Pledge of Allegiance Upon the call ofr roll, the following were found to be present Councilwoman Greene Councilman Martin Councilman Walker Councilwoman Moss Councilman Hadaway Mayor Criswell City Attorney - Danny Mims Interim City Clerk- Laura L. Rawlins Councilwoman Moss made a motion to accept the minutes of11/08/181 based on the corrections. Councilman Martin stated on) Page 2, Roll Call: for Resolution 2018-021, Councilman Martin states that his vote was NO. Councilwoman Greene seconded, all favored, none opposed, motion carried. CITIZENS ADDRESSING THE COUNCIL Dru Ryals states that a year ago, she asked if every employee working for the City of Creola was hired through the Personnel Board. Dru Ryals states Mayor Criswell answered Yes and now she has found out this is not true. Mayor Criswell states not everyone who works for the city is under the Personnel Board. There are some contract workers that do not fit under the Personnel Board. Mayor Criswell states the city can hire those people. Mayor Criswell gave the example with the Cm11.29.18 contract workers that are working in the Public Works Department must work 1080 hours before they are qualified to work under the Personnel Board. Dru Ryals states she understands that, but your exact words were everyone that works for the city is under the Personnel Board. Mayor Criswell states with the intent that everyone will be placed under the Personnel Board. Dru Ryals states a year ago that was your intent, but you haven'tdone that yet. Mayor Criswell states that the city is working with the Personnel Board on a weekly basis to do that. Dru Ryals asked how long you think that will be. Mayor Criswell states he cannot say because the Personnel Board dictates what! happens with the City ofCreola. Mayor Criswell states the city still owes thel Personnel Board $54,000.001 that was unpaid from 2006-2013, sO we are under the watch system with the Personnel Board. Thel Personnel Board has a claim/judgement against the city for $558.00 per month, Mayor Criswell states he had that removed and the city is working towards resolving the $54,000.00 at this point. Mayor Criswell states that the city is under the Personnel Boards scrutiny, Dru Ryals asked Mayor Criswell why he didn't say that a year ago instead of saying that everyone working for the City of Creola is under the Personnel Board. Dru Ryals asked Mayor Criswell did he mis- speak, or you. just didn'ttell the truth. Mayor Criswell states to Dru Ryals that was a year ago and ouri intent Dru, you know this very well because you (Dru Ryals) worked fort the City of Creola and was not under the Personnel Board. Dru Ryals states that is true, Mayor Criswell states that you (Dru Ryals) took the job and you worked for the city and that was okay, Dru Ryals states that it's okay now, but she wished that the truth had been told a year ago instead oftelling a tale. Mayor Criswell states the city has never relented from the point of putting everyone under the Personnel Board. Dru Ryals states if she is clear maybe you mis-spoke, Mayor Criswell states that could be possible, but he is not looking at the minutes from a year ago. Dru Ryals states it was not in the minutes, she can tell him that right now it's not in the minutes. Mayor Criswell states ifit's not in thei minutes then hej probably didn'tsay it then because it should'vel been recorded, Dru Ryals states the Mayor said it, because she has made the claim before and there are other people in here that heard it. Dru Ryals asked. Joan Stringfellow ifs she heard it and. Joan Stringfellow states yes. Mayor Criswell states to Dru Ryals that ifit's not in the minutes maybe you (Dru Ryals) mis-spoke and maybe you didn't hear the answer correct. Dru Ryals was under the assumption that the minutes are edited. Mayor Criswell states that minutes are not edited. Mayor Criswell states that hei is going to make this statement to everyone in this room, our intent has been for two years and the reason for this as we have met with the Personnel Board and there are certain guidelines the city is following to put everyone in Creolai undert thel Personnel Board that we can. Dru Ryals asked) Mayor Criswell how long that will take. Mayor Criswell states that hej just told Dru Ryals that he does not know how long that will take and that it might take two years. Mayor Criswell states they worked a whole year to match the payroll that was being sent down to the Personnel Board by the city. It took the city a whole year to get it passed and to match the payroll. Mayor Criswell states they gave everyone working for the city a 15% raise and the only person that got aj penny out ofity was Linda Hoiles, who got her salary raised one penny, that was how: far offthej personnel records were. Mayor Criswell states that hel had people who were employed here, who had been employed for seven & al half years that was making minimum wage and had never been evaluated, had six