ChiefTaylor gave invocation. Pledge of Allegiance was recited. Upon the call ofroll, the following were found to be present: MayorNelson Councilwoman Greene Councilman Heathcoe Councilman Ivy Councilwoman Moss - Councilman Howell Attorney Johnny Lane and City clerk was present. Minutes from the council meeting held on, February 13, 2014 were presented. Councilman Heathcoe made ai motion to accept the minutes from the last meeting. Councilman Ivy seconded, all favored, none opposed, motion carried. CITIZENS. ADDRESSING THE COUNCIL Mrs. Jackie Stewart states that first she would to forgive Councilwoman Moss because her son- n-law preached on forgiveness the other day. Mrs. Stewart states that she appreciates them coming up and cleaning it but did not appreciate them throwing all their stuff away. She states that the seniors have been up there around 15 years and have never had anyone come and throw away their personal things and she thinks they need to pay for the items that were thrown away. Mrs. Stewart asked for some guidelines about taking children to the Senior Center. Mrs. Stewart states that she keeps her grandbaby once a month and she takes him with her up there. Mrs. Stewart understands that employees can't keep children on the clock while working but why can't the seniors bring children with them? Mayor states he has given each council person a copy of the bylaws and he commends the two council ladies that did the painting and cleaning at the center. They did a great job. Mayor states for the council and seniors to look over the guidelines Cm 3.13.14 Page 1 make changes ifi needed and bring back at the next council meeting. Mrs. Stewart asked who was going to replace the items that were thrown away. Mayor states to give an itemized list of the thrown away items. Mrs. Stewart states a book cabinet was thrown away. Councilwoman Moss states that the back was coming off of the cabinet and it needed to be thrown away. Councilwoman Moss states that everything that was thrown away was rusty and old. Old filing cabinets were thrown away because the bottom was rusted out. Mrs. Stewart states that she made 20 bean bags to play games with and the few that they found in the dumpster were ruined. Mrs. Stewart states that they got a lot out oft the dumpster but lots ofit was ruined. Mayor states to put a list together of what is missing and the council will work towards it. The plunger Councilwoman Greene states they did not see a plunger but they did throw away the toilet brushes but they bought new ones to replace them. Mrs. Stewart asked about why the children Kim, city clerk explained the details about children at center. The city insurance agent from AMIC, Mr. Buttonshaw had come to do an inspection ofall city facilities, he visited the center as aroutine and an employee was keeping an infant daily and when he asked the city clerk, he then explained that this was a liability for the city and that it is bad practice that employees probably shouldn't bring children to work daily, but that has nothing to do with Seniors bringing children or grandchildren to the center to visit or have meals with them. Children are allowed to be in the center, just that the employees cannot have a common practice of babysitting children on the clock and advised the city clerk and police chief that this is something that may need to go into the employee handbooh. Mrs. Stewart asked about Frieda's personal property from her office. Mayor states to write down and make a list. Mrs. Loraine Bryant states personal items should be kept at home as they could also spread germs to the seniors or anyone, and stated that most businesses as common practice do not allow children in the work place, and it is probably not good for sO many children tol be around the seniors anyway, they too could make them sick. Councilwoman Moss states before they started the painting and the floors, she asked Mrs. Frieda to clean out the desk and clean out everything that she wanted and she did not do it or remove any items that she wanted. Mayor states to get a list together. Mayor states that Mrs. Frieda Mr. Joel Pike states that they got one load of rocks and would like to get one more load for Mr. Pike states that there are rumors about our inspector not being qualified, he stated that he was surprised and quite offended by this rumor especially since it seemed to have come from one oft the city leaders, he stated that Mr. Moss has always been professional and highly qualified and experienced and has done a great job for the city. Mr. Pike states he has been in the construction business for about 35 yèars and 99% of city inspectors or retired construction people. Mr. Moss is doing a great job, he is bringing revenue into the city, He is catching people that does not have business licenses, keeping everyone current with permits and he hopes the council can appreciate him as well as the citizens and businesses do. Another citizen echoed Mr. Pikes comments and stated that the city helps lots of businesses and residents in the jurisdiction because the county only sends inspectors out possibly once a week and Mr. Moss is always timely and dependable with the permitting in all areas and hopes the city will continue to service the jurisdiction as they was thrown away. can'tcome to the center. works forl him and that is her office and she needs to lock it up. Cm 3.13.14 Page 2 RESOLUTIONS, ORDINANCES OTHER BUSINESS Mayor states for the council to look over the leash law provided by Mr. Lane and be ready to Mayor asked the council if they were ok with the rental inspection fees. Mayor states that the council needs to send the property owners a letter to notify them of the fee. Mr. Smith asked what the Rental fee was for. The council and citizens talk about the inspection fee. The inspection fee is for rental property owners only and it is where the inspector goes through all rental property to make sure everything is up to code and safe for the people renting and serves as