Mill, LLC has announced plans for a new project, which refers to real property and improvements thereon which is wholly within the Autauga County; WHEREAS, pursuant to the Brownfield Development Tax Abatement Act (Section 40- 9C-1 et seq., Code of Alabama 1975) (the Act) the Company has requested firom the Granting Authority an Abatement of all state and local noneducational property taxes and all city and county construction related transaction taxes, except those local construction related taxes levied WHEREAS, the company has requested the abatement ofstate and local noneducational WHEREAS, the Autauga County Commission has considered the request of the Company and the completed applications (copy attached) filed with the Autauga County WHEREAS, the Autauga County Commission has found the information contained in the Company's application to be sufficient to permit the Granting Authority to make a reasonable cost/benefit analysis oft the proposed project and to determine the economic' benefits WHEREAS, the construction oft the project will involve a capital investment of thirty- WHEREAS, the project will the creation of 127 residential units at the Pratt Gin site; WHEREAS, the Company is duly qualified to do business in the Stato of Alabama, and has powers to enter into, and to perform and observe the agreements and covenants on its part WHEREAS, the Autauga County Commission represents and warrants to the Company that is has power under that constitution and laws of the State of Alabama (including particularly the provisions of the Act) to carry out the provisions of the Tax Abatement NOW THEREFORE, BE IT RESOLVED, that the Autauga County Commission development; and and for educational purposes orf for capital improvements for education. property taxes, in accordance with the Act; and Commission by the Company, in connection withi its request; and tot the community; and seven million dollars ($37,000,000.00); and and contained in the Tax Abatement. The period of abatement for noneducational property taxes shall extend for a period oft ten (10): years measured as provided in Section 40-9c-1 through 9c-8 of the Brownfield Act. In the event that Pratt Cotton Gin Mill, LLC should convey ownership of any portion of the property, the non-educational property tax abatement shall expire upon conveyance. For purposes of this paragraph conveyance includes sale, deed, lease with option to purchase or other agreement whichi includes a conveyance or possibility of conveyance of any interest greater than a leasehold interest. BE IT FURTHER RESOLVED, that the Autauga County Commission hereby authorizes the Chairman of the Commission to execute for and on behalf of the county commission any and all documents and agreements necessary to effectuate the abatement as set forth above and to take all such further action as shall be necessary or desirable to carry out the purposes andi intent ofthis Resolution.
