Councilmember Strohman felt that user fee increases, even based on the Consumer Price Index (CPI) annual increase, should be frozen due to the toughening economic times, which Councilmember Walker agreed with. Mayor Bellinger stated concerns with freezing user: fee increases, stating it could make for an even bigger jump ifthe City were to catch up in later years. Mayor Pro Tem Hagan felt that, based on the budget and state of City finances, it would not be prudent to freeze fee increases. Councilmember Engle agreed. SJCOG Citizens Advisory Committee (CAC)Quarterly Report Mayor Pro Tem Hagan inquired regarding what staffi member handled Human Resources at the City. Finance Director/HR Administrator (FDHRA), Celinda Bickner, responded that she was the Human Sergeant Zambrana informed the council that Officer Figone had accepted a position with the City of Ripon. However, ai new officer was recently cleared from training, and a second officer was currently in training. He also informed the council that there had been an increase in burglaries on the north side oftown during the month of May, and that patrols had been increased in the area, which seemed to be helping. Finally, he noted that Officer Palomino led the department with 12 Public Works supermtemoent.Manager (PWSM), Juston Collins, advised that the Phase 2 McHenry Sewer Project was nearly complete. He also noted that the Wastewater Treatment Plant (WWTP) Biosolids Removal Project was set to start tomorrow, with the industries beginning their operations onJ July 1st. He then politely reminded the public to ensure care of their overgrown lots for safety reasons, and encouraged everyone to attend the next Farmer's Market on Wednesday. Councilmember Strohman commended Public Works for their quick work during Memorial Day weekend fixing a major water leak on Yosemite Avenue. He noted that there seemed to be an increase in water leaks lately, inquiring ift that was normal for this time of year. PWSM Collins responded that it was normal for summer time, as more water was used, and that Public Works staff was doing a sizable portion of this work in-house, which helps reduce delays and reduce costs. He praised the team for their hard work and thanked the Police Department for being a great partner during water leaks. Interim City Manager French noted that Public Works staff tracks all water leaks, and that this information is used to determine which lines were needed more than periodic repairs and would incorporate this information into the City's Capital Improvement Program (CIP) Resources Administrator. arrests and 44 citations last month. for line replacements. MINUTES Escalon City Council June 17,2024 Page 4of6 Escalon resident, Gabriella Vargas, brought forth several issues, acting as an advocate on behalf of residents, as the owner of the Escalon Residents Facebook page. These included the trees on Sophie Lane needing to be trimmed and the aphid problem dealt with, the nuisance excessive feral cats in town, particularly on First Street near James Street, and her concerns with police officers having an attitude and possibly profiling drivers based on the cars they drive, rather than focusing ont the speeding Escalon resident, Ed Alves, thanked Interim City Manager French for his help in providing information tol him and PWSM Collins for taking care ofthings int town. He inquired ifthes solar system installed for the city was as efficient as promised and encouraged staff to reach out to Engie to subsidize the difference ifit was not. He also highlighted issues which could be improved with the budget format, including indexing and a larger print size, although he commended staff for the great Escalon resident, Betty Bennett, inquired if the trees referenced on Sophie were crepe myrtles, and if Escalon resident, Vance Nielsen, expressed concern regarding the number of overgrown lots in the neighborhoods and suggested having the senior patrol drive around and make note ofwhich ones need PWSM Collins noted that Public Works was gathering bids to doai full tree trimming fori the Westwood Country Landscape Maintenance District and staff would be treating for the aphids on the infected problem on First Street between Pioneer Drive and El Portal Middle School. job on the budget. sO, that a treatment would need tol be applied early in the year to mitigate aphids. to code enforced. trees themselves. Ms. Vargas thought that there could have been better communication regarding the budget Mr. Alves questioned what the balance of funds collected for the SSJID Surface Water Project was and where it was located in the budget. FDHRA Bickner responded that she would get that information to Mr. Alves. Mayor Bellinger closed the item for public comment. FDHRA Bickner responded that this was why fund management was sO important. Mayor Bellinger thanked staff for all oft the hard work they put into creating a balanced budget. Councilmember Walker questioned the South McHenry to Jones CIP Project. Interim City Manager French noted that, per previous CIP decisions, that that item would be dropped from the budget and Councilmember Strohman noted that he asked ChietHardgraves what he thought of the budget cuts to the Police Department during the budget workshop. Chief Hardgraves responded that it was putting equipment and new police vehicle purchases on hold, but the budget was ai real budget for the Police Department and ChiefHardgraves was not concerned with the cuts. Councilmember Strohman wanted the residents to know that all departments had made a commitment to this budget and, while it was lean, there should be no disruption to the level ofs service normally provided by the City. Hej praised staff for presenting a balanced budget, prior to. July 1st, with no excess spending. Councilmember