a business license as well, the trailer parks already pay an annual per unit fee. Mayor state that the Tar Sands resolution was given to the council and the attorney Johnny Lane got a copy. Mayor asked council and attomey to look over and bring back to the: next meeting. discuss at the next meeting. PLANNING COMMITTEE Mr. Chambers is out of town. Mayor states that the council got a letter from the planning board asking for assistance from council and the attomey Mr. Lane to determine if Hicks Pallet is in compliance with the M-1 definition. Is Hicks Pallet conducting as a manufactory lite company? Mayor states that the Zoning board can change the definition by adding or taking away from through a process that they go thru and then the council will make a decision to accept their recommendations. Mayor states that Mr. Hicks should be grandfathered if anything is changed in the M-1 definition. Mayor states that the council can give opinion of the situation but the board has to handle it. Mr. Hicks is present. Attomey Johnny Lane said boards need to act. Mayor stated that Cobert Bending and Mr. Lassiter trucking had to put up fencing between their business and the residential area. Mr. Lane said that he is the attorney for the city and that the council cannot get in the business of the Zoning Board. Mr. Lane told Mayor several times to move on and he does not need to discuss the Hicks issue, it needs to be addressed separately from the council. The council cannot make a decision for the Board, and Mayor needs not to address this it is the Mr. Criswell explained that citizens have been coming to the board with complaints and the board has brought that to the council. Mr. Criswell states that the board, the council and Mr. Hicks could talk about maybe Mr. Hicks could put a fence around the area that is generating noise and possible going through the procedures and then he would be in compliance. Mr. Lane stated that Mr. Hicks should be grandfathered or they need someone to look into it, he has been in M-1 for 7 years and now the fence is an issue. Mayor states for Mr. Hicks and some of the planning board to meet after the council meeting and speak further on the situation. Councilwoman Greene states that the board may not meet Tuesday night due to not having any Boards business. Mayor continued to speak, Mr. Lane advised to move on. business. No business ZONING BOARD OF ADJUSTMENTS PARKS AND RECREATION Councilman Howell states that he is waiting on update on the walking trial. Cm 3.13.14 Page 3 UTILITIES AND SENIOR CITIZEN Mayor states to give. Mr. Frieda a copy oft the guidelines of the center. Councilwoman Moss states that they will have an Easter party on April 17, 2014 at the center. Councilwoman Greene read report and gave bank balances as of3/13/2014. FINANCE General fund 4cent gas tax 7cent gas tax $69,838.30 $6,750.47 $1,6088.48 Councilwoman Green made ai motion to accept the finance: report as presented. Councilwoman Moss seconded, all favored, none opposed, motion carried. Councilman Howell made a motion pay bills as presented. Councilman Heathcoe seconded, all favored, none opposed, motion carried. COMMUNITY GROUP Mrs. Casie Bennet thanked everyone that helped pick up trash. Councilman Heathcoe drove truck and picked up bags and Rev. Chambers helped pick up trash. Mrs. Bennet states they picked up 20 bags of garbage on Hwy 43. The community trash pick-up day will be held the 1St Councilwoman Greene states that the community yard sale will be held 4/12/14 at the park and you can reserve a spot for $15.00. Councilwoman Greene announced Citizen of the year award for 2013 was Rev. Chambers and the Business of the year award goes to. Axis welding. Mayor thanked the police department for helping and being flexible with all the funerals. Councilman Ivy agreed with the mayor and states that he had heard a lot of good reports on Councilman Ivy states that the air condition unit needs to be fixed on police car unit 2 for the Saturday oft the month. POLICE AND FIRE escorting the funerals. amount of$700.00. Councilman Ivy made a motion to purchase an a/c unit for $700.00 unit 2. Councilman Heathcoe second, all favored, none opposed, motion carried. Councilman Ivy motioned for the chieft to attend the seminar. Councilman Howell seconded, all favored, none opposed, motion carried. Councilman Ivy states that the Chiefwould like to attend a police chief seminar on 3/24/14. Councilman Howell motioned for 4 volunteer fire members to go for schooling in Tuscaloosa; hotel cost is $240.00 plus tax. Councilman Ivy second, all favored, none opposed, motion carried. Councilman Heathcoe states streets striping starts Monday. STREETS Mayor states he has spoken to someone about the problems on Quinley and Criswell and they said it would be closer to spring before someone can start correcting the problems. Cm 3.13.14 Page 4 ADDITIONAL NOTES Mayor states he has met with the Mediacom people and trying to get service to areas that do not Councilman Heathcoe made a motion for 3 council members to attend school in Mobile on 5/5 Mayor states that he didn't think that all 3 needed to go, it could put the city in a bind, and Councilman Ivy asked what the purpose oft the schooling was. Councilman Heathcoe stated that all the council needed to go and get updates on laws and procedures and also find out what help is out there for the city as well. Councilwoman Greene stated that she had already registered and paid her own tuition, Councilwoman Moss stated that the city should pay for schooling and that Councilwoman Greene should be reimbursed, but if not there were going to register and go anyway. Kenny Walker stated that it is important to the city to be educated and the Mayor has not sent any council to school in over 10 years, yet some employees go several times a year and some only once. He stated that the council has just as much right to attend school and they have it. A citizen states that Sailor Rd and Ellison Rd do not have it. and 5/6.
