Townof Cedaredge Colorado PLANNING & ZONING COMMISSION Special Meeting Tuesday, April 30, 2024, 5:30 p.m. Call to Order: Chairperson Skip Bethurum called the meeting to order and lead the Pledge of Roll Call: Chairperson Skip Bethurum, Commissioners Ardon Barnes, Marcy Peterson and Jason Weed. Ex-Officio member Jim Atkinson, Town Planner Mark Chain, Interim Town Administrator Mark Relph and Town Clerk Jess Shelton are in attendance. Attorney Bo Nerlin Allegiance at 5:30 p.m. joined the meeting at 5:35 p.m. Board Deliberation on Public Hearing: Interim Town Administrator (ITA) Mark Relph described the meeting and what can be expected. He also explained to the Planning and Zoning Commission there are three ways the meeting could go; approval, approval with conditions or denial oft the application. Chairperson Bethurum read a letter from a group of concerned citizens the Town received on April 23. Geotechnical Chairperson Bethurum stated he had concerns about the geotechnical issues. Ex-Officio Atkinson stated the information in the staff report regarding geotechnical issues was correct. Atkinson stated he did not want to see the Town ofCedaredge in a situation where there is a constant issue with the maintenance Commissioner Peterson stated there is already movement in existing homes in Commissioner Weed stated he is concerned, and drill sites should be done in that Commissioner Barnes stated he would like to hear from Dan Quigly first since he Town Engineer Dan Quigly stated the project is still at the sketch plan phase and not everything is engineered at this stage. However, Mr. Quigly stated the Town did not want to set themselves up for failure with road issues in the future. Mr. Quigly also stated the application was the first plan and there may be other plans Chairperson Bethurum asked Attorney Nerlin if the Commission could require bores to be conducted. Attorney Nerlin stated it could be a referral to the Board of and upkeep oft the roads. that area. area to address geotechnical issues. has an expert opinion on the matter. as the project progresses. Trustees, but it could not be a requirement. Highway 65 Traffic Study Commissioner Peterson stated the Highway 65 access should be further approved since the intersection ofJay and Highway 65 is already difficult to enter and exit. Commissioner Peterson asked for another traffic study to be done. CDOT has required improvements to the highway and Jay Road with the warrants Engineer Dan Quigly stated the improvements will be phased in and when the Ex-Officio Atkinson asked ift the Independence and Highway 65 access was addressed. Ex-Officio Atkinson stated the access at Highway 65 and Independence since the intersection is already a possible warranted area. ITA Relph stated he assumed once the report was submitted to CDOT that all Tate Locke stated the methodology stated most of the traffic flow would use Jay Road and not Independence and the study was done during school and in off ITA Relph stated the conditions of approval could include all intersections that Tate Locke stated on page 9, section 2.2 ofthe traffic study, it stated 95% ofthe traffic would travel from Jay and the other 5% from the existing roadways. Commissioner Weed, Peterson and Barnes all agreed tol have the Recreation Center be a second application. Chairperson Bethurum stated on page 6 oft the staff report (in1 the meeting packet), it addresses offsites and he would like to know what will be done. Board ofTrustees as a condition. itcould be a recommendation to the Board ofTrustees. John Peterson stated an entry statement in a 5-year beautification project would occur and then additional improvements as the project gets built out. Finding 1- Compliance with Cedaredge Municipal Code Commissioner Weed stated the Wildfire Mitigation has not been addressed with this project. Discussions were. had regarding on-street parking. The applicants stated Town Code requirements stated two spaces were required forj parking and each driveway would hold two spaces, along with on-street parking. Finding 4-D Desirability in the specific area of town Finding 5-1 Potential for adverse environmental effects Planner Mark Chain stated it was covered ini the 1989 agreement. This was regarding slope issues, which have been addressed in condition seven. Finding 6-1 Impacts of project generated traffic on the neighborhood and surrounding area There were several conditions that would be listed. Finding 7-1 Impacts on water and wastewater utility systems. Finding 8-1 Demands for and impacts on municipal services. Try to minimize or eliminate lift stations. There will be no adverse impacts on general municipal services. Finding 9 - Potential impact upon the value of property and building within the surrounding area There is concern that land use actions would negatively impact property value. Planner Mark Chain stated there were fourteen affordable homes included in the project. There will be six in phase one and eight in phases two and three. This will be addressed in a condition. Finding 10- Conformance with the approval requirements concerning water and sewer tap availability. o This was addressed ini the PUD section oft the Town Code. Commissioner Barnes asked about affordable housing and stated there were lots the Town owned that could use affordable housing. Commissioner Barnes stated there: may be concerns Chairperson Bethurum stated it would be an agreement with the Town and the Developer on ITA Relph stated a condition would need to be made and more: research would need to be done by the Town. The details will need to be addressed later, but affordable housing should be kept Commissioner Weed moved and Commissioner Peterson seconded to take a break. The information was also ini the packet for the Additional Conditions or Changes Required by thel Planning Commission: with affordable housing being next to custom housing. what the AGI was and how that would look for affordable housing. in the application as a condition. at7:11 p.m. 7:25 p.m. meeting under approval with conditions. Condition 3b to read there will be six affordable units in Phase 1 and 8 in Phases 3 and/or four. The Commission stated it would need to be at 120% AMI and not to exceed 160% Entrance statement, or acceldeceleration lanes required by CDOT. Otherwise, the Town ofCedaredge could look for additional funding to make ai more visual statement at the entrance oft the town. ITA Relph stated it would be good to go further and enhance the Town. It would also change CDOT guidelines for timing and when things could be 3d would require storm runoff to be used fori irrigation purposes. The runoff gets mitigated, sO itis not a harmful impact for the golf course on a surface manner and not incorporated into the irrigation. Design/Use of stormwater runoffi to be used in a Section 3.e.1.ii: finalizes phasing ofi improvements to the listed intersections. AMI. accomplished. beneficial manner for the Town GolfCourse. 3.e.1.vi: Development Agreement with the Town and Owner for Deer Creek Drive with at twelve' requirement for driving lane width. The Town may not be able to commit to a financial obligation at this point but can join iftherei is financial means. 3.e.1.vii: Utility engineering to be done preliminary for phase 1 and then each phase 2,3 and 4 at 100% proofo of concept and then modify as needed for the final completion. There needs to be enough engineering to know it works, and not just preliminary SO that the design calculations are completed. A drainage plan would be included as well. Conditions 7 and 11 can be combined since they both regard geotechnical issues. Condition 8: add stormwater, roads, and wastewater to all phases, not just phases three Condition 9: John Peters said it was open to the Public via the Surface Creek Trail. Add Condition 12g would not apply ift the recreation center is moved to a separate application. The Planning Commission stated the pickleball courts should not be put in the detention Condition 12f: A setback should be required to keep the houses from being hit by rogue Condition 12: Future consideration should be made for access to the North, East and South for future connectivity, sO the PUD was not landlocked. Tate Locke stated it would be hard toj plan for. There would need to be compensation made to the current developers; iff future developers come in with a development that utilized those connections. Add wildfire mitigation as a condition to future phases (WUI). The Commission wanted to see the recreation center removed and made as a separate application. Tate Locke stated the removal oft the recreation center would remove it permanently for all the residents in the PUD and current Deer Creek Village. He stated Tate Locke stated the way the recreation center would be public would be ift the Town and or four. all phases to the condition and add the word public to the condition. ponds and should be moved from the proposed location due to noise. golfballs. there would not be another application for the recreation center. took it over; otherwise, it would be an amenity for the PUD. Commissioner moved Weed and Commissioner Peterson seconded to direct stafft to clean up and wordsmith the conditions discussed in the meeting tonight and to bring them back to another meeting on May 7.A All voted 'aye,' no one voted 'nay," motion passed unanimously.
