KIT CARSON COUNTY BOARD OF COUNTY COMMISSIONERS MINUTES AUGUST 17, 2022 The Kit Carson County Board of County Commissioners meeting was called to order at 8:00 AM. Those present were Dave Hornung, Stan Hitchcock, Cory Wall, Lynsay Cormack, Susan Corliss, Kelly Alvarez, and Jeff Cure. Also attending were Chris Haas, Brandon Smith, Andy Spielman, Jennifer Herron, Jessica Rodriguez, Natalie Graves, and Trev Comstock from NextEra and associates. Bond Beams was with Las Animas Mineral. Commissioner Meeting to convene with Pledge of Allegiance The Pledge of Allegiance was recited by all. In-Person Schedule - Commissioners Board Room 8:00. AM-I NextEra - Wind Farm Project & Met Tower Projects NextEra MET Tower - E2 Section 17, Township 10S, Range 46W - 4M Feeders; Variance Needed NextEra MET Tower - E2 Section 17, Township 11S, Range 46W - 4M Feeders; Variance Needed; 2nd Phase Wind Farm Permit for Bronco Plains II Wind LLC Discussion on the mineral rights for the oil wells were expressed by Bond Beams. He would like language in the application that would require NextEra to negotiate with mineral owners in the Bronco Plains II project. Concern was raised that the complaint letter was received just before the public hearing; NextEra stated that the letter was presented for legal review on their part but that would take time. The Board of County Commissioners stated that mineral owners needed to be involved in the process much earlier, since notification was sent out over 60 days ago. Also, there is language in state statute that addresses and protects-mineral The application will be conditional ofitems that are missing. Jennifer Herron gave an update on these items and stated they would be completed and turned in within 30 days. Cory Wall moved to approve the Land Use Application for NextEra applying for an Industrial development permit for Dusty Rose Wind MET Tower 1 located in West Halfof Section 17, Township 10S, Range 46W on a private agricultural land owned by 4M Feeders, seconded by Dave Hornung. Dave Hornung moved to approve the application variance for a Land Use Dusty Rose Wind MET 1 within 500' of parçel line per landowner request, specifically DM01 lies within 297 ft of the parcel line, seconded by Cory Wall. Discussion was held on a renting process for the building based on rates from the community building and neighboring counties' facitilities. A rental agreement for the Farm Credit of Southern Colorado Show Pavilion will be drafted by Lynsay Cormack and Collin, which will be presented for approval. Discussion was held on budgeting for upgrading some oft the electrical in the buildings at the fairgrounds and possible 9:00. AM- Collin Koop - Grounds & Buildings - Updates bathrooms in the Farm Credit of Southern Colorado Show Pavilion. 9:30 AM-I DHS-I Monthly Financials See Board of Human Services Agenda 10:30 AM-Todd Holmes/Vyve. Phone system The courthouse phone system is 13 years old and issues of the systems being down or parcially down is happening quite often. Todd noted that the hardware cannot be replaced without purchasing another license. Donavan Roger and James Miller of Vyve explained the process to change the phone system at the courthouse to a Voice Over IP with the possibility of creating an umbrella of all Kit Carson County phones; the process would be in phases including staff training. Support would include firmware updates and phone replacements if needed. A detailed proposal will be presented at a later meeting. 11:00 AM- -Jeff Cure - County Attorney The Land Use for the County Right-of-Way was reviewed as written. Past situations were reviewed that confirmed the companies received easements from the land owners for using the right-of-way. Guidelines for mineral interests involved with solar leases need to be addressed. 20220817 Board of County Commissioners Minutes Pagel 12 11:00 AM - Abbey Mullis Assessor- Board Of Assessment Discussion Rescheduled for next week. 12:00 PM-Lunch and Susan Corliss. 1:00 PM - Work Session The Board of County Commissioners recessed at 12:00 PM: returning at 1:00 PM. Those present for the session were Dave Hornung, Stan Hitchcock, Cory Wall, Lynsay Cormack, Randy Gorton shared with the board clean up that is being done in Vona that is coming in with mixed loads ofitems for the landfill. He would like to work with Bethune to take some of the dirt and bio-solids to cover the closed cell. The board asked tol be kept up-to-date on the two projects. 1. New Items 2.A Community Ambulance New Ambulance Certification Director Ryan Bancroft submitted an application for licensing ai new ambulance for Community Ambulance. It was explained that KC#7 has been retired. The request was made to change certification identity of KC#7 to the current KC#8. They would like to have KC#8 as the newest ambulance. The paperwork has been noted ofthis request. Cory Wall moved to authorize certification for Community Ambulance with Certificate #200 for the new ambulances identified as KC#8 to provide services in Kit Carson County, seconded by Dave Hornung.
