TOWN OF MORRISON, COLORADO BOARD OF TRUSTEES ORDINANCE NO.5 544 AN ORDINANCE REFERRING TO VOTERS CHARTER AMENDMENTS, COORDINATING A GENERAL ELECTION ON NOVEMBER 5, 2024, WITH JEFFERSON COUNTY, AND ORDERING PUBLICATION OF NOTICE OF THE WHEREAS, the Board ofTrustees wishes to remove a requirement that a special election be called when a vacancy is not filled within 60 days and no regular election is scheduled within PROPOSED CHARTER AMENDMENTS 90 days; WHEREAS, pursuant to C.R.S. $ 31-2-210(1)(b), a home rule charter may be amended by an ordinance adopted by the Board ofTrustees submitting the proposed amendments to a vote oft the registered electors oft the Town; and WHEREAS, pursuant to C.R.S. $ 1-7-116(5), the Town must notify Jefferson County of NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Town of Section 1. Election. The Board of Trustees hereby coordinates a general election on Section 2. Charter Amendments. At the Town general election on November 5, 2024, in accordance with Article XX of the Colorado Constitution and the Municipal Home Rule Act of 1971, the following questions shall be submitted to a vote of the registered electors of the Town its participation in a coordinated election at least 100 days before the election. For purposes of C.R.S. $S 1-11-203.5 and 31-2-210, this Ordinance shall serve to set the title and content oft the ballot issue set forth herein and the ballot title for such question shall be the text ofthe question itself. Section 4. Uniform Election Code. At the election called hereunder, in lieu of the Colorado Municipal Election Code of 1965, the requirements and procedures of the Uniform Election Code of1992, Articles It to 13 ofTitle 1, C.R.S., to the extent applicable, shall be used in coordination with Jefferson County. Section 5. Safety Clause. Thel Board ofTrustees hereby finds, determines and declares that this Ordinance is promulgated under the general police power oft the Town of Morrison, that itis promulgated for the health, safety and welfare of the public and that this Ordinance is necessary for the preservation of health and safety and for the protection of public convenience and welfare. The Board ofTrustees further determines that this Ordinance bears a rational relation tot the proper legislative object sought to be attained. Section 6. Severability. Ifany article, Section, paragraph, sentence, clause or phrase ofthis Ordinance, or the standards adopted herein is held to be unconstitutional or invalid for any reason, such decision will not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board ofTrustees hereby declares that it would have passed this Ordinance and each part hereofirrespective oft the fact that any one part or parts are declared unconstitutional Section 7. Effective Date. This Ordinance shall take effect fifteen (15) days after adoption and publication in accordance with Section 3.9 and 3.14 ofthe Home Rule Charter.