evaluations in their folders, sO don'ttell me what you're talking about when you are talking about the Personnel Board. Mayor Criswell states he has been to the Personnel Board numerous times and fought several battles with them and it was because of what was done before we got here. Joan Stringfellow states the minutes never have what the citizens say. Joan Stringfellow states if the Mayor will go back over your time in office. Joan Stringfellow states the time before Mayor Criswell was in office, every citizen and what they said was in the minutes, but in your term, itl has never been done. Joan Stringfellow states therefore Mayor Criswell and Dru Ryals are. having this conflict now because they are never there, what we say doesn't matter. Joan Stringfellow told Mayor Criswell to put it all in the minutes sO there is no conflict, Mayor Criswell states that each time the minutes are approved the council must approve them and ifthere is anything different it's 2 Cm 11.29.18 there and the minutes are available. Joan Stringfellow states that is why Dru Ryals asked if the minutes were edited, they don'thave the citizens that speak. Mayor Criswell states the only editing that is done is the corrections that comes out int this council meeting, that are approved or corrected just like Councilman Martin did. Joan Stringfellow asked why we aren't there. Mayor Criswell states he isn'ts sure that you'r re not there, Joan Stringfellow states she is not there because she has Joan Stringfellow asked Mayor Criswell about the cars that we got rid of after you came in. What money did we get out of those cars? Mayor Criswell states we received $13,300.00. Joan Stringfellow: asked how many vehicles we crushed. Mayor Criswell states that we didn'tcrush. any. Joan Stringfellow states that we aren't talking about the same time. Joan Stringfellow states that right after Mayor Criswell came into office, he crushed a red truck. Mayor Criswell states we sold the red truck and parts removed from it that we received from the county.Joan Stringfellow asked again which ones you crushed, Mayor Criswell answered that he doesn't know of any that we crushed. Joan Stringfellow states the Mayor should go back through his minutes. Joan Stringfellow states this town does not have a good name, we are ashamed, the citizens are ashamed of this town right now and have been for quite a while. Several citizens in the meeting stated that Ms. Stringfellow was speaking forl herselfand wasn'tspeaking fort them. Mayor Criswell states that you have a lot of people stating that you don'ts speak for them. Joan Stringfellow states these people are the only ones that come when you're here, sO she is talking about the outsiders, the ones on the outside. Mayor Criswell asked Joan Stringfellow to define what she meant about the outsiders. Joan Stringfellow states the other people outside, they don't want to come to the council meeting. Mayor Criswell states that everyone should come to all the meetings. Joan Stringfellow: asked thel Mayor nott to speak about the past administration. Mayor Criswell states Ms. Stringfellow just compared this to the past administration. Joan Stringfellow states she did and when Don Nelson came in and he had a $100,000.00 debt he didn't go around telling anyone, he dealt with it. Mark Howell states that you're elected to do a job and that he was a part of the past councils. Mark Howell states there are two people on the council that spent four years and another one that is sitting on the council that spent either four or eight years on the council with Mark Howell that has taken zero responsibility for anything that has happened in the past. Mark Howell states when Don Nelson took office in 2004 there was taxes in $107,000.00 that had not been paid. Itwas never made public and he never talked about Cleo Phillips or anyone on the council. Mark Howell states his point was they never tried to attack aj person' 's good name or reputation. Mark Howell states there has been enough bad things said about previous council, about bills and the person over thel bills for fours years is thes same person that is overt thel bills rightnow. Councilwoman Greene states to Mark Howell the previous city clerk prepared every financial statement and Councilwoman Greene has every copy. A citizen sitting in the meeting asked Mark Howell ifl he didn'tthink that the citizens have ai right to know what is going on. Mark Howell: states the citizens have the rightt to know butt there wasi nothing going oni int this cityt that wasn'tpublic. Mayor Criswell suggest to Mark Howell to read Resolution 250 that was resended. Mayor Criswell states Mark Howell (previous councilman) Councilman Avis Walker and several other people signed it, given Don Nelson and Kim Green exclusive right to handle all finances, loans for the city. Mark Howell states he won't say that didn't happen. Mayor Criswell states what that means that anybody else was locked out oft that. Mark Howell states in his twelve years on council there was never any bills that weren't brought before the council. Mayor Criswell states this council has not borrowed one cent to operate on in the last two years. Mark Howell states the Mayor gutted out the police department and personnel to make that happen. Mayor Criswell states there is still money in the bank to pay that personnel and we didn'tmake them go, they left.. Joan Stringfellow wants tol know how many employees have left the City of Creola since Mayor Criswell came through the door. Mayor Criswell states no to Joan Stringfellow's question and the Mayor states again if those every one ofy your minutes and there not there. 