Mayor Wolfe called the Regular Town Board Meeting to order at 6:00 P.M. Roll Call. Mayor Chris Wolfe, Trustees Katie Gill, John Leonard, David Wirtz, Paul Sutton, and Adam Way were present. Trustee Sean Forey was absent. A quorum was established. StaffPresent. Agenda. Trustee Gill added Trail Committee to the Agenda under General Neverdahl (Town Clerk), Courtney Christensen (Deputy Town Clerk). Business. Public to Address the Board. None. Presentations and Hearings. Red Rocks Amphitheatre 10-Year Sounds Review. David Glade, 111 Wood Lane. Glade presented tot the Board as study he conducted on the Red Rocks Amphitheatre. Glade stated itl had been ten years since the last acoustic consultant review of Red Rocks Amphitheatre. Glade stated that Red Rocks Amphitheatre is the top five busiest venues in the world and thet top-ranked Outdoor Venue in 2023. Red Rocks Amphitheatre had record ticket sales of over 1.65 million in 2023. Glade highlighted that between the years 2000-2023, there has been a 567% increase in concerts. Glade reviewed the current time and sound pressure level restrictions for all events at Red Rocks Amphitheatre. Glade reviewed Fiddlers Green Amphitheater curfew and sound limits. Glade highlighted that Fiddler's Green Amphitheater provides the Greenwood Village Police Department with a spreadsheet showing the exact decibel reading after every event. Glade stated that the volume of concerts and events at Red Rocks Amphitheatre has significantly increased light pollution and traffic congestion in the Town. Glade reviewed his proposed recommendations and suggested the Town review and hire an independent consultant to review the Amphitheatre's current regulations. Glade also suggested the Town establish al Red Rocks Concert Noise Line and analyze the health effects ofnoise pollution. Glade recommended the Town adopt thel Dark Sky recommendations for outdoor lighting. Glade also proposed adding additional signage and lanes to help Trustee Leonard asked if Glade was working with Red Rocks Amphitheatre on behalf fofthe Town. Glade stated that he worked with the Amphitheatre on the original study and allowed them to use his house to Trustee Way asked for clarification on how the curfew and noise violation fines work. Town Manager Winters stated that the $10,000.00 fine is effective the first minute over the stated curfew time. Trustee Sutton asked if the Town has any regulatory authority over the Amphitheatre. Glade stated no, the Town does not have any regulatory authority, and all violation fines are paid to the City ofl Denver. Trustee Sutton stated that he did like Fiddler's Green Amphitheater regulations. Glade suggested the Board look at implementing a few oft the regulations and restrictions used by Fiddler's Green Amphitheater; earlier curfew, max decibel level of110, and documentation provided to the local police with traffic congestion. measure the sound pressure levels. department indicating regulations were met. Glade stated that the Town can make the recommended changes but Denver does not have to implement any of Glade stated the Town has no. jurisdiction over Red Rocks Amphitheatre other than traffic control. Trustee Way asked ift the Town can negotiate with Red Rocks Amphitheatre to increase the Traffic Trustee Gill stated that she would like to see more regulations on the Red Rocks Amphitheatre, and Trustee Gill stated that she appreciated seeing the numbers int the report relating to noise pollution. The Board has received feedback from the Community regarding noise from traffic. Trustee Gill suggested that the Board consider putting together aj proclamation expressing their concerns and recommendations Trustee Wirtz thanked Glade for his presentation. Trustee Wirtz suggested the Town have a consultant Trustee Wirtz stated that the Town does have a noise ordinance and ift the Town is holding vehicles to that The consensus of the Board was to review the current Traffic Impact Fee with Red Rocks Amphitheatre. Ordinance NO. 541-Cable Franchise. Agreement- - Discussion/Questions, will be on the next agenda for adoption. Town Manager Winters informed the Board that Town Legal has worked on the Cable Franchise Agreement with Comcast and asked for their feedback on the agreement. Trustee Leonard asked what the purpose of the franchise agreement was. them. Andy Davis, Comcast Representative. Davis stated that the agreement allows Comcast to access, maintain, and operate its infrastructure on all rights-of-ways within the Town. Davis stated that Comcast services willl have contiguity throughout the Town and' be available to all residents. Davis stated that the current