Engle also gave his appreciation to staff for the budget presentation from two weeks ago and tonight, noting the Council and community would be tracking the progress oft the budget Councilmember Strohman inquired ifs staffwould' bej presenting quarterly updates on the budget, MOTION - Iti is moved/seconded by WALKERSTROHMAN to Adopt Resolution No. XX-24, approving the Fiscal Year 2024-25 Proposed Budget, including the Capital Improvement Plan, as amended to remove the South McHenry to Jones CIP Project. She encouraged the public to report overgrown lots in town through code Councilmember Strohman asked if council could request increased fireworks patrols for the holiday. Mayor Bellinger agreed that more patrol would be good. Sergeant Zambrana noted that patrol is always Councilmember Strohman informed the council that he had been approached by the San Joaquin County District Attorney's Office asking if the City had interest in applying for an asset forfeiture grant. He also asked for a status update on a potential Murphy Ranch town hall meeting, which Interim City Manager French provided. Next, Councilmember Strohman informed everyone that the senior lunch program had lost one day of programming, so it would only bel held on Tuesday afternoons, and asked staff to try to find funding to bring back that second day. Next, Councilmember Strohman stated that the Escalon Fire Protection District was looking to have regular meetings with the City, much like the City already had with the Escalon Unified School District, and asked for a consensus from council to have staff start the process of forming a 2x2 committee, which was received. Councilmember Strohman then asked for a transportation update for Finally, Councilmember Strohman wished everyone a safe 4th of. July and encouraged everyone to support the Escalon Chamber of Commerce by attending the upcoming Farmers Market, as it was Councilmember Engle questioned where someone could find the budget on the City of Escalon Mayor Pro Tem Hagan asked that staff work on the weedy lots in town, and encourage everyone to maintain decorum during the election this year. He noted that staff was doing a great job and he appreciated what they did for the budget. He encouraged the public to read about the Saudi petrodollar Mayor Bellinger praised staff for the great work on the budget. He hoped residents would support the Farmers Market and support the local non-profits by buying fireworks locally. He wished everyone a further discussion and a decision. Briscoe finished removing the solidsi in ponds 1 and 2. Vito started repairing the banks in pond two. The industrial season officially began in June. Eckert's began their production on Tuesday 6/25. Staff began installing and starting aerators as needed and continue making repairs when necessary. Pond 3 is receiving production water and is at 3' of free board and began spilling over into pond 2. Pond 41 remains at 8' of free board and has 2 running aerators in the pond. No odor complaints were reported during the month of. June. Domestic System: An average of .430 MGD of domestic flow was received at the plant according to. June 2024 meter data, totaling 12.896 MG for the month. Staff continues with maintenance around the plant. Staff worked on aerators making repairs as needed. No odor complaints were reported for June. Under Revenue and Taxation Code $ 7272, the California Department of Tax and Fee Administration (CDTFA) will assess the City charges to administer the new. local sales tax based on actual costs, with a statutory maximum not to exceed $175,000. XX-24 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ESCALON, CALIFORNIA CALLING FOR THE PLACEMENT OF A GENERAL TAX MEASURE ON THE BALLOT FOR THE NOVEMBER 5, 2024 GENERAL MUNICIPAL ELECTION FOR THE SUBMISSION TO THE QUALIFIED VOTERS OF AN ORDINANCE TO ENACT A GENERAL TRANSACTIONS AND USE TAX (SALES TAX) AT THE RATE OF ONE CENT (1f) WHEREAS, the City of Escalon ("City") is authorized to levy a Transactions and Use Tax ("TUT") for general purposes pursuant to California Revenue and Taxation Code section 7285.9, subject to approval by a majority vote of the electorate pursuant to Article XIIIC, section 2 of the California Constitution (*Proposition 218"); and WHEREAS, pursuant to California Elections Code section 9222, the City Council has authority to place local measures on the ballot to be considered at a Municipal Election; and WHEREAS, the City Council would like to submit to the voters at the November 5, 2024 General Municipal Election a measure established the rate of the TUT of one cent (1f) on the sale and/or use of all tangible personal property sold at retail in the City until it is repealed by voters, as more specifically set forth in the attached proposed ordinance adding Chapter 3.14 to the City's Municipal Code; and WHEREAS, the City of Escalon prides itself on maintaining a high level of service through fiscal responsibility and efficiency where it recently passed an operationally balanced budget for the next fiscal year that maintains funding for the services that our residents and businesses use; and WHEREAS, even with an operationally balanced budget, challenges remain to fund maintenance and enhancements to existing infrastructure and facilities, that over time will become more expensive to address in the future; and WHEREAS, the City's current General Fund budget outlines $5.3 million in revenues and expenditures for the 2024-2025 fiscal year that included in $515,000 in cuts related staffing, programs, and services; and $3.23 million in reserves over the next five years; and WHEREAS, according to the budget projection, Escalon will deplete its WHEREAS, like many organizations, Escalon is experiencing the impact of inflation. Increasing operational costs are