City Hall Fayette, Alabama June 9, 2020 A regular meeting oft the City Council oft the City of Fayette met at 5:00 o'clock, p.m. on June 9, Upon roll call the following were found to be present: Mayor Ray Nelson, Councilmembers Linda McCraw, Eddy Campbell, Jason Cowart, Cedric Wilson and. Jerry Nichols. Also present were City Attorney Dale Lawrence, City Clerk Dawn Clapp, Police Chief Danny Jenkins and Fire Chief Shannon 2020, int the Council Chambers oft the City Hall. Taylor. The opening prayer was given by Councilmember Eddy Campbell. Mayor Ray Nelson announced a quorum was present and the meeting was open for the Police Chief Danny Jenkins presented the police report for the month of May 2020. The report Chief Jenkins stated the Police Department has two positions to fill and he hoped to have this done by mid-July. The Police Department is budgeted for twelve officers and currently has ten. By filling the positions by mid-July, the new officers could get into the Police Academy quicker. Chief. Jenkins said Chief Jenkins said Officer James Sanders was attending the police officer refresher course at Chief Jenkins stated! hel had investigated potential illegal dumping at the old recycling center. He Fire Chief Shannon Taylor presented the fire report for the month of May 2020. The Fire Mayor Nelson provided the Council with the guidelines for the Fayette Aquatic Center. He stated Eachy person entering the facility willl have their temperature checked. Anyone with a temperature Patrons will be requested to maintain six-feet social distancing from anyone not from the same Admissions and concessions workers willy wear either a face mask or face shield and gloves. Thel Park & Recreation Director recommended no season passes be sold this year, mainly due to the limits on attendance. The Aquatic Center wants every person who enters at any point to be a paying customer. The Aquatic Center is trying to avoid! having peoplei inside whol haven't paid for that day (ie. they buy aj pass and use it more than 101 times) while others with money in hand are having to wait outside. If the decision is made to sell season passes, the Park & Recreation Director recommended it be a flat fee of$100 for each pass, with a limit of 10 visits. After 10 No groups larger than 10 people will be allowed due to the social distancing guidelines. Mayor Nelson said after two weeks the Aquatic Center would evaluate its operations based on paid attendance. The Aquatic Center will open on June 15,2020. The Aquatic Center currently has 57 parties booked. Mayor Nelson stated the Aquatic Center was now wanting to sell the season passes. transaction ofb business. DAL-TILEABATEMENT REQUEST Mr. David Thornell of C-3 reported to the Council on the Dal-Tile expansion and their tax abatement request. He said Dal-Tile was planning a major expansion which would involve a capital investment of $2,013,672.00. Ms. Valerie Watts, Manager oft the local Dal-Tile plant, spoke concerning the expansion stating they were starting tor make a new product and, therefore, they needed to enlarge their facility and bring in new equipment. RESOLUTION 2020-02 RESOLUTION 2020-02 ABATEMENTS FOR Al NEW PROJECT Mayor Nelson presented Resolution 2020-02 to the Council for their consideration. Resolution 2020-02 is as follows: ARESOLUTION. APPROVING AND GRANTING CERTAIN' TAX This Resolution is made this 9th day of June 2020, (the Effective Date) by the CITY OF WHEREAS, the Company has announced plans for a major addition toi its existing facility located WHEREAS, pursuant tot the Tax Incentive Reform Act of 1992 (Section 40-9B-1 et seq., Code of Alabama 1975)(the Act), the Company has requested from the Granting Authority an Abatement of all state and local non-educational ad valorem taxes, construction related transaction taxes, except those construction related transaction taxes levied for educational purposes or for capital improvements for WHEREAS, the Company has requested that the abatement of state and local non-educational ad valorem taxes (ifapplicable) be extended for a period of ten (10)years, in accordance with the Act; and, WHEREAS, the Granting Authority has considered the request oft the Company and the completed applications (copy attached) filed with the Granting Authority by the company, in connection with its WHEREAS, the Granting Authority has found the information contained in the Company's application to be sufficient to permit the Granting Authority to make a reasonable cost/benefit analysis of WHEREAS, the Company is duly qualified to do business in the State of Alabama, and has powers to enter into, and to perform and observe the agreements and covenants on its part contained in WHEREAS, the Granting Authority represents and warrants to the Company that it has power undert that constitution and laws oft the State of Alabama (including particularly the provisions of the Act) Section 1. Approval is hereby. given to the application of the company and abatement is hereby granted of all state and local non-education ad valorem taxes, all construction related transaction taxes, except those construction related transaction taxes levied for educational purposes or for capital improvements for education," tot the fullest extent permitted by the Act. The period ofa abatement for the non-educational ad valorem taxes (if applicable) shall extend for a period of ten (10) years measured as provided in Section 2. The Mayor and City Clerk of the City of Fayette, the Granting Authority, are hereby authorized to execute on behalf of the City an abatement agreement with the Company toj provide for the Section 3. A certified copy oft this resolution, with the application and abatement agreement, shall be forwarded to the Company to deliver to the appropriate local taxing authorities and to the Alabama Section 4. The governing body of the Granting Authority is authorized to take any and all actions FAYETTE (the "Granting Authority"), to grant at tax abatement for DAL-TILE CORPORATION (the" "Company") withint thej jurisdiction oft the Granting Authority; and, education, mortgage and recording taxes; and, request; and the proposed project and to determine the economic benefits tot the community; and WHEREAS, the project will involve a capital investment of $2.013.672.00; and the Tax Abatement. Councilmember Cowart Mayor Nelson announced Alabama Power Company was almost finished converting the street City Clerk Dawn Clapp reported for the month of May, the City received $252,626.00 in non- designated sales tax and the Vaf sales tax for the hospital generated $40,425.00 for a combined total of $293,152.00. She stated the City received $8,900.00 in sales tax from online sales last year, and has received $13,870.00 this year. She stated the City received $2,002.00 in alcohol taxes. Councilmember Cowart spoke concerning the opening of the bathrooms at Guthrie Smith Park. He said the City should consider delaying the opening or buy protective equipment for those cleaning them.
