Benbrook MINUTES OF THE MEETING OF THE BENBROOK CITY COUNCIL THURSDAY, MAY 16, 2024 The regular meeting of the Benbrook City Council was held on May 16, 2024 at 7:30 p.m. in the Council Chambers with the following Council members present: Jason Ward, Mayor Renee Franklin Larry Marshall Dustin Phillips Laura Mackey Keith Tiner Also Present: Andy Wayman, City Manager Jim Hinderaker, Assistant City Manager Joanna King, City Secretary Brooke Teal, Planning Technician Rick Overgaard, Finance Director Pastor Toby Dingler Peter Kau Penny Story John McQueeney and two other citizens Others: I. REPORTS FROM CITY MANAGER G-2654 Accept Finance Report for period ending April 30, 2024 Mr. Overgaard gave the following report: General Fund revenues for the month of April, the seventh month of the fiscal year, were $2,850,597. Major revenues collected for the month include Property taxes of $108,221, Franchise taxes of $18,687, Permits of $49,851, Fines and Forfeitures of $67,914, Charges for Services of $79,460, Other Agencies of $39,000, and Interest of $108,816. The City also received a distribution from the TIF of$1,934,916, closing out the expired TIF District. Sales tax collected and recognized as revenue in April was $435,927. Fiscal year to date sales tax is $2,843,529, an increase of 11.6% over last year at this time. General Fund revenues collected through the end of April were General Fund expenditures for the month of April were $1,675,432. Fiscal year to date expenditures were $12,199,338 and 49.7% of the adopted budget. Fiscal year to date expenditures increased compared to last year because EMS salaries were reimbursed from the American Rescue Plan Act (ARPA). The ARPA grant Total General Fund revenues of $24,145,470 were more than total General Fund Debt Service revenues for the month of April totaled $8,090 and were all from property tax. There were no expenditures in April. The next debt service payments EDC revenues for April were $236,265. EDC expenditures for April were $38,772. $24,145,470 and 98.4% of the budget. expired in October 2023. expenditures of $12,199,338 by $11,946,132. are due August 1, 2024. Revenues exceeded expenditures by $197,493. Revenues received for April were $21,817 from stormwater utility fees, mineral lease revenue, and interest earnings. Expenditures for the Capital Projects Fund 2 were $3,731,915 for April. April expenditures included the TIF distribution to the TIF partners, Dutch Branch Drainage Study, and the Cedar Creek and Timbercreek Drainage Projects. Expenditures exceeded revenues by $3,710,098. Sufficient funds are available in the current fund balances of the Capital Projects Fund. This fund operates on a project basis rather than a specific fiscal year. On April 30, 2024, the City had $41,742,851 invested at varying interest rates; the Motion by Ms. Franklin, seconded by Ms. Mackey to accept the finance report for EDC had $8,978,329 available. the period ending April 30, 2024. G-2655 Adopt an Ordinance amending Chapter 1.12 of the Benbrook Municipal Code by revising fees for City Services Mr. Hinderaker gave the following report: The City periodically reviews its fee ordinance to ensure City fees are adequate to cover costs and comparable with other Staff is recommending changes to Chapter 1.22 of the Benbrook Municipal Code related to 1) Business Licenses, 2) Animal Fees, 3) Building Permit Fees, and 4) cities. Development Fees. Business Licenses The existing Business Licenses fees have been in place since at least 1998. Recommendation: Annual Solicitor's Registration Fee From $15 to $100 per solicitor From $15 to $80 per wrecker Annual Wrecker Fee 3 Animal Fees Animal related fees were last updated in 2002 Recommendation: Transfer Fee From $20 to $40 per animal From $40 to $50 maximum per same litter Registration Fee (annual) From $5 to $10 (dog or cat) From $50 to $300 (dangerous dog) Duplicate Tag Fee From $1 to $5 Impound Fee From $25 to $40 (first offense) Increased to $10 per offense if occurring within a 12-month period Impound Daily Handling Fee From $5/day to $10/day (if vaccinated) From $10/day to $20/day (if not vaccinated) Quarantine From $7.50/day to $20/day 10 day minimum Animal Head Testing From $50 to $250 Building Permit Fees Ona average, Benbrook is charging significantly less that comparison cities. Recommendation: Increasing all commercial building permit fees and plan review fees by 10%. Temporary Certification of Occupancy Establish a $300/month fee Swimming Pool From $300 to $375 (based on $35K pool value) Small Job (water heater, electrical service panel, alc replacement, etc.) From $50 to $75 4 Development Fees On average Benbrook is charging less for rezoning and comprehensive plan amendment fees than comparison cities. Recommendation: Plat Fee Reduced to flat fee of $300 Create a separate engineering plan review fee Alternative Tree Pleservation/Mitgation Establish a $250 fee Landscaping Plan Review Establish a $150 fee Zoning Verification Letter Establish a $50 fee Document Recording with Tarrant County Establish a $50 fee (to cover processing costs) Public Meeting costs) Establish a $300 fee (to cover increasing legal notice and software licensing Motion by Ms. Mackey, seconded by Mr. Phillips to adopt Ordinance No. 1500 amending Chapter 1.12 of the Benbrook Municipal Code revising fees for City Services. Ordinance No. 1500 being "AN ORDINANCE OF THE CITY OF BENBROOK, TEXAS, AMENDING CHAPTER 1.12- FEES FOR CITY SERVICES, TITLE1- GENERAL PROVISIONS OF THE BENBROOK MUNICIPAL CODE, AS AMENDED, UPDATING CITY FEES BY AMENDING SECTION 1.12.040 "BUSINESS LICENSES," SECTION 1.12.050 "ANIMALS," SECTION 1.12.080 "BUILDING AND CONSTRUCTION, AND AMENDING SECTION 1.12.090 "ZONING, SUBDIVISION, AND DEVELOPMENT'; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL ORDINANCES; PROVIDINGA SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR ENGROSSMENT AND ENROLLMENT; PROVIDING FOR PUBLICATION 5 IN PAMPHLET FORM; PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING AN EFFECTIVE DATE." SECTION 12 EFFECTIVE DATE This Ordinance shall be in full force and effect from and after its passage and publication as provided by law, and it is sO ordained. VI.