anticipated to reduce City services and defer capital improvement projects over the next 5-10 years; and WHEREAS, the City Council has explored different revenue-generating approaches to maintain the current levels of service and fund capital improvement projects; and WHEREAS, a significant amount of the sales tax revenue last year came WHEREAS, the City Council has determined that a sales tax measure is the most suitable revenue source that is equitable amongst City residents and out-of-towners while generating the funding to continue providing services to from those who reside outside of Escalon; and residents and businesses; and WHEREAS, the City of Escalon's Local Services Measure would raise the local sales tax by 1f, and if approved, would generate an estimated $900,000 each year of new and local revenue to maintain City services that benefit the residents and businesses of Escalon; and WHEREAS, a 1f increase in the City's local sales tax does not apply to groceries, prescriptions, medical and dental services, real estate, rent, education, utilities, personal services, or labor; and WHEREAS, this measure incorporates accountability provisions, such as public disclosure of all spending and annual independent financial audits; and WHEREAS, the one cent (1f) TUT is a general tax, the revenue of which will be placed in the City's general fund and will be used to pay for general City services; and WHEREAS, on November 6, 1996, the voters of the State of California approved Proposition 218, an amendment to the State Constitution which requires that all general taxes which are imposed, extended or increased must be submitted to the electorate and approved by a majority vote of the qualified electors voting in the election; and WHEREAS, pursuant to Proposition 218 (California Constitution, Article XIIIC, section 2(b)), the general rule is that any local election for the approval of an increase to a general tax must be consolidated with a regularly scheduled general election for members of the governing body of the local government; and WHEREAS, the next regularly scheduled general election at which City Council members will be elected is November 5, 2024; and WHEREAS, pursuant to Government Code section 53724 and Revenue and Taxation Code section 7285.9, a two-thirds (2/3) vote of all members of the City Council is required to place the Measure on the November 5, 2024 ballot; and WHEREAS, the ordinance to be considered by the qualified voters and the terms of approval, collection and use of the general TUT are described and provided for in the ordinance/measure attached hereto as Exhibit "A" (the Measure") and by this reference made an operative part hereof, in accordance with all applicable laws. The City Attorney shall prepare an impartial analysis of the Measure, not to exceed 500 words in length, showing the effect of the Measure on the existing law and the operation of the Measure, and transmit such impartial analysis to the City Clerk not later than August7, 2024, at 5:00 p.m. The impartial analysis shall include a statement indicating whether the Measure was placed on the ballot by a petition signed by the requisite number of voters or by the City Council. For the purposes of this ordinance, all retail sales are consummated at the place of business of the retailer unless the tangible personal property sold is delivered by the retailer or his agent to an out-of-state destination or to a common carrier for delivery to an out-of-state destination. The gross receipts from such sales shall include delivery charges, when such charges are subject to the state sales and use tax, regardless of the place to which delivery is made. In the event a retailer has no permanent place of business in the State or has more than one place of business, the place or places at which the retail sales are consummated shall be determined under rules and regulations to be prescribed and adopted by the California Department of Tax and Fee Administration. 3.14.060 - Use Tax Rate. An excise tax is hereby imposed on the storage, use or other consumption in the City of tangible personal property purchased from any retailer on and after the operative date of this ordinance for storage, use or other consumption in said territory at the rate of one percent (1%) of the sales price of the property. The sales price shall include delivery charges when such charges are subject to state sales or use tax regardless of the place to which delivery is made. 3.14.070 - Adoption of Provisions of State Law. Ifas seller's permit has been issued to a retailer under Section 6067 of the Revenue and Taxation Code, an additional transactor's permit shall not be required by this Ordinance. 3.14.100 - Exemptions and Exclusions. No injunction or writ of mandate or other legal or equitable process shall issue in any suit, action or proceeding in any court against the State or the City, or against any officer of the State or the City, to prevent or enjoin the collection under this ordinance, or Part 1.6 of Division 2 of the Revenue and Taxation Code, of any tax or any amount of tax required to be collected. 3.14.130 - Duration of Tax. The tax imposed by this chapter shall continue until this ordinance is repealed. Background and] Discussion: On June 17,2024, Councilmember Strohman expressed desire to apply for the SJCDA Asset Forfeiture Funds to support programs such as the Healthy Room Project and other programslefforts and/or equipment for the youth of Escalon. Mayor Pro Tem Hagan supported bringing an item before the council to identify the preferred use of the funds tol be compiled in an application and submitted to SJCDA with the hope of receiving said funds. Fiscal Impact: There is not expected to be ai negative fiscal impact to the City as part of this grant program.
