TOWN OF HUDSON PLANNING COMMISSION CALLTO ORDER 6:01 p.m. The meeting was called to order by the Planning Commission Chairperson, Daniel Warren, at PLEDGE OF ALLEGIANCE ROLLCALL Present Commissioners: Brandi Bond Robert Hollister Kerry Shaklee Daniel Warren Lisa Marie Buesgens Matt Cole Don Post Ex-Officio Members: Absent: Natalie Schlidt, Deputy Town Clerk, took roll call and six (6) Commissioners were present. Town Staff Present: Jennifer Woods, Town Planner Natalie Schlidt, Deputy Town Clerk APPROVALOF) MINUTES a) Wednesday February 14, 2024 Commissioner Warren noted that the minutes from the February 14, 2024, planning commission meeting are pending due to the length oft the meeting and will be tabled until April 10, 2024, to ensure their accuracy. ADDITIONS TO AGENDA Town Planner Woods noted a Weld County Referral was received today that will be added as item 7f. Additionally, the order oft the Public Hearings will be changed to allow attendees to get home before the anticipated storm and allow Mr. Shaver to make his flight home. Minutes - March 13, 2024 Town of Hudson Planning Commission Regular Meeting Page 2of6 CITIZEN'S COMMENTS GENERAL BUSINESS None a) Public Hearing: Cases 23-11 and 12 Pilot Subdivision and Site Plan Commissioner Warren opened the Public Hearing at 6:03 p.m. for Case Nos. 23-11 and 12 Pilot Subdivision and Site Plan. Planning Secretary Schlidt stated the Public Hearing is for the purpose ofreceiving public comment and to consider Pilot Subdivision and Site Plan. Planning Secretary Schlidt stated that the notice for the public hearing was published in the newspaper on February 24, 2024, posted at the site on February 23, 2024, sent to: neighboring property owners on February 27, 2024, and to mineral estate owners on February 12, 2024. Town Planner Woods noted that the subdivision and site plan meet the basic criteria and follow public works standards and include requests for sign height variances. The development includes significant infrastructure and road improvements to support the travel center and future developments. Project Manager Ross Shaver presented a slide show and discussed the overall plan including having an EV charging network. Mr. Shaver also indicated that there are planned road improvements to manage traffic effectively, creating dedicated turn lanes, adjusting speed zones and installation oft traffic monitoring cameras on CR49. A traffic study was conducted and approved by CDOT. The development's impact on traffic is manageable in the short term, but long-term signalization is necessary due to historical growth, not just the new development. Mr. Shaver noted that the requested sign variances are. justified based on operational needs and safety considerations. Additionally, the project is expected to create $380,000 in tax revenue and approximately 59 jobs. Water and sewer will be extended to the development. Travis from Hudson Fire Department noted that they have been working with United Power on the charging stations and will evaluate whether training exercises are: needed. Town Planner Woods noted that no comments were received by the Town prior to the hearing. There being no further public Commissioner Cole made ai motion, seconded by Commissioner Bond, to approve Case 23-11 Pilot minor subdivision with the conditions stated in Staff Recommendation (that a public works permit shall be obtained by the applicant in order to implement all oft the required subdivision improvements, both on and off-site, as required by the Town's Standards and Specifications for the Construction of Public Improvements for streets, water and sewer, and storm drainage) and to comment, Commissioner Warren closed the Public Hearing at 6:34 p.m. forward to Town Council. The vote was as follows: Nay- None Aye- Commissioners Cole, Bond, Buesgens, Hollister, Shaklee and Warren Commissioner Warren declared the motion passed. Specifically, the CAT Scale sign may be up to 21.33 feet in height and the Hi-Rise sign may be up to 100 feet in height) and to forward to Town Council. The vote was as follows: Nay- None Aye- Commissioners Cole, Bond, Buesgens, Hollister, Shaklee and Warren Commissioner Warren declared the motion passed. b) Public Hearing: Case 22-01 Reed Annexation Initial Zoning Before opening the Public Hearing, the Planning Commission heard from Commissioner Hollister noting that he assisted Mr. Reed in early 2022 to get the annexation