Rev. Chambers gave invocation. Upon the call ofroll, the following were found tol be present: Mayor Nelson Councilwoman Greene Councilman Heathcoe Councilman Ivy Counciwoman Moss Councilman Howell Attorney Johnny Lane was absent and Christie filled in for City Clerk. Minutes from the council meeting held on, February 13, 2014 were presented. Councilman Ivy made ai motion to accept the minutes from thel last meeting. Councilman Heathcoe seconded, all favored, none opposed, motion carried. CITIZENSADDRESSING THE COUNCIL Rev. Chambers states that a few citizens came to a meeting and spoke about a business in the area. The planning board has gone through the process of finding out the zoning oft this property. The zoning was changed after the zoning ordinance book was updated. The property in question is Mr. Hicks and he is zoned M1. Rev. Chambers states that the board has asked SARPC for a clear understanding what M1 was. The planning board has an obligation to the residents and business and the council has the authority to enforce compliance of the zoning ordinance. The planning committee has no authority to enforce anything, only to make oidinance, rules and give out permits. The board asks the council to review ordinance. Rev. Chambers read the ordinance. Rev. Chambers states that the board brought this before the council months ago and they are Mayor asked Mr. Hicks when he started the business. Mr. Hicks states in 1993, about 22 years ago. Rev. Chamber's states that Mr. Hicks asked to be rezoned M1 after the ordinance was bringing it again to see what can be done. Cm 2.27.14 Page 1 updated. Mr. Hicks states he explained to the council 21 years ago what he wanted to do and they zoned him wrong at that time. Mayor states he will have to talk to the attorney Johnny Lane for advisement. Rev. Chambers suggest that they have a workshop because the board as sent letters, they have all been in meetings, and if they are. not going to go by the ordinance then there is no reason to have them. Rev. Chambers states that the ordinance book was updated in May 2002 and any property that is zoned after this date has to go by the ordinance that isi in effect. Mr. Crisswell states Mr. Hicks, the group that is complaining, council, attorney and board sit down together and try to work out a way that will work for everyone. Mr. Crisswell states that this has gone before the council and nothing is being done. Mr. Hicks states that he has been to court and it has been thrown out. Mayor states he will contact the attorney and set up a workshop to discuss this issue. Mr. Hicks states that all he wants is for someone to tell him what he needs to do. Mayor states to Rev. Chamber states to Mr. Hicks that the board done what it was supposed to do and that was to bring it before the council. The board can only tell you what the ordinance says to do. Mrs. Heathcoe addressed the council with her concern of tar sand and tank farms possible coming the community in the future and they are very dangerous and asked that the council put an ordinance in place to prevent this type of activity in our area. Mayor and council will check just be at the meeting when it is set. Rev. Chambers states to revisit the ordinance itself. into getting an ordinance. RESOLUTIONS, ORDINANCES OTHER BUSINESS Mayorr read Resolution 14-255 to display the words In God We Trust ini the city Hall. Councilman Howell made ai motion to adopt resolution 14-255. Councilwoman Moss second, all favored, none opposed, motion carried. Jeff ReƩves introduced a youth named Gavin Reeves who is with Boy Scouts Troop 32 and is working toward getting citizenship badge. Mr. Reeves explains to receive this pin; he has to attend ai meeting to observe how government operations work. Rev. Chambers states they have spoken on the M1 issue already. PLANNING COMMITTEE Rev. Chamber states that they need to have a workshop outside of their regular meetings to discuss the inspections outside of city limits. Rev. Chamber's states that we might need to take the motion back about the ordinance but he thinks we should keep doing the subdivision inspections. Mayor states that in 2004, he introduced ai resolution, and Mayor Phillip sent al letter to Commissioner Jones but the county never acted on their part of the letter. Mayor states he has spoken to several people that have had the county inspect their property since the letter. Mayor states that his biggest issue is safety and liability and that he and building inspector Don Moss will discuss this later. Mayor states that the current building codes in Mobile are 2012 and we are 2000 codes. Mayor said he spoke with the attomey and the liability issue concerns him. Councilwoman Greene states that the people are stating that the county is telling them to call Creola to their inspection. Ifthe letter and fax did not go through to the county back in 2004 then why is the county telling people to call us? Mr. fosters states that the county told him to call Mayor states that they will talk to the attorney and see what needs to be done. Cm 2.27.14 Page 2 Creola. Mayor states that if you talk to people who live in Pecan Woods other than Mr. Duke, ski Councilwoman Moss asked ift the city would lose money if these properties are inspected by the county. Mayor states that we could make money inspecting. Mayor states that if we are qualified then we could do it. Councilwoman Moss asked how we could go about being qualified. Mayor states that we are qualified to the flood zone administrator, electrical inspections, mechanical, building inspections. Mayor states we are operating off of 2000 building codes and the current law is 2012. Councilwoman Moss states that she thinks it is the councils fault for not keeping the books updated. Mayor states that the employees bring the training session to the council for approval. Mayor states the council pays for the books and training. Mayor states that if the building inspector needs training he needs to bring it before council. Mr. Crisswell states that the council votes in which national codes it wishes to operate off of. Mayor states that Mobile is in the process of adopting the 2012 codes, and Saraland is on 2009 getting ready to adopt the 2012. Councilwoman Greene asked what we are on. Mayor states 2000 codes. Building inspector Don Moss states he is going by the 2009 codes. Mayor states he will be checking with the personnel Counciwoman Greene states to the Mayor that if you did set a motion in 2004 and then you wrote a letter to Kim and Don without even going through the council. Mayor states that when it comes to those people there, he directs their work activity. When I have a concern about safety and liability, I wrote that letter and I will write another letter until I'm satisfied that we are doing what is safe and not be liable for the situation. Councilwoman Greene states that it is hard to believe that the county did not get all the information back in 2004. Mayor states that what he is saying is the county is still doing inspections that they never quit. Councilwoman Greene states that we have done inspections outside of our city limits. Mayor states he is looking for them, other than what Don Moss has done. Building inspector, Don Moss states he has a stack oft them. The Psalms 23 horse ministry (James Malone) will be at the senior building on March 26. The building willl be painted on Monday (3/3/14) FINANCE Councilwoman Green states that the public works sign will cost $680.00. Councilman Howell made ai motion to purchase the sign. COMMUNITY GROUP Councilwoman Greene states that the next meeting for the Community group, CCU, and the Creax scholarship program will be on March 10. POLICE AND FIRE Fire Chief Reeves states that 4 people will be going to fire training in Tuscaloosa on March 29- 30. Will get price ofhotel and bring it back. Councilwoman Greene states that the Fire department had 33 calls for February. STREETS Councilman Heathcoe states that bobby has been busy. They purchased 1 load of gravel for Councilman Heathcoe made ai motion to purchase 2 loads of rocks for Brown rd. Mayor states the insurance is one of the biggest out flow of funds. Councilwoman Greens states that she will ask Kim for a report about the insurance for the next meeting. Councilman Howell states to invite someone to come in and give updated rates.
