CITY COUNCIL MINUTES REGULAR MEETING KERRVILLE, TEXAS SEPTEMBER 24, 2019 On September 24, 2019, at 6:01 p.m. the meeting was called to order by Mayor Bill Blackburn int the City Hall Council Chambers at 701 Main Street. The invocation was offered by Councilmember Kim Clarkson, followed by the Pledge of Allegiance led by Councilmember Clarkson. PRESENTATIONS: 3A. Mayor Blackburn presented a Proclamation observing September 2019 as Recovery Month in the City. The Proclamation was received by Recovery Community Coalition members Leighann Fitzpatrick, Chief Dannie Smith, Dale Trees, and Kendall Young. 4. CONSENT AGENDA: Councimember Judy Eychner moved to approve the items on the consent agenda as presented. Councimember Gary Cochrane seconded, and the motion passed 5-0. 4A. Resolution No. 33-2019. A Resolution repealing specified resolution which address various aspects of the City's development process but which are no longer necessary or applicable based upon the adoption of a new: zoning code by City Council. 4B. Resolution No. 38-2019. Adoption of the 2019-20223 Airport Strategic Plan. 4C. Resolution No. 39-2019. A Resolution approving the budget for Kerr Emergency 9-1-1 4D. Renew Geographic Information System Enterprise License Agreement with 4E. Minutes for the City Council workshop held September 10, 2019. 4F. Minutes for the City Council meeting held September 10, 2019. Network for Fiscal Year 2020. Environmental Systems Research Institute, Inc. 4G. Minutes for the Kerrville-Kerr County Joint workshop held September 16, 2019. END OF CONSENT AGENDA: 5. ORDINANCE(S), SECOND READING: 5A. Ordinance No. 2019-23. Second reading. An Ordinance approving and adopting the City of Kerrville, Texas, Sign Code, a comprehensive rewrite of the City's sign regulations in accordance and aligned with the Kerrville Comprehensive Plan (Kerrville 2050); said rewrite to be known as the "City of Kerrville, Texas Sign Code" and found within a new Chapter 92 of the City's Code of Ordinances, which will repeal and replace Article II of Chapter 6 of the City's Code of Ordinances; adopting revised regulations concerning the installation and maintenance of signs within the City of Kerrville, Texas, and within the extraterritorial jurisdiction of the City; containing a cumulative clause; containing a savings and severability clause; providing for penalties not to exceed $2,000.00; ordering publication; providing an Drew Paxton presented the item, highlighted changes, and responded to questions. effective date; and providing other matters related to the subject. Discussion ensued among Council. Since neither citizen registered to speak in advance, they were not recognized and called forward. Mayor Blackburn moved to approve Ordinance No. 2019-23 with amendments, and Councilmember Eychner seconded. After discussion, both Mayor Blackburn and After Council comments and discussion, the following motions were made and some actions Councilmember Eychner moved to amend Ordinance No. 2019-23 to change to read "shall not exceed a light intensity or brightness level of 500 nits at night and 7,000 nits during the day'. Councimember Delayne Sigerman seconded and the motion passed 5-0. Councilmember Cochrane moved to amend Ordinance No. 2019-23, Section 92 -9-5"E to read "shall be supplied with underground electric service". Councilmember Clarkson Councilmember Clarkson moved to amend Ordinance No. 2019-23, Section 92 - 9-5"" Electronic Displays to read "shall operate in a way that the message remains static for 5 seconds'". Councilmember Cochrane seconded and the motion failed 2-3 with Councimember Clarkson and Councimember Cochrane voting in favor, and Mayor Blackburn, Councilmember Eychner, and Councilmember Sigerman voting against. Councilmember Clarkson moved to amend Ordinance No. 2019-23, Section 92 -9-7#9 to add G Street, between Sidney Baker South and Memorial Boulevard, to the list of free standing signs page 34 "free standing signs". Councilmember Cochrane seconded, and the motion passed 4-1, with Mayor Blackburn, Councilmember Cochrane, Councilmember Clarkson, and Councilmember Sigerman voting in favor, and Councimember Eychner voting Councilmember Eychner moved to amend Ordinance No. 2019-23, Page 33 item 1 to read "shall operate in a way that the message remains static for a minimum of 6 seconds". Mayor Blackburn moved to adopt the entire Ordinance 2019-23 as presented with the above approved amendments. Councilmember Cochrane seconded and the motion passed 5-0. 