rolling and met with the Town Planner but quickly realized Mr. Reed would need help beyond what he could offer. Commissioner Hollister has not been involved since that time. Commissioner Hollister noted hel has no bias in the outcome oft the zoning. Commissioner Warren gave an opportunity for members oft the Planning Commission and the public to state any concerns. Having heard no concerns from the Planning Commission, or from the public, Commissioner Hollister was Commissioner Warren opened the Public Hearing at 6:39 p.m. for Case 22-01 Reed Annexation Initial Zoning. Planning Secretary Schlidt stated the Public Hearing is for the purpose of receiving public comment and to consider Reed Initial Zoning. Planning Secretary Schlidt stated that the notice for the public hearing was published in the newspaper on February 24, 2024, posted at the site on February 16, 2024, sent to neighboring property owners on February 27, 2024, and to mineral estate owners on February 12, 2024. Town Planner Woods reminded the Planning Commission and those in attendance that the Planning Commission provides recommendation on the initial zoning to the Town Council and that ultimately the Town Council makes the final decision on the zoning and annexation. The property known as Reederville"is proposed tol be zoned Business (B) with an existing Residential use and will be coming in as-is, subject to future site planning or new use approval depending on what is being proposed for the property. The applicant had nothing additional toj present. Commissioner Cole inquired about the existing residence on the property and whether anything additional has to be done ifit's zoned differently. Town Planner Woods noted that a Findings of Fact is done after the annexation and zoning are approved that details exactly what exists on the property down to the square footages to capture the existing conditions at the time ofthe annexation and rezoning. Town Planner Woods noted that no comments were received by the Town prior to the hearing. There being no further public comment, Commissioner Warren closed the Public Hearing at 6:47 Commissioner Cole made ai motion, seconded by Commissioner Buesgens, to approve Case 22- allowed to participate and vote on the Reed Initial Zoning. p.m. 01 Reed Annexation Initial Zoning and toi forward to Town Council. Planning Secretary Schlidt stated the Public Meeting is for the purpose ofreceiving public comment and to consider Cedar St. Site Plan. Planning Secretary Schlidt stated that the notice for the public meeting was posted at the site on February 22, 2024, and sent to: neighboring property owners on February 27,2024. Town Planner Woods noted that this is for a change of usei in the old Compare grocery store to ai restaurant. The restaurant will occupy the entire building, utilizing space for kitchen, entry, seating and possibly a meeting room. The current structure will remain as-is and the change of use is allowed in the downtown business zone. Downtown parking remains tol be an issue and the Town will be doing a future study to develop a comprehensive parking plan for downtown. Town Planner Woods noted that the restaurant has 14 parking stalls ini total on the property and recommended approval ofa condition that relieves the owner of additional parking to meet the minimum requirement oft the code of one stall for every three and a halfs seats. Efforts are being made to maximize parking on the property while considering ADA requirements and necessary installations like a grease trap. Town Planner Woods noted that no comments were received by the Town prior to the hearing. There being no further public comment, Commissioner Warren closed the Public Hearing at 6:57 p.m. Commissioner Bond made ai motion, seconded by Commissioner Cole, to approve Case 24-03 Cedar St. Site Plan with conditions stated in Staff Recommendation (that noi new parking shall be required with site plan. Alley to: remain free and clear of parking but can be used for loading/unloading) and to forward to Town Council. The vote was as follows: Nay- None Aye- Commissioners Bond, Cole, Buesgens, Hollister, Shaklee and Warren Commissioner Warren declared the motion passed. d) Public Hearing: Case 24-01 Code Amendment Animal Keeping in Ag zones Commissioner Warren opened the Public Hearing at 6:59 p.m. for Case 24-01 Code Amendment for Animal Keeping in Ag zones. Planning Secretary Schlidt stated