agreement will bring the Town's franchise fee of3% up to the Federal Maximum of 5%. Trustee Sutton stated that he trusted the review oft the agreement that was done by the Town Council. Trustee Leonard asked ifthis agreement is administratively needed because the old one had expired. Town Manager Winters stated yes, that the Town has added some provisions to the agreement. Included Davis also mentioned there is a $5,000.00 grant that would be available to the Town if they would like to Trustee Gill asked if Comcast cables are co-locating with other utility poles int town. Davis stated that yes, Comcast does co-locate their poles when they have an agreement with Xcel. Town Manager Winters stated this is the ordinance that will allow the Town to use the speed cameras and trailers. Alsoi included in the Mayor Wolfe asked ift the ordinance should include Highway 93 and Morrison Road as possible locations for speed radar cameras. Town Attorney Flanagan stated per state law, the location has to be specified. Chief Vinelli stated the locations listed in the ordinance are where the majority oft the speeding happens in Town Manager Winters stated that once the program is up and running the Board can amend the ordinance ift they find another location, they would like to add a speed camera to. A motion was made by' Trustee Leonard to adopt Ordinance NO.540 AN ORDINANCE AMENDING TITLE 6 OF THE MORRISON MUNICIPAL CODE BYTHE ADDITIONOFA NEW CHAPTER 5TO ESTABLISH AN AUTOMATED VEHICLEI IDENTIFICATION SYSTEM.The motion was seconded by Trustee Sutton. All members present voted aye. The motion Resolution 2024-03- A Resolution Increasing the Compensation for Town Administrative Employees. Town Manager Winters stated that Town Staff went back and ran a market analysis to include smaller municipalities. The results from the Compensation Study came back higher. Town Manager Winters stated that the Town Employees are the Town's most important asset and believes Town employees should be provided aj positive workplace where they get paid the market wage for their Trustee Leonard stated that he respectfully disagrees with the market study and the consultants' findings. He does not have enough information to approve the Compensation Study. Trustee Leonard stated that he believes ifTown Manager Winters applied for her jobt today, she would not meet the qualifications for the Town Manager Winters asked the Board to take her out of the equation and then approve the resolution. Trustee Leonard stated that he did not agree with raising Town Clerk Neverdahl's wage either. Trustee Leonard mentioned that he sent out documentation to the Board from other municipalities listing their requirements for the' Town Clerk position and Town Clerk Neverdahl does not have those requirements. Trustee Leonard stated that he is not ready to approve the Compensation Study based on the consulting's findings. Trustee Leonard stated the Board should have hired a consulting firm instead of the Town Manager. Trustee Leonard stated that he did not agree with the consulting firm's 35% scope reduction. Town Manager Winters stated that she felt Trustee Leonard was insinuating she guided the study and Trustee Leonard stated he did not think Town Manager Winters influençed the results of the study but felt the Board should have hired the consultant to remove Town Manager Winters from that position. ordinance is the authority for ai red-light camera. Trustee Sutton stated getting into the weeds and discussing other Town employees' wages is the responsibility oft the Town Manager and he is a little uncomfortable with the process. Trustee Sutton said that he understands this would be an amendment to the budget and thati is Trustee Sutton stated that Town Clerk Neverdahl is currently making the same: salary as a. Jefferson County Public School teacher who has eight to nine years of experience with an undergraduate degree and teaching credential. Trustee Sutton stated that he does not want to lower Town Clerk Neverdahl's salary but feels she is fairly compensated. Trustee Sutton stated the proposed amount toj pay Town Clerk Neverdahl is a salary that a. Jefferson County Public School teacher would make with a bachelor's degree, amaster's degree, a teaching credential, and sixteen years oft teaching experience. Trustee Sutton stated that the proposed salary increase that is proposed for Town Manager Winters is not anything he has seen in the private, academic, or government sector. A raise of that magnitude is typically achieved by getting aj job someplace else and is that ofa promotional level. Trustee Sutton stated the Town does not have a way to