5B. Ordinance No. 2019-21. Second reading. An Ordinance adopting the annual budget for the City of Kerrville, Texas, Fiscal Year 2020; providing appropriations for each City department and fund; containing a cumulative clause; and containing a savings and Councimember Cochrane moved as follows: "Imove to approve Ordinance 2019-21 to adopt the City's budget for Fiscal Year 2020 on second reading." Ms. Eychner seconded. Councimember Eychner withdrew the motion and second. were taken. seconded and the motion passed 5-0. against. Councimember Sigerman seconded and the motion passed 5-0. severability clause. Through a record vote, the voting results were as follows: Mayor Blackburn YES Mayor Pro Tem Eychner YES Councilmember Cochrane YES Councimember Clarkson YES Councilmember Sigerman YES Councilmember Eychner moved as follows: "Imake a motion that we vote to ratify a budget that will require raising more revenue from property taxes than the previous fiscal year". 5C. Ordinance No. 2019-20. Second reading. An Ordinance levying an ad valorem tax for the use and the support of the Municipal Government for the City of Kerrville, Texas, for Fiscal Year 2020; providing for apportioning each levy for specific purposes; and providing when taxes shall become due and when same shall become delinquent if not paid. Councilmember Sigerman seconded, and the motion passed 5-0. Amy Dozier presented item. Councimember Eychner moved as follows: I make a motion that Ordinance 2019-20 be adopted and that the property tax rate be increased by the adoption of a tax rate of $0.5400, which is effectively a 3.4% percent increase in the tax rate." Councilmember Sigerman seconded. Through a record vote, the voting results were as follows: Mayor Blackburn YES Mayor Pro Tem Eychner YES Councilmember Cochrane YES Councilmember Clarkson YES Councimember Sigerman YES 5D. Ordinance No. 2019-22. Second reading. An Ordinance creating a "Planned Development District" for agricultural, commercial, mixed-use, office, open space, residential, and wireless telecommunication facilities on tracts of land making up an approximate 264.22 acres, as defined herein, and within the City of Kerrville, Kerr County, Texas; and more generally located southeast of the intersection of Farm-to-Market Road 783 (Harper Highway) and Interstate 10 and adjacent to and north of Holdsworth Drive; adopting a concept plan and conditions related to the development of said district; repealing Ordinance Nos. 2004-15a and 2017-19, which established the previous zoning oft the property, containing ac cumulative clause; containing a savings and severability clause; establishing a penalty or fine not to exceed $2,000 for each day of violation of any provision hereof; ordering Drew Paxton presented the item and responded to questions, and real estate consultant publication; and providing other matters relating to the subject. Bruce Stracke responded to questions. The following persons spoke: George Baroody Councimember Sigerman moved to approve Ordinance No. 2019-22 for the Planned Development District. Councilmember Cochrane seconded, and the motion passed 5-0. 6A. Resolution No. 37-2019. A Resolution amending the City of Kerrville Fee Schedule by revising fees charged for various services and uses provided or offered by the City. 6. CONSIDERATION AND POSSIBLE ACTION: Amy Dozier presented the resolution and highlighted revisions. Ms. Dozier and Eric Maloney Councimember Cochrane moved to approve Resolution No. 37-2019. Councilmember 6B. Resolution No. 40-2019. A Resolution nominating a candidate(s) to Kerr Central Appraisal District Board of Directors for the 2020-2021 term. (This item is eligible for Councimember Sigerman moved to approve Resolution No. 40-2019 and nominate Judy Eychner as a candidate to the Kerr Central Appraisal District Board of Directors. Councimember Cochrane seconded, and the motion passed 4-0, with Mayor Blackburn, Councimember Cochrane, Councimember Clarkson, and Councilmember Sigerman voting in favor, and Councilmember Eychner abstaining from the vote. Councilmember Eychner responded to questions. Sigerman seconded, and the motion passed 5-0. Executive Session, Section 551.074: Personnel Matters.) did not want to be included in a vote appointing her to this position. 7A. Financial update for the month ended August 31, 2019. 7. Councilmember Eychner moved to appoint the following seven individuals to the Main Street Advisory Board: Edward Hamilton, Mary Elaine Jones, J.
