Roger Munson spoke on behalfo of the. Fire department. And at their last meeting they discussed offering upi their donation amount for the Sedgwick County Economic Development instead. Public Comment from Dora Devie expressed that service is mainly geared towards the east side oft the county.Isupport donating to them, but not the whole $15,000 they are requesting. Ireached out to SPWRAP, andl IV was informed that to construct: a newl licensed wastewater treatment facility that is valid in the eyes of the State and Federal government, we will need to consult with US Fish and' Wildlife Service (USFWS) on depletions to the South Platte River caused by the Town's existing drinking water wells. This will most likely require the Town to pay a small additional annual membership fee to SPWRAP, along with al largeri initial fee to. join SPWRAP, so wanted to consult with the Town Platte River Recovery Implementation Program, administered by SPWRAP, was established in 2007 to protect endangered species in the Nebraska segments of the South Platte River. Aslunderstand it, this program is essentiallya way to satisfy requirements for endangered. spècies protection established by USFWS. USFWS requires any water drawn from the South Platte River basin to be "replaced" to ensure downstream conditions dor not become too dry for Apparently, all communities that have been required to adhere to this water replacement have joined SPWRAP, as SPWRAP has an agreement with USFWS to replace water drawn by all its member communities. Ine exchange, SPWRAP assesses an annual fee to all its member communities. The annual fee assessed to each member community is proportional to the total amount of water treated by the community for distribution to customers. Using rate information supplied to us by SPWRAP, iti is estimated the annual fee assessed toi the Town for 2023 would be approximately $166. However, to become a member, SPWRAP requires new members to pay retroactive assessment fees going back to the start oft the program in 2007, plus interest, which would mean the Town would have to pay. approximately $2,700 initially, including the 2023 payment of $166, toj join (see the attached SPWRAP assessment calculation). Ispoke with Rich Belt, the Executive Director at SPWRAP, because Ithought it was somewhat ridiculous that the Town would have to pay another. sizeable fee for water replacement, as the Town is already likely required to pay an increased feei for augmentation to Sedgwick County Well Users. He: says water replacement and the associated fees are: still required, because fees paid to the Sedgwick County Well Users are for an intrastate agreement, while fees Rich with SPWRAP said there is a possibility that the Town could negotiate directly with USFWS on a replacement scenario without joining SPWRAP. However, he says no community on the South Platte River basin has ever negotiated directly with USFWS for this, and he estimated it could take approximately three years to finalize this agreement directly with USFWS (which would conflict with the WWTF Improvements Project timeline). Rich could get us al USFWS to reach out to with questions if the Town wishes to reach out directly to USFWS. Either way, Rich with SPWRAP asked if someone at the Town would bei interested in speaking with him directly.
