMS: 6a: MONTHLY WATER REPORT: The Monthly Water Report for November were presented by Charlotte McElwain. She reported that most of the new meters were installed. 6b: SONORA POLICEI DEPT.MONTHLY REPORT: Chief Fuentes presented the Police Dept., the Resource Officer Report and the Animal Control Reports. 6c: SENIOR CENTER MONTHLY REPORT: 6d: CODE ENFORCER MONTHLY REPORT: be: MUNCIPAL MONTHLY REPORT: The Senior Center Report was tabled due to report not being available. The Code Enforcer November Report was presented by Briggs. Thel Municipal Monthly Report for November was presented by Judge Kemp. He also reported that House Bill 569 has passed and this allows an individual that has prior minor charges to request time credit for time served in lieu of paying the fines and court costs for prior minor outstanding charges. Thus far, he reported that the city has lost $4,700.00 in fines that could have been collected but the defendants requested the credit for time served and thel Municipal Court cannot deny the request. 6f: WATER RECLAMATION MONTHLY REPORT: The Water Reclamation Monthly Report for November was presented by Don Barker. He reported that Tim Martinez has accepted another job in a different city and he will be advertising for a new employee. Don passed his Backflow Prevention Assembly Tester exam. Motion to approve the above-mentioned reports was made by Councilmember Sanchez Motion was seconded by Councilmember Martinez and it carried with the following votes cast: AYES: All members shown present NAYS: None 6g: SECOND READING: RESOLUTIONNO. 2021-R-12: A Second Reading was held regarding the expenditure of $100.000.00 of 4B Sales Tax Revenue will be to pay a part of the cost of expansion of the municipal sewer line to Exit 404 and will promote tourism and new or expanded business development. Resolution No. 2021-R- 12 was adopted upon a motion made by Councilmember Barker. Motion was seconded by Councilmember Martinez and it carried with the following votes cast: AYES: All members shown present NAYS: None 6h: APPROVING $5,757.92TO ADJUSTTHE SUTTON CO. HISTORICALSOCIETYS 2002 BUDGET: Mrs. Tammy Fisher addressed the Council and explained that due to COVID-19,they underestimated the 2020 Budget for the Sutton County Historical Society and unfortunately went over the budget by the amount of $5,757.92 and requested payment out of the HOTS Fund to make up for last year' 's shortfall. Motion to approve the payment of $5,757.92 out of the HOTS Fund and adjust the 2020 budget was made by Councilmember Barker and seconded by Councilmember Cervantez. Motion passed with the following votes cast: AYES: All members shown present NAYS: None 6i: REVIEW OFTHE SONORA TOURISM COMMITTEESEIRANCIAIS Mr. Max Howorth was present and presented the Sonora Tourism Committee's Financials. This matter was tabled and will be discussed for approval at the next meeting. 6j: DISCUSSION ONSICK LEAVE RELATED TO COVID-19 FOR EMPLOYEES: This matter was tabled. City Attorney Clint Griffin will draft a policy with different options and present it to the Council at the next meeting. 6k:REQUEST TO BUILD Al FENCE-420 W.3RD STREET: Mr. Gerardo Garcia requested permission to build a fence on his property at 420 W.3rd St. and would like to extend the fence all the way to the dead end of 3rd St. which street does dead end on his property. Councilmember Cervantez made the motion to approve the reports. Councilmember Sanchez seconded the motion and motion passed with the following votes cast: AYES: All members shown present NAYS: None 7:R REPORT AND OTHER INFORMATION: None 8:CITIZENS AND VISITORS' COMMENTS: Mr. Max Howorth inquired about the Air B& B Occupancy Tax and asked who enforces the tax. It was decided that Briggs will contact the owners of the Air B & B's regarding the tax. 9: ADJOURNMENT: There being no further business, Mayor Gomez adjourned the meeting at 7:42 p.m. upon amotion made by Councilmember Cervantez and seconded by Councilmember Barker.
