AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BRIGHTON, COLORADO, DISCONNECTING FROM THE CORPORATE BOUNDARIES OF THE CITY OF BRIGHTON APPROXIMATELY 23.7 ACRES AT THE NORTHWEST CORNER OF 120TH AVENUE AND CHAMBERS ROAD BEING A PORTION OF THE SOUTHEAST ONE-QUARTER OF SECTION 31, TOWNSHIP 2 SOUTH, RANGE 66 WEST, ALL OF THE 6TH PRINCIPAL MERIDIAN, CITY OF BRIGHTON, COUNTY OF ADAMS, STATE OF COLORADO Mayor Mills read the title of the Ordinance into the record. Senior Planner Nick Di Mario presented the Adams Crossing Disconnection. The property is located ont the northwest corner of 120!h Avenue and Chambers Road and is bound by the Burlington Northern Santa Fe (BNSF) Railroad, 120h Avenue, and Chambers Road and Commerce City. The request is to disconnect (de-annex) an approximately 23.7-acre parcel. The property was annexed as part of the Sable Annexation No. 2in 1987 and is zoned for limited industrial and parks and open space under the Sable Planned Unit Development. The Comprehensive Plan designates this property as parks and open space and mixed use residential. The City Council shall use the review criteria in Section 2.11 of the Land Use & Development Code. In 2019, the City of Brighton and Commerce City entered into an IGA that deals with annexation boundaries and actions. With the owner's consent, Brighton will de-annex the property and Commerce City is free to act upon any new requests for annexation. The subject property is the only land east of1-76 and the railroad that is annexed into the city. All other land The property is in the service area for Adams Crossing Metropolitan Districts Nos. 1-8 and in 2018 the property was included in the Adams Crossing Metropolitan District No. 2. The adopted service plan indicates areas outside the city limits cannot be included, unless with prior written consent of the City Council. If the disconnection is to be approved, the property will need to be excluded from the Adams Any utility extensions required for any development would only serve the subject property. If the property was not disconnected and development were to occur, the utilities necessary to serve the site would need to be constructed under 1-76, the BNSF Railroad, the Burlington Ditch, and the Burlington O'Brian Canal and all potable water lines would need to be looped. Planner Di Mario presented the cost comparison for connecting to city utilities or the South Adams County Water and Sanitation District (SACWSD). Options one and two would cost an estimated $4.256 million to $5.961 million to connect to city utilities. Option three would disconnect from the city and cost an estimated $65,8631 to connect to SACWSD utilities. If the property were to develop in the City of Brighton, the city would In accordance with the Land Use & Development Code, the Adams County Board of Commissioners and the Board of Directors and other special districts were notified appropriately. None of the notified districts or County Commissioners requested a meeting to discuss any concerns with this application. None of the notified districts relayed any concerns about the proposed disconnection. Staff finds that the disconnection is in general compliance with the Land Use & Development Code and as such, the Development Review Committee recommends approval.
