TOWN OF MORRISON, COLORADO BOARD OF TRUSTEES ORDINANCENO.S4S AN EMERGENCY ORDINANCE IMPOSING A THREE (3) MONTH MORATORIUM ON THE ACCEPTANCE OF LAND USE APPLICATIONS UNDER TITLE 10 OF' THE MORRISION MUNICIPAL CODE WHEREAS, the Town ofl Morrison is a Colorado home rule municipality operating under a Home Rule Charter approved by the electorate pursuant to Article XX of the Colorado Constitution and governed by its elected Board ofTrustees; 16-101, et seq. to adopt and enforce all ordinances; WHEREAS, the Board has authority pursuant to the Home Rule Charter and C.R.S. $31- WHEREAS, pursuant to C.R.S. $31-23-301, the Town's police powers include the power WHEREAS, temporary suspensions and moratoria for land uses are, judicially approved as a method or means of enabling local governments to plan for, regulate and protect the health, tor regulate the location and use ofl land within the community; safety, and welfare oft the community; WHEREAS, the Board of Trustees last adopted comprehensive zoning and subdivision WHEREAS, Title 10 does not reflect the goals and objectives of the Town and is difficult WHEREAS, Title 10 has led to zoning and subdivision approvals that do not promote the WHEREAS, suspending the Town's acceptance of new applications under Title 10 is determined to be prudent and reasonable as such suspension is temporary in nature and intended only to afford the Town the opportunity to consider and amend its regulations as needed; and WHEREAS, the Board ofTrustees desires to impose a three (3)month moratorium on the Town's acceptance of new applications under Title 10 to provide the Town time to address the regulations in 1978, codified as Title 10 oft the Morrison Municipal Code ("Title 10"); to interpret and apply; health, safety, and welfare of the Town and leave a lasting impact on the Town; issues identified in Title 10. Morrison, Colorado: NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Town of Section 1. Moratorium. A temporary three (3) month moratorium is hereby imposed on the acceptance and processing of new applications under Title 10 in the Town. No new applications shall be accepted by the Town until June 19, 2024. Section 2. Severability. The Board of Trustees hereby declares that it would have passed this ordinance and each part hereofirrespective oft the fact that any one part or parts are declared unconstitutional or invalid. Section 3. Emergency Declared. This Ordinance is necessary for the immediate preservation of the public health and safety, because passage ofai regular ordinance with a fifteen (15)d day adoption could lead to an increase in the number of Title 10 applications in such period and exacerbate the impacts created on the Town by the current Title 10 for years to come. Adelay in the moratorium would allow additional applications for development under archaic rules that harm the public health and safety. Allowing additional applications while revisions to Title 10 are under consideration would harm the community and the Town's neighborhoods and interfere with the Town's goal of better regulating such development to enhance the Town's wellbeing. The moratorium will provide the Town with a reasonable opportunity to complete new legislation that will better address the impacts caused by Title 10 in the Town. Section 4. Effective Date. Pursuant to Section 3.10 of the Morrison Home Rule Charter, this Ordinance shall take immediate effect upon approval of the Board ofTrustees.