the Public Hearing is for the purpose of receiving public comment and to consider code amendment animal keeping in ag zones. Planning Secretary Schlidt stated that the notice for the public hearing was published in the newspaper on February 24, 2024. Town Planner Woods noted that this is for a change to the code to address requests for additional animals on properties in ag zones without significant impact on the Town'sa animal population. Thej proposal starts with allowing two animals per acre, adding one more animal per acre thereafter for properties zoned as Agriculture Two (A-2) and Agriculture Three (A-3). Chickens are considered differently under livestock and residential chicken keeping ordinances. Roosters continue to bej prohibited unless they are part ofa commercial agriculture operation. Town Planner Woods noted that no comments were received by the Town prior to the hearing. Amendment Animal Keeping in Ag zones as stated in Staff Recommendation. The vote was as follows: Nay- None Aye- Commissioners Cole, Bond, Buesgens, Hollister, Shaklee and Warren Commissioner Warren declared the motion passed. e) Public Hearing: Case 23-13 MSLCAT Annexation Initial Zoning Commissioner Warren opened the previously continued Public Hearing at 7:08 p.m. for Case No. 23-13 MSLCAT Initial Zoning. Planning Secretary Schlidt stated the Public Hearing is for the purpose of receiving public comment and to consider MSLCATI Initial Zoning. Planning Secretary Schlidt stated that the notice for the public hearing was published in the newspaper on January 27, 2024, posted at the site on January 26, 2024, sent to neighboring property owners on January 25, 2024, and to mineral estate owners on. January 11, 2024. The hearing was properly continued by motion and vote by the Planning Commission on February 14, 2024. Commissioner Warren requested another continuance because the zoning application was prompted by an annexation application and the annexation proceedings are still being held in abeyance pursuant to $31-12-1140 C.R.S. because oft the conflicting annexation initiated by the Town ofLochbuie. Public Comment was received previously, and no further public comment will be received Commissioner Cole made ai motion, seconded by Commissioner Bond, to continue Case 23-13 tonight. Commissioner Warren will entertain a motion. MSLCAT: Initial Zoning to April 10, 2024, at 6:00pm. The vote was as follows: Nay- None writing to Jennifer Woods. Aye- Commissioners Cole, Bond, Buesgens, Hollister, Post and Warren Commissioner Warren declared the motion passed. Additional comments may be submitted in f) Weld County Referral: Case FFD24-0006 Family Farm Division, Greenleaf. Acres Town Planner Woods noted that the referral is regarding a family farm division located off CR 22 and CR49. Town Planner Woods noted concerns about the potential misuse of family farm divisions as the same applicant has proposed similar divisions in the recent past and to suggest Weld County review the process to prevent unintended subdivisions. The Planning Commissioners discussed the legitimacy oft the family farm divisions for genuine family or farm employees versus potential exploitation of the process and concerns over the cumulative impact ofr multiple family farm divisions by a single property owner potentially leading to a de: facto major subdivision without proper oversight and the impacts it has on local infrastructure and planning. Commissioner Buesgens raised concern about the recommendation and that rights of property owners should be prioritized and requested the recommendation letter clarify the concern is with the process and the potential impact on the Town and not the specific property LLC Minutes - March 13, 2024 Town of Hudson Planning Commission Regular Meeting Page 6of6 owner. The discussion highlighted the need for a balanced approach that respects property rights while addressing potential abuses of the property division process. The Planning Commission was in consensus with the recommendation with the addition to clarify the concern is with the process and not the specific property owners. STAFF COMMENTS Town Planner Woods gave an update on some development plans and will be updating the Town website with all oft the upcoming projects. Deputy Clerk Schlidt noted that the Town has ai new building permit portal and that SO far, the transition is going well. PLANNING COMMISSION COMMENTS None.