promote her as shei is the current Town Manager. Trustee Sutton stated if the Town is going to increase the wage of the Town Manager, the position should be opened up to applications. Trustee Sutton stated that is not what he would recommend at the moment. Trustee Sutton stated that the average wage increase for the Town Staff was 3.78% and stated that was too low. Trustee Sutton stated that twelve of the eighteen staff do not get a raise, and Town Manager Winters and Town Clerk Neverdahl would receive 69% of the proposed wage increase. Trustee Sutton Trustee Sutton stated he was okay with the Police Department receiving the largest raise. They have the most challengingjobs with significant legal, physical, and emotional challenges associated with their work. Trustee Sutton stated that he believes the Police Department is where the Town has the largest gap Trustee Sutton stated he did not want to jump to the market values listed in the study because he felt the Trustee Sutton stated that he does feel that inflation is real. Trustee Sutton stated that he feels the employees do deserve a raise and proposed a 3% raise for all Town employees with an additional 2% to be distributed on a merit basis at the discretion oft the Town Manager. Trustee Sutton also proposed a 5% raise for all Morrison police officers with an additional 4% to be distributed on a merit basis at the Trustee Sutton stated that he believes the Town Staffworks from home too much and that teachers and police officers do not get the option to work from home. Trustee Sutton stated he would not support the Mayor Wolfe stated that he understands that both Trustee Sutton and' Trustee Gill are teachers and mentioned that Town Staff do not receive PERA (Colorado Public Employees Retirement Association). and do not receive the same amount of time off as school teachers. Mayor Wolfe stated that he found it hard to compare the Compensation Study to teachers and stated that the study was done and compared to other government agencies. Mayor Wolfe stated that the Compensation Study should be compared to why the Board is currently discussing it. stated that he felt this was disproportionate. in the Compensation Study between the Town and the current market. Compensation Study was flawed. discretion ofthel Police Chief. motion as it stands. other government agencies and not the Board's professions. 4 Mayor Wolfe stated that he agreed with Trustee Sutton that all employees should receive al raise. Mayor Wolfe said that the Board was asking for aj pay structure and believes that the consulting firm did ai fair job. Mayor Wolfe stated that he spoke with other mayors regarding the Compensation Study results and Mayor Wolfe stated that he believed the Town should approve the resolution and maybe do even more to ensure that all employees receive a raise. Mayor Wolfe also stated that he wants Town employees to be happy and stay with the Town. He does not want to bet the training pad for employees. Mayor Wolfe stated he would like to agree with the Compensation Study that is amicable to everyone. Trustee Gill stated that she was not comfortable commenting on the Compensation Study. Trustee Gill stated the Compensation Study was entirely focused on compensation and did not look at the qualifications and requirements in the job descriptions. Trustee Gill stated the way that teacher pay scales work is you receive COLA wage adjustments year-to-year and receive increases based on obtaining a master's degree and a Ph.D. Trustee Gill stated that there is a way that education and specific training feed into the wage increases for teachers. Trustee Gill also stated that teachers receive al heavy performance Trustee Gill stated that Town Manager Winters is responsible for evaluating all Town Employees and the Board is responsible for evaluating the Town Manager. Trustee Gill stated she would like a better understanding ofhow the roles, responsibilities, and expectations for each employee's position. Trustee Gill stated that she does want to be an employer of choice and that she does value and appreciate Town Employees. Trustee Gill stated that Morrison is a small Town and it is tricky when talking about Trustee Gill mentioned that teachers do get PERA and work a loti including overtime during the school year, but do not receive Social Security. Trustee Gill stated that the Board does not know what the soft benefits for the Town are, what the paid time offi is for Town employees, and how vacation timei is accrued. Trustee Gill stated she does not have enough context to agree to the proposed salary increases. Trustee Gill stated that the CML (Colorado Municipal