Upon the call ofroll, the following were found tol be present: Mayor Nelson Councilwoman Greene Councilman Heathcoe Councilman Ivy Councilwoman Moss Councilman Howell City clerk was present RESOLUTIONS, ORDINANCES OTHER BUSINESS Councilwoman Greene made ai motion to hire Mr. Johnny Lane for the city attorney. Councilwoman Moss second, all favored, none opposed, motion carried. Councilman Howell asked was there information on the cost of the attorney. Councilwoman Greene states $150.00 an hour, no retainer, only use. Mr. Lane when needed. Roll Call Vote: Hiring Attorney Councilman Howell Councilwoman Moss Councilman Ivy Councilman Heathcoe Councilwoman Greene Mayor Motion carried by unanimous vote. Yes Yes Yes Yes Yes Yes Mayor states that the next order ofbusiness is Ordinance 2-10. Councilwoman Greene states that the ordnance regulates the appointing authority and it was dated 4/12/2001. The ordinance states that the Mayor and city council is hereby nominated as the appointing authority of the City of Creola. As the appointing authority the Mayor and the council by majority vote shall have the right tol hire, promote, transfer, demote and terminate any city employee in conjunction and accord with the rules and regulations of Mobile County Councilwoman Moss has the State of Alabama codes in section 8 for Mayors. It states that no recognized executive authority, the council may not only determine policy but supervise and Councilwoman Moss states she was not aware of Councilman Howell and Mr. John Loden being put on the negotiating committee. It was not discussed in the meeting that took place earlier. The Mayor states he will give the council the code and it will be placed in the council's box Councilwoman Greene states the Alabama Attorney General Opinion has looked at the issue of the Mayor Appointment authority under 11-43-81, the AG has determined that where the code is silent as the appointing authority the Mayor has the power to make the appointment unless the council by properly drafting ordinance provides a different method of appointment.
