City Hall Fayette, Alabama November 27,2018 A regular meeting of the City Council of the City of Fayette met at 5:00 o'clock, p.m. on Upon roll call the following were found to be present: Mayor Ray Nelson, Councilmembers Cedric Wilson, Lindal McCraw, Eddy Campbell and. Jason Cowart. Also present were Police Chief Danny Jenkins, City Attorney Dale Lawrence, City Clerk Dawn Clapp and Fire Chief Shannon Taylor. November 27, 2018, int the Council Chambers oft the City Hall. Councilmember Jerry Nichols was absent. The opening prayer was given by Mr. Rick McCabe. Mayor Nelson announced a quorum was present and the meeting was open for the transaction of Councilmember Campbell moved the minutes oft the regular meeting held on] November 13,2018, be approved. Upon the motion being seconded by Councilmember Wilson, the same was unanimously business. APPROVAL OF MINUTES approved. PARADE PERMIT Mayor Nelson presented to the Council at request for aj parade permit for the Christmas Parade to be held on December 3, 2018. Councilmember Cowart moved the permit be granted. Upon the motion being seconded by Councilmember McCraw, the same was unanimously approved. SPOT PAVINGSTREET PROJECTUPDATE Mayor Nelson stated the Council had been considering doing some spot paving on some streets. Hep presented to the Council the proposal for the paving of four streets from Murphee Paving. Mr. Luke Porter, an engineer, is assisting the City on a contract basis. Mr. Porter stated the City should consider applying to ALDOT for ST Funds to be used on a major collector street. He said the process works by presenting an estimate tot the Highway Director and then asking ALDOT for funds for the project. Mr. Porter said he had prepared estimates for 10t Street and 25th Street to present to the Mr. Porter spoke concerning 10t Street. He said it did not appear 10th Street had problems with It was the consensus of the Council that the Mayor approach the Highway Director about using Because Councilmember Nichols was not present, Mayor Nelson suggested Ordinance 2018-06 bet tabled. Councilmember Wilson moved the Council table Ordinance 2018-06. Upon the motion being Highway Director. its base. He suggested the street be milled before ity was repaved. STI Funds top pave 10" Streeta and 251h Street. 10'HSTREET TRUCK TRAFFICUPDATE seconded by Councilmember McCraw, the same was unanimously approved. HOUSING. ABATEMENT REPORT Fire Chief Shannon Taylor reported ont the abatement of the three buildings located on 3rd Avenue NW. One oft the buildings has now been remodeled andi is no longer a nuisance. Another oft the buildings is currently under renovation and no longer presents a safety issue or nuisance. The remaining building needs to be demolished. The building is under contract and the individuals who are purchasing it have agreed to demolish the building. He stated the purchasers said they were demolishing the building this Fire Chief Taylor also reported a sign on Highway 171 was blocking the vision of motorists entering the highway from a side street. The sign is located at the Tiger Mart (Marathon gas station). He weekend. said hel had tried too contact the owner but had notl had his phone call returned. PROPOSAL OF BUILDING, ANDLIFES SAFETY DEPARTMENT Fire Chief Shannon Taylor addressed the Council concerning creating a Building and Life Safety Department. He said a new Building and Life Safety Department would be a division of the Fire Department. The Fire Chief would manage and oversee the permitting, inspection, and final approval of new and existing structures within the City and police jurisdiction. He stated the Fire Chief is already responsible for each and every structure in existence within the City and police jurisdiction. By establishing a formalized department, the ability to apply all ordinances, codes and standards would be created. ChiefT Taylor stated the engineering and code enforcement are two different things. He said the need for a city engineer is not pertinent to the need to establish a functioning system tol handle new and existing construction and the removal of the city engineer from the process removes the conflicts associated with it. ChiefTaylor: stated even ifthe City decides tol hire a new city engineer, the creation of af formalized building department should take place. He said the only requirement toi implement this plan would bet toa amend the existing Code of Ordinances. tot thel International Building Code and Fire Code. ChiefTaylor: also recommended the Council consider revising the Code of Ordinances pertaining Mayor Nelson stated the Council interviewed five applicants for the Municipal Judge position. Councilmember Cowart explained how the Council arrived at their decision. After a general discussion, Councilmember Cowart moved to appoint Mr. Steven Nolen as Municipal Court Judge for a term oft two years ata a1 rate of$1,400.00 per month beginning. January 16, 2019. Upon the motion being seconded by APPOINTMENT OF MUNICIPAL JUDGE Councilmember Campbell, the same was unanimously approved. APPROVAL OF FINANCIALSTATEMENT Councilmember Cowart moved the City's financial statement be approved. Upon the motion Councilmember Wilson moved the Park & Recreation financial statement be approved. Upon the Councilmember McCraw moved the Municipal Court financial statement be approved. Upon the Mr. Danny White, Director of the Chamber of Commerce, stated C3 will have open house in Guin on December 13, 2018. Mr. White also stated the C3 "State of the Region" meeting will be held in being seconded by Councilmember Campbell, the same was unanimously approved.