League) does not show that smaller municipalities are paying higher wages. Trustee Gill stated that there does need to be an increase in compensation for Town Staff. Trustee Gill stated that she does not have aj problem with certain staff members receiving higher increases in wages. She does not have enough information about every Town employee's position Trustee Way stated that thel Board often talks about how unique Morrison is, Morrison is a small town that deals with larger issues. Trustee Way stated wage increases should be based on performance. Trustee Way stated that he had heard enough about the credentials needed for the position. Trustee Way mentioned that ift the employee does a good job, they deserve to be on the pay scale. Trustee Way stated that Morrison is different and he does not agree that we should require the same credentials as the other municipalities. Trustee Way mentioned that credentials can be overrated that having credentials does not correlate with doing a good job and that if Town Staff does a good job, they deserve to be compensated Town Manager Winters stated that no one mentioned her credentials at the time of her hire or during any Trustee Wirtz stated that he is not ready to decide on the Compensation Study tonight. Mayor Wolfe stated that he appreciated Trustee Sutton's solution to the Compensation Study and would like to come up with a Chief Vinelli addressed thel Board and stated that he came from al broken city before working for Morrison. Chief Vinelli stated that Morrison has three full-time employees who do the job ofr nine people. ChiefVinelli: stated that the' Town does not run any different than other municipalities and the Town Manager, Town Clerk, and Deputy Town Clerk are responsible for multiple responsibilities for the Town. ChiefVinelli stated that he comes to work every day because of the people he works with. ChiefVinelli stated that he has officers who cannot independently live on their own because oft the salary they are receiving with eleven years of experience. ChiefVinelli stated that he currently has officers looking elsewhere because they do not make enough money. Chief Vinelli stated that Morrison Sergeants Chief Vinelli stated that the consultant company that completed the Compensation Study are professionals, they chose 24 other municipalities that are within the Denver Metro. Area and average in size to complete the Compensation Study. Chief Vinelli stated that thel Board has more than enough information to decide on the Compensation Study. Chief Vinelli stated that his officers are working hard fort the Town and are doing the same. job as every other Police Department in the Denver Metro. Area. Trustee Wirtz stated that he liked' Trustee Sutton's suggestion and would like to see the proposed Trustee Sutton stated his proposed numbers would be al bigger increase to the budget but it would be spread out and provided to all employees. Trustee Sutton stated that he would prefer to only talk about Trustee Sutton mentioned that Colorado has experienced inflation and does think that' Town employees deserve a raise and that his suggestion is a bump to the budget but it is spreading it out to all employees. Sergeant Sweeney addressed the Board and said that hel has eighteen years ofe experience and has received employment offers from other municipalities but hel has chosen to stay with Morrison. Sergeant Sweeney stated that hel has made a sacrifice to stay with the Morrison Police Department including living with his family in al house with four other adult roommates. Sergeant Sweeney stated that he felt what was being Mayor Wolfe stated that the Board needs a solution and it will be on the next agenda for action and the Trustee Leonard stated that he does not agree with the report and results from the consultant on the Compensation Study. Trustee Leonard stated that the Town Staff does ai finej job and that the Police Department does a great job. Trustee Leonard stated that it is unfortunate that they cannot afford a place tol live but the Town cannot try to fix it all and needs to do what is right for the' Town. Trustee Leonard stated he disagreed with ChiefVinelli and stated he has worked with many consultants and, although they have degrees and certificates, he does not listen to them 90% of the time because they do not know what the real world is. Trustee Leonard stated you cannot have the market study amounts and not look at the qualifications because all oft the other towns put time and money into those qualifications, including Trustee Leonard stated that Town Manager Winters has done a great job and wants to make sure