Interstate Ford. Ostrander & Prescott, P.C. Councimember Plain moved to approve the Consent Agenda as presented. The vote was unanimous with Mayor Morehead declaring the motion carried. State Roofing. Mayor Morehead opened the public hearing. Valerie Taylor and gave a brief presentation. Page 1 of3 Planning Manager Mark Doering presented his report and asked that the following be entered into the record: staff report, testimony, zoning ordinance and comprehensive plan. Mayor Morehead asked about the location of the entrance being on the west side oft the property. Mark stated that is correct, the entrance is located on the southwest corner of the building. The garage doors are on the east side at the back of the building. Mayor Morehead asked about where the sales tax would be collected. Brian Zwiep, 9249 Eastman Park Drive, Unit A, Windsor, CO 80550 was sworn in by City Clerk Valerie Taylor and stated the sales tax charged is based on the location oft the job. With no further comments, Mayor Morehead closed the public hearing. Councilmember Plain moved to approve Resolution 24-36, Approving a Site Plan and Industrial Use, Water Dedication Agreement, and Development Agreement for Peach State Roofing. S 24-6-402(4)(e), specifically concerning pending litigation, review of application materials for City Manager, none of whom are finalists, and a request by the Town of Frederick to enter into an intergovernmental agreement. The Mayor stated the time is now 8:28 PM, and the executive session has been concluded. The participants int the executive session were: Councilmember Andrew Martinez, Councimember Doris Crespo, Councimember Michelle Rogers, Councilmember Tony Cummings, Councilmember Kevin Plain, City Attorney Kathleen Kelly, and Interim City Manager Jennifer Krieger. Also present during the first discussion in the executive session were attorneys Amy Militech and Riley Howard and HR Generalist Rachel Klinger; representatives from GOVHR were present during the second discussion in the executive session; and the City's Public Works Director Bobby Redd was present during the third discussion in the executive session. For the record, if any person who participated in the executive session believes that any substantial discussion of any matters not included in the motion to go into the executive session occurred during the executive session, or that any improper action occurred during the executive session in violation oft the Open Meetings Law, and he asked that any concerns be stated for the record.
