Section 2. Chapter 1 ofTitle 4 oft the Morrison Municipal Code is hereby amended by the addition ofa new subsection 4-1-7 to read as follows: 4-1-7: LITTERING: A. It shall be unlawful for any person to deposit, throw, or leave any litter on any public or private property or in any waters. B. Its shall be an affirmative defense, that: 1. Such property is an area designated by law for the disposal ofs such material and the person is authorized by proper public authority to sO use the property; 2. The litter is placed in a receptacle or container installed on such property 3. Such person is the owner or occupant in lawful possession ofs such property. C. Litter as used in this section, means all garbage, rubbish, waste material, trash, debris, or other foreign substances, solid or liquid, ofevery form, size, kind and description. D. Whenever litter is thrown, deposited, dropped or dumped from any motor vehicle in violation oft this section, the operator ofs said motor vehicle is presumed to have caused or permitted the litter to be sO thrown, deposited, dropped or dumped therefrom. Section 3. Section 6-1-2 of the Morrison Municipal Code is hereby amended to read for that purpose; or as follows: 6-1-2: Vehicle Registration and Driver License Requirements: A. All motor vehicles in operation in the Town shall comply with State Law requirements regarding the proper display of valid vehicle registration license plates as B. All operators of a motor vehicle in the Town shall comply with State Law requirements regarding licensure as stated in C.R.S. $ 42-2-101, ,etseq. Section 4. Severability. Ifany article, Section, paragraph, sentence, clause or phrase oft this Ordinance, or the standards adopted herein is held to be unconstitutional or invalid for any reason, such decision will not affect the validity or constitutionality of the remaining portions of this Ordinance. The Board of Trustees hereby declares that it would have passed this Ordinance and each part hereofirrespective oft the fact that any one part or parts are declared unconstitutional Section 5. Effective Date. This Ordinance shall take effect fifteen (15) days after adoption and publication in accordance with Section 3.9 and 3.14 of the Home Rule Charter. INTRODUCED, READ, PASSED AND.
