CITY OF COOPER  CITY COUNCIL MEETING-REGUIAR DECEMBER 7, 2020 VIAZOOM- -5:00PM  COUNCIL MEMBERS PRESENT: DARREN BRADDY; MAYOR, DAVID PHILLIPS, ALLEN FOSTER  (arrived late), AMANDA L'ESPERANCE AND DIANE STEGALL  ABSENT: ELMO ROBINSON CITY ATTORNEY: JAY GARRETT  OTHERS PRESENT: EMILY HOWSE, KASEY BRITTON,  AGENDA ITEM #1 AGENDA ITEM #2  Mayor Darren Braddy called the meeting to order and Darren also voiced the prayer.  Diane Stegall made the motion to approve the November 9, 2020 minutes as presented. David  Phillips seconded. Vote carried with 3 ayes.  AGENDA ITEM #3  David Phillips made the motion to approve the Sheriff's annual contract that was previously  approved but lost. Diane Stegall seconded. Vote unanimous.  AGENDAI ITEM #4  Mayor Braddy presented to the council the emailed resignation of Trustee Delbert Horton from the Frankie McKinney Foundation that he has served on since October 1998. David Phillips made the motion to accept the resignation of Trustee Delbert Horton from the Frankie McKinney Foundation. Amanda L'Esperance seconded. Vote unanimous.  AGENDA ITEM #5  Mr. Horton nominated James B. Price to take his place as Trustee for the Frankie McKinney Foundation. Mayor Braddy nominated Judy Falls for the Trustee position. Mayor Braddy stated that ini the past. Judy Falls was nominated for this position and the process was never complete. Diane Stegall asked why. Judy's process was not completed. City Attorney, Jay Garrett stated that when. Judy Falls was approved by the council, it was to the dislike of Delbert Horton. Jay stated that Delbert went directly to the 62nd District Judge and had him override the council It was the consensus of the council to appoint Mrs. Judy Falls as Trustee of the Frankie McKinney Foundation. This appointment must go before Will Biard, 62nd Judicial District Court of Texas, to approve this appointment as pert the Frankie McKinney Foundation--acting in his personal and not official capacity. After appointment is approved, the appointment document  decision.  will be filedi in the Delta County Court of Records.  1    Amanda L'Esperance made the motion to appoint Mrs. Judy Falls as Trustee toi the Frankie  McKinney Foundation. David Phillips seconded. Vote unanimous.  AGENDA ITEM: #6  Allen Foster made the motion to read resolution #01-12-20, appointing Mrs.. Judy Falls as Trustee to thel McKinney Foundation, in its entirety. Diane Stegall seconded. Vote unanimous.  City Attorney, Jay Garrett Read:  RESOLUTION NO. 01-12-20  AI regular meeting of the City Council of Cooper, Texas was held in Cooper, Texas at City Hall on 7th day of December 2020 at! 5:00 PM, a majority of City Council member being present and constitutinga  quorum, the following resolution was adopted.  NOW, THEREFORE, BE IT RESOLVED, BYT THE City Council of City of Cooper, that:  Delbert Horton has submitted his resignation serving as Trustee on the Board of Trustees of the NOW, THEREFORE, BE IT RESOLVED that the City Council appoints Mrs. Judyl Falls as Trustee of the BEITFURTHER RESOLVED that the Mayor of the City of Cooper, Texas be authorized, and hei is hereby authorized to sign this Resolution, and to sign alli instruments requisite in implementing this BEITFURTHER RESOLVED that the City Secretary of the City of Cooper, Texas be authorized and is hereby authorized to attest to the signature of the Mayor of the City of Cooper, Texas to said PASSED BY THE GOVERNING BODY OF THE City of Cooper, Texas, on the 7th day of December 2020. Diane Stegall made the motion to approve resolution #01-12-20 appointing Mrs. Judy Falls as Trustee to the Frankie McKinney Foundation. Allen Foster seconded. Vote unanimous. Mayor Darren Braddy updated the council on current events within the city.  Frankie McKinney Foundation since October 26, 1998. Frankie McKinney Foundation replacing Delbert Horton.
