PRESENTATION CORPORATION EDC-2024-01 BY BENBROOK ECONOMIC DEVELOPMENT Approve an Economic Development Performance Agreement between the Benbrook Economic Development Corporation (BEDC) and JVEP Commerce Centre, LLC Jessica James gave the following report: JVEP Commerce Centre, LLC purchased the Commerce Centre located at 4800 Benbrook Blvd. and is requesting economic development assistance from the Benbrook Economic Development Corporation The Commerce Centre is approximately 4.21 acres and contains seven different The proposed Commerce Centre project submitted to the BEDC Board includes (BEDC) to help refurbish the exterior of buildings. suites including office and small warehouse space. the following façade enhancements: replacing and repairing stucco and flashing on buildings where needed; and sealing and painting the exterior of all seven buildings; and replacing gutters throughout the property as needed; and replacing exterior lights throughout the property as needed; and restriping the existing parking lot; and updating landscaping throughout the property; and replacing irrigation as needed; and replacing two fences; and updating the existing signage. adding new garage doors for the eleven warehouse suites; and The project aligns with BEDC's mission to "Build A Better Benbrook" through investing in projects that support redevelopment, job retention and creation, and increases sales/property tax revenue. 2 On January 16, 2024, the Board held a public hearing during their regular meeting and approved a reimbursement grant upi to 60% oft the actual costs of the project not to exceed $275,000 and authorized the president to sign an economic development performance agreement. The Economic Development Performance Agreement establishes: A. Duties of JVEP Commerce Centre, LLC; and B. Duties of the BEDC Motion by Mr. Phillips, seconded by Ms. Mackey to approve the Economic Development Performance Agreement between the BEDC and JVEP Commerce Centre, LLC. GENERAL G-2646 Adopt Ordinance amending Title 15-Buldings and Construction of the Benbrook Municipal Code (1985), as amended, by amending various sections of Chapter 15.40-Flood Hazard Protection relating to the repair and improvement of structures located within the Area of Special Flood Hazard Jim Hinderaker gave the following report: The City of Benbrook has participated in the National Flood Insurance Program (NFIP) since 1979. To participate, the City must adopt and enforce Federal Emergency Management Agency (FEMA) floodplain regulations sO Benbrook residents and property owners are eligible to purchase flood insurance. The City's floodplain regulations are codified in Chapter 15.40 of the Benbrook Municipal Code and were most recently updated in April Staff recently conducted a periodic review of Chapter 15.40 of the Benbrook Municipal Code. Based on this review, Staff recommends amending Chapter 15- 40 Flood Hazard Protection ofi the Benbrook Municipal Code to reduce immaterial restrictions and provide additional improvement options for properties situated in 2021. the floodplain. Updates and adds terms in the Definition section Adds a nonconforming section for uses and structures 3 Eliminates the requirement for a city issued floodplain permit for "general maintenance", which includes all repair work and other improvements to properties that otherwise do not require a permit from Exempts property owners from having to obtain a permit to perform routine grounds maintenance, landscaping, and home gardening Clarifies the provisions for flood hazard reduction for new construction Allows structures located in the floodway to be repaired or improved provided the total cost is less than 50% of the value of the structure. Costs over 50% of value are considered substantial improvements and require the structure to be raised to the Base Flood Elevation plus 2 the city and substantial improvements feet. The proposed updates provide additional citizen flexibility without endangering Benbrook's National Flood Insurance Program Risk Rating. FEMA's current floodplain maps for the Benbrook area became effective March 21,2019. Motion by Dr. Marshall, seconded by Mr. Addison to adopt Ordinance No. 1498 amending Chapter 15.40 Flood Hazard Protection. Vote on the Motion: Mr. Tiner Noes: None Ayes: Ms. Franklin, Dr. Marshall, Mr. Phillips, Mayor Ward, Mr. Addison, Ms. Mackey, Motion carries unanimously. Ordinance No. 1498 being "AN ORDINANCE AMENDING CHAPTER 15.40 - FLOOD HAZARD PROTECTION, TITLE 15 - BUILDINGS AND CONSTRUCTION OF THE BENBROOK MUNICIPAL CODE (1985), AS AMENDED, BY REVISING THE CITY'S FLOOD HAZARD PROTECTION REGULATIONS; PROVIDING FOR VIOLATIONS, PENALTIES AND INJUNCTION; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A - SAVINGS CLAUSE; PROVIDING FOR PUBLICATION IN PAMPHLET FORM; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE." SECTION II PENALTY CLAUSE Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this Ordinance shall be fined not more than Two Thousand Dollars ($2,000.00). 4 SECTION IX EFFECTIVE DATE This ordinance shall be in full force and effect from and after its passage and publication as required by law.