that Town Manager Winters is compensated at the right level. Trustee Leonard stated he does not want to be rushed into this and that it takes time to get it right. Trustee Leonard stated he agreed with Trustee Trustee Sutton stated that he was insulted by the comments made on eduçation and credentials. The Town pays for Town Staff to receive training and education and it is not a waste of money. Trustee Sutton stated there is a reason that certifications are: required. Trustee Sutton stated it isi insulting and degrades our society when we do not believe in expertise anymore. Trustee Sutton stated that certifications mean Trustee Sutton stated that he would like all employees to receive a wage increase after thei inflation the Amotion was made by' Trustee Sutton to table the compensation for the' Town Managerand increase wages for Town Staff by 3% with a2 2% wage increase for Town Manager discretion and 5% wage increase for the Morrison Police Department and a 4% wage increase for Police of Chief The consensus of the Board was to table the conversation to the next agenda when they have a dollar Trustee Gill clarified that she does not think that education, qualifications, and degrees are synonymous but that can feed into a qualification. Trustee Gill stated she wanted to know more about the qualifications and experience required for Town positions. Trustee Gill stated that she was not implying she does not respect the work ofTown Manager Winters because she does not have a master's degree in public Trustee Gill stated that she agreed with Trustee Sutton about education. Trustee Gill stated that she worked hard and took out student loans to further her eduçation. Her education helped her every day in Mayor Wolfe stated that Town Staff does complete continuing education and training for their positions education. The consensus oft the Board was to schedule an Executive Session with Cindy Covell and Alan Leak on April Town Manager Winters stated that she was leaving the meeting because oft the treatment ofTown BRIC Scoping Report Dscusiom/Clarification on Projects. An motion was made by' Trustee Leonard to appoint Trustee Wirtz and Trustee Gill to the trial committee. The motion was seconded by Trustee Sutton. All members present voted aye. The Utilities Department. Trustee Way asked about the 39 irrigation taps at Red Rocks Ranch. Trustee Gill stated there are additional EQRs that were purchased for irrigating their open spaces like easements and entryways. Trustee Gill also stated that outdoor irrigation that attends a residential dwelling is covered in the residential tap. Parking. No oral report. Town Manager. Mayor Wolfe stated that in his eleven years volunteering with the Town he has never seen Town Manger Winters walk out ofa meeting. Mayor Wolfe stated that he knew Town Manager Winters had received feedback from Town employees after the first Compensation Study discussion at the January 16, 2024 Board meeting that was upsetting. Mayor Wolfe stated that he understands the topic of compensation is tough but encouraged the Board tol have an answer at their next Board meeting. Town Attorney. No oral report. Consent. Agenda. Trustee Way asked ifiti is legal to cross a double yellow line on Morrison Road at the entrançe to Red Rocks Ranch. ChiefVinelli stated that it is not legal to cross a double yellow line while Trustee Sutton stated that he was conçerned that Town Manager Winters was upset and that Trustee Leonard mentioned the roofers at the Town Office were not properly tied off and stated there was no one there supervising. Trustee Leonard stated this is a safety hazard and a liability. Streets, Grounds and Buildings Director Lamont stated he will have a conversation with the driving. Town employees do not feel respected by the Town Board. contractors and ask them to address the safety concerns. 8 Trustee Leonard stated he agreed with Trustee Sutton and stated that het thought Town Manager Winters, Town Staff, and the Police Department do a great job. Trustee Leonard stated it was not Trustee Wirtz asked ChiefVinelli for an update on the speed cameras. ChiefVinelli stated the department is hoping to have the speed cameras up by the first of March for a 30-day trial period his intent to upset anyone and apologized ifl his comments upset anyone. and fully ruining by April of2024. Trustee Leonard moved to go into executive session fora conference under Town Charter Section 3.4 and CRS7464974Xbaml (e) with the Town Attorney, Town Manager,and appropriate staff to receive legal advice and toi instruct negotiators regarding the lease and use of Town land for aretail marijuana store.
