The old fence had been installed on town property and the owners placed the new: fence back on town property even though there was a survey pin located on the southwest corner of the property indicating that the fence was on town property. The owner indicated that they had the fence placed back in the original location against the back of the sidewalk to eliminate a 16" section of grass and dirt in front of the fence. Fences ofless than seven feet do not require a permit, and only after a drive by inspection of the new fence having been installed, did the situation become apparent to town staff. FISCALI IMPACT The impact to the town is allowing a private citizen to enclose town property into a private yard. The issue is the setting of precedence for future projects and the question is does the town want to allow private citizens to encumber town property. RECOMMENDATIONS The owner of the property was informed that the fence was required to be relocated to the property line.
