MINUTES REGULAR CALLED MEETING HEATH CITY COUNCIL TUESDAY, JUNE 25, 2024 at 6:30 PM ATTENDING: JEREMIAH MCCLURE, MAYOR SHARON CALDWELL SCOTT DODSON RYAN MOORMAN BRENT WEAVER RICH KRAUSE ABSENT: PAUL: RUFFO, MAYOR PROTEM Mayor Jeremiah McClure called to order the Regular meeting at 6:30 p.m. Councilman Moorman delivered the Invocation and led the Pledge of Allegiance. 2. Public Comment Phyllis Salverson, 626 Sorita Circle - asked the City Council to enforce their Ordinances. From Ordinances regarding fireworks tot the' Take Area, the Cityl has nott taken action or fined violators. The current waters situation is very serious and wei must workwithi the communitytogete everyone to adhere to the watering restrictions and follow the schedules. 3. Consent Agenda 3.a Action Regarding the Minutes of the June 11, 2024 Regular Meeting. MOTION: APPROVE CONSENT AGENDA, ITEMS 3.a REGARDING THE MINUTES OFTHEJUNE 11th MEETING. MOTION MADE: SECONDED: APPROVED: ABSENT: WEAVER DODSON KRAUSE, RUFFO PASSED UNANIMOUSLY BYTHOSE PRESENT 4.a Discussion Regarding an Update on the Alternate Water Source Study, Water Conservation and Enforcement Program by the City, and Maintenance Repairs of City Engineer Richard Dormier provided a brief update stating that the Mayor, the Director of Public Work Bryan Creed and himself met with North Texas Municipal Water District NTMWDin June and are waiting for their response. We also submitted Heath's population projections and flow requirements to the City of] Rockwall and' 'are also waiting for their response. Wel believe both meetings were positive. We have also talked with RCH in the past and want to consider all our options. Director of Public Works Bryan Creed added that the pump replacement from 200hp to 300 hp is expected to happen within two weeks and provided a presentation "Stages of Water Conservation Measures" that is the city's plan to keep the water usage down during these hot summer months. Stage 1 Initiation: The current conservation policy is in this stage, limiting watering to two scheduled days per week; Stage 2 Initiation: if city water usage exceeds 90% (5.4- MGD) of the daily water supply limit for two days in a seven-day period. Limits watering to one scheduled day a week irrigation or sprinkler use. The new watering schedules follow the trash collection schedules for each region of the city. Stage 3 Initiation: City water usage exceeds 95% (5.7-MGD)ofthe dailywater supplyl limit fort two days ins seven days, or any set of conditions where ita appears that the City water demand will exceed the ability of City water system or water supply. Limits watering to once every other weeki irrigation or sprinkler use. (1) During Plan Stage 3 water restrictions the City Manager has authority tol limit all customers to a maximum daily water usage regardless of historical water usage. Ifa customer. has more than one water meter serving a lot or tract ofland the combined usage of all water meters for the lot or tract shall be used to determine the customer's usage limit; (2) During Plan Stage 3 water restrictions, the City Manager has authority to initiate load shedding of non-critical water demand (such as irrigation meters) to prevent loss of pressure in the city water system below the mandatory 20 pounds per square inch (psi); (3) During Plan Stage 3 water restrictions, the City Manager has authority to prohibit water use for construction purposes and may declare a moratorium on all grass or landscape planting until Stage 3 is terminated; and (4) During Plan Stage 3 water restrictions, the City Manager has the authority to double the water rates for all usage rate tiers for usages over 50,000 gallons a month. Creed's presentation also provided two zoning maps that mirror the trash pick-up maps. Map 1 is the Water Conservation Schedule (Stage 1 Year Round) two days a week and Map 2 is the Water Conservation Schedule (Stage 2 Restrictions) one daya week. Therev willl ber nowatering on Sundays during either stage to allow for the system to recover. Communication will begin with placing a sign at the neighborhood entrances, the Blue sign is the Water Conservation Schedule signs for Stage 1 and the Red signi is the Water Restrictions in Effect signs for Stage 2. Regarding the meter replacement project, Councilman Weaver reiterated that in Phase 1, 75% oft the city's meters have been replaced and although the data is not live yet, the data will be stored and retrievable for staff usage. Thej purpose oft the water schedule Zoning Maps aret to: reduce the peaksa and help flatten out the water usage load by staging it. Weaver clarified for the record that although Heath does have av water supply issue, Heath does not have a water loss issue as was misrepresented by some individuals. Most recent water loss reports show the city's water loss at 7% and 8% for the prior year. The State average is more than 15% and the goal is 10-12%. Anything under 10% is considered great and Heath is at 7%. Building Official Leisa Price provided a presentation regarding the enforcement of the water restrictions. Stage 1: The first offense is notification and warning and the second offense is notification and ticket. Stages 2 & 3 will be no warning and ticket on first offense. Creed added that the Summer Water Use Lawn and Landscaping Irrigation Consumption Report, lists the twenty top water consumers, twelve are commercial accounts and eight are residential accounts and four residential accounts are in the top ten. Mayor McClure reminded all of the Citizen's Portal on the website www.heathtx.com where one can report any information of concern and staff has a way oft tracking it. 4.b Update Regarding Hubbard Drive Phase; 3. Assistant Director of Public Works Mike Shook, Hubbard Drive Phase 3 stated that the project consists of replacing existing 6" water line that are forty year old Forney Lakes Water Supply lines, with new 18" water line. The Developer is responsible for 12" water line for the development and City is responsible for upsizing to 18" water line as in the Development agreement: and these funds are covered by the water impact fees. The upgrading willl bei utilized for the 5-year CIP firel low plan. Also, a storm sewer line will bei installed where drainage has been by open ditch. The street willl be widened to: 37.1 This portion oft thej project is approximately1350'inl length. This] project will require closing Hubbard Drive across the causeway area for one month and residents in Antiqua Bay will detour through the HG&YC. Other residents will detour using Rush Creek. Oncei thei intersection is complete and opened Antiqua Bay residents will have access to use the Rush Creek detour route. This is quite a large detour route affecting many residents. Staff will notify residents utilizing mail notices, contacting HOAS, doorhangers and signage. Thej post office, school district, DPSand trash service will also be notified. Regarding the trees that are in the city's right-of-way, some will be removed during construction but will make an effort to save as many as possible. Trees located on private property will not be removed. The project has had challenges since starting from road closures and detours are hard on everyone due to the limited access points available and maps of the detour routes were presented at tonight's City Council meeting. Cameron Slown, PE, Senior Project Manager with tnp, Inc. was present to answer any questions. The review of the waterline plan must take place before a completion date of the project is determined. City Engineer, Richard Dormier clarifiedi that thej part ofthe roadway from thel bridge tol Michael and Lee Drive willl bej paid by HGYC and not the City under the development agreement. Section 551.074: Deliberation regarding the appointment, evaluation,' reassignment, duties, discipline or lismisalofapubicofffiveroremployee, In accordance with Texas Government Code, Chapter 551, Mayor McClure closed Executive Session and reconvened the: meeting into open session at 8:38 p.m. stating that no action was taken in the regarding: (i) City Manager.
