CITY OF COOPER OCTOBER 9, 2018-5:05 PM CITY COUNCIL MEETING: - PUBLIC HEARING AND REGULAR MEETING COUNCIL MEMBERS PRESENT: DARREN BRADDY; MAYOR, E.. J.C CATES, ALLEN FOSTER, DONNA THOMASON, AND WILLIE "BEAR" WILKINS ABSENT: DAVID PHILLIPS CITY ATTORNEY: JAY GARRETT OTHERS PRESENT: EMILYHOWSE, JOE ADAMS, AMANDA L'ESPERANCE, JIM BUTLER, SUSAN RASER, KAREN ATKINS, KIMBERLY HAYNER, STEVE KILLIAN, AND ELDON FOX AGENDAITEM #1 AGENDAITEM: #2 Mayor Darren Braddy called the meeting to order and Darren also voiced the prayer. Mayor Darren Braddy opened the public hearing fori input from the public on the submission of an application to the Texas Department of Agriculture (TDA)f for a Texas Community Development Block Grant (TXCDBG). AGENDAITEM #3 Mayor Braddy stated that, if the application was approved, this grant would be ini the amount of $275,000.00 and would to go toward repairs at the Water Treatment Plant which would consist of revamping two ground storage tanks, the clarifier, and the raw water intake structure. AGENDA ITEM #4 After brief discussion on this matter, Mayor Braddy closed the public hearing on the TDA TXCDBG application submission at 5:12! PM. Mayor Braddy opened the regular council meeting at 5:12 pm. AGENDA ITEM #5 E.J. Cates made the motion to approve the September 11, 2018 minutes as written. Donna Thomason seconded. Allen Foster abstained due to his absence. Vote carried. AGENDA ITEM #6 The item to consider authorization of the Cooper VFD to submit an application for the 2018 FEMA Assistance to Firefighters Grant for the acquisition of P25-compliant mobile and portable radios was on the table for discussion. Mayor Braddy presented that the Cooper Volunteer Fire Department needed to replace their outdated radio system to comply with FCC'sP25 digital 1 standard. He stated that if the application was approved, this would be an $85,000.00 grant with a! 5% match which would be $4,250.00 ofv which Delta County ESD would be willing to pay 1/2ifthe City could pay 1/2f for at total match portion of $2,125.00 for each entity. Mayor Braddy stated that this was not budgeted but the city would try to locate funding. It was the consensus of the council to allow the submission oft the application, by the Cooper VFD, for the 2018 FEMA Assistance to Firefighters Grant, pending the city's match portion funding. Donna Thomason made the motion to allow the application submission. Allen Foster seconded. Vote unanimous. AGENDAI ITEM #7 Haley Newton with Certainty Home Loans has contacted the city by email stating that the property located at 1308 S.W. 10th had recently obtained a survey which indicated that the structure was not in compliance with the city's setback regulations. Mayor Braddy measured the setback distance and he concluded that the structure was compliant with the setback ordinance. City Attorney. Jay Garrett stated that he was not sure of the beginning point of the surveyor but lenders could not allow encroachment of property lines, therefore this matter should be directed to the Planning and Zoning Commission (P&Z) for review. If the P&Z approved to allow a variance they would then present it to the council with an ordinance, Donna Thomason made the motion to allow City Attorney. Jay Garrett to prepare an ordinance granting the variance of 1308 S.W. 10th pending the P&Z judgement. Willie "Bear" Wilkins prepared by City Attorney. Jay Garrett, stating SO. seconded. Vote unanimous. AGENDA ITEM #8 Kimberly Hayner presented to the council that she had previously received approval to place a "Little Free Library" at Harmon Park. She stated that she now thinks that placing it on the Pagoda would be al better location. Mayor Braddy asked City Attorney. Jay Garretti tifthere were any legal issues with this. Mr. Garrett stated that he saw no legal issues on this matter. Kimberly stated that she would be the person to monitor the content. It was the consensus of the council to allow the "Little Free Library" to be placed on the Pagoda. Allen Foster made the motion to allow the "Little Free Library" to be placed on the Pagoda. E.JCates seconded. Vote unanimous. AGENDA ITEM #9 Mayor Darren Braddy stated that the issue of state regulated handicap parking areas on the square had been brought to his attention. Darren said that he had done some research and found that there were more than enough spaces marked as handicapped, but they were not properly designated with a sign placard and the city needed one van accessible space. Eldon Fox asked what the penalty was for parking in a handicap area if you are not handicapped and who would enforce. such violation. City Attorney Jay Garrett stated that the fine was up to $200.00. Mayor Braddy stated that the Sheriff's Department would enforce these violations. Mayor Darren Braddy stated that he would get sign placards for each current handicap space on the square and would create one van accessible parking area on the square to become state compliant. Willie "Bear" Wilkins made the motion to purchase sign placards for each current 2 handicap parking area on the square and designate one van accessible handicap parkingarea ont the square. E.J.
