COMMUNICATIONS FROM CITY STAFF meetings on the declining trend on enrollment. City Manager Foltz announced the South Bay Union School District is holding town hall 6. PUBLIC COMMENT Juliana Gonzalez spoke about the closure of the Scripps Labor and Delivery Unit. June Frost announced the upcoming Kiwanis Pancake Breakfast event. Agustine Rojas expressed concern about how every rain event causes sewage, debris, Jarrod Casswell complained about a homeless person that broke into his property and Ron Schwab was opposed to the closure of the Scripps Labor and Delivery Unit. Julie Schwab was opposed to the closure of the Scripps Labor and Delivery Unit. Teah Caine was opposed to the closure of the Scripps Labor and Delivery Unit. Danielle Richardson was opposed to the closure of the Scripps Labor and Delivery Unit. Lauren Gaw was opposed tot the closure oft the Scripps Labor and Delivery Unit. She asked Josie Hamada questioned why there were no more flags near the Dempsey Center and suggested flying first responder flags. She asked IB to look into the $1B that CalTrans will have for road projects. She asked for information on the final design of the IB Pier. Mayor Aguirre, as Chair of the City Council, directed staff to agendize the closure of the Scripps Labor and Delivery Unit for the April 17, 2024 City Council meeting. 7. PRESENTATIONS 7.a PROCLAMATION REÇOGNIZING: NATIONAL CHILD ABUSE PREVENTION MONTH- - APRIL 2024. (0410-30) Motion by Councimember Seabury Seconded by Councimember Fisher To approve the Proclamation. AYES (4): Mayor Aguirre, Mayor Pro Tem McKay, Councimember Seabury, and Councimember Fisher ABSENT (1): Councimember Leyba-Gonzalez Motion Carried (4 too 0) Councilmember LeyDa-Gonzalez left Council Chambers at 6:50 p.m. and returned at 6:53 p.m. No public comments. Councimember Fisher read the proclamation. 3 Councimembers shared personal experiences with autism and there was encouragement to accept, uplift, and support those with autism. The Mayor and Councilmembers presented the Proclamation to Engineer Paramedic Daniel Holian. 7.c IMPERIAL BEACH CHAMBER OF COMMERCE UPDATE. (0130-10) Marty Mattes, President of Imperial Beach Chamber of Commerce, gave a PowerPoint presentation. No public comments. The Mayor and City Council expressed appreciation for Mr. Mattes' efforts on the Chamber of Commerce and for getting businesses involved. There was support for the Chamber of Commerce and the City finding opportunities to partner up and encourage people to buy local, stay local and enjoy what is in Imperial Beach. Mayor Aguirre commented that although the sewage crisis is impacting businesses, she reminded everyone that this has been the wettest winter ever. She spoke about the importance of surveying businesses in all areas of the City and to not rely only on conversations. She further stated there are sophisticated tools out there for tracking data. City Council received and filed the February 2024 Treasurer's Report. 8.d RESOLUTION NO. 2024-016 AWARDING A PUBLIC WORKS CONTRACT TO ACE EXCAVATING & ENVIRONMENTAL SERVICES, INC. TO CONSTRUCT 4 THE SPORTS PARK RESTROOM PROJECT AND ALLOCATE ADDITIONAL Adopted Resolution No. 2024-016 awarding the construction contract to Ace Excavating & Environmental Services, Inc. for a not-to-exceed amount of 8.e NOTIFICATION OF TRAVEL: MAYOR AGUIRRE WILL ATTEND THE SAN DIEGO CHAMBER OF COMMERCE DELEGATION TO WASHINGTON D.C. APRIL 14-17,2024. THE ESTIMATED EXPENSES FOR TRAVEL, FUNDS TO THE PROJECT (P23101) (0330-35 & 0920-40). $368,000.00 for the Sports Park Restroom Project (P23101). ACCOMMODATIONS AND MEALS IS $1,860. Shirley Nakawatase, Chair of the Sun & Sea Committee, spoke in support of having the event. She spoke about a lack of vendors and sponsors due to the sewage issue and requested the City assist with funding the shortfall. The Mayor and City Council discussed options to make the event happen yet be fiscally responsible. There was support to approve the event conditionally sO the Sun and Sea Committee can work on obtaining sponsors and vendors for the event. Motion by Councilmember Fisher Seconded by Councimember Seabury To approve the 2024 Sun and Sea Event under the required condition that the Sun and Sea Committee secure at least half of the vendors (7 to 10) by the deadline of 5 the end of May; by the 4th of July at least 15 vendors must be secured to move forward with a road closure; and the City's logo is required on all promotional AYES (5): Mayor Aguirre, Mayor Pro Tem McKay, Councimember Seabury, Councimember Fisher, and Councimember Leyba-Gonzalez materials. (0460-20) CAO Cortez-Martinez gave a PowerPoint. No Public comments. Councimember Fisher asked that the resolution be posted on the City's website and let voters make their own decisions about the matter. He spoke in support of the resolution. Mayor Pro Tem McKay spoke in support of the item. Mayor Aguirre spoke in support of the item and was hopeful that other cities follow IB's lead. Motion by Councimember Fisher Seconded by Mayor Pro Tem McKay To adopt Resolution No. 2024-018 opposing the Taxpayer Protection and Government Accountability Act (Initiative No. 21-0042A1) and request that the Mayor send a letter on behalf of the City Council tot the League of California Cities AYES (5): Mayor Aguirre, Mayor Pro Tem McKay, Councimember Seabury, Councimember Fisher, and Councimember LeyDa-Gonzalez opposing Initiative No. 21-0042A1. City Council expressed appreciation for the leadership, progress and growth City Mayor Aguirre announced that pursuant to Government Code Section 54953 Resolution No. 2024-017 authorizes an increase to the benefits of the City Manager Foltz has made over the past year.