3 Cm11.29.18 employees were not under the Personnel Board and if those employees want to leave the City of Joan Stringfellow asked if John White is contract labor. Mayor Criswell states John White is contract labor and that he works twenty hours a week. John White asked the Mayor since his name was brought up could he address some things. John White states he is a pastor in this community, his responsibility with the City of Creola is to love, pastor and to shepherd people. John White's interest in the government oft this city is to help make it better and to bring unique things to the table because of his experience. John White states he has twenty-two years in the United States Army, during that time hev was inc charge ofOPS, United States medic in Fort] Knox Kentucky where he was MP school trained in physical security, anti-terrorism and operation security level 2. John White states his responsibility for the city as consultant is to provide information, knowledge and things on leadership and policy. Dru Ryals asked John White ifthat's what he does as Lieutenant. John Whites states he is al Reserve Officer and over the Reserves as the Reserve Lieutenant. John White states that was announced wrong on the news and they made sure the news station knew that, they knew that ahead oftime before they reported it and. John White corrected it with the news afterwards.. John White states at noi time did he ever present himselfas an APOSTCertified Officer. John White would like to make that clear to the citizens oft this city, we have a good department, we've had some issues that have come up, but we are working on making it a great department. William Bruce Winfield states he lives on Bobo Shilly Circle and he was told there was some changes coming to the covenant in his neighborhood and he would like to ask questions and to see whati rulings havel been made. Mayor Criswell states therel have been no rulings made by the council and we do not interact with covenant. Mayor Criswell states that ist typically on your deeds and we, did have someone who attempted to move a trailer in the area, they went before the Zonng Development Board and informed the Zon'Development Board there was no covenant there. Thel stipulation was they wanted to put the trailer there to house a family member in a hardship case. The board granted it based on the fact that ift there was a covenant it would not be allowed, it had to pass the inspection from the Building Inspector, had to have adequate sewer and power connections. Mayor Criswell states there was covenants in that area which disallowed it, found some infractions on the plumbing, sewer part and it was turned down. Mayor Criswell states the trailer is not allowed in that area, Mayor Criswell states his feelings on trailers, he is not against trailers, he feels like there is a place for them and the place_for them is in trailer parks, not in the housing residential areas. Mayor Criswell states the Zone/Dévelopment Board has no authority in changing the covenants and it was never brought up. Mark Howell states that is something that should be addressed, they always posted it and had anyone in our neighborhood knew about this we could have shown our covenant. Mark Howell states the covenants have been in place since 1960 when Ms. Guthrie (Mr. Howell isn'tsure ofh her married name) bought the property and they were implemented then and they have not changed. Mark Howell states when hel built his home, he had to comply with them and the building codes and he's been in his home for forty years. Mark Howell states there are two houses that are being built within a rock throw oft this situation and the ones that are being affected by this situation knows nothing about it and then it was accepted. Mayor Criswell states that it was not accepted, it was accepted based on some restrictions. Mark Howell states he appreciates that, and he can accept that, but his point is that anytime something like this comes up those that are directly affected by it should be notified. It created sO much controversy within the neighborhood. Mayor Criswell and Councilwoman Greene stated the gentleman showed up tot the meeting unannounced, requesting that and we put those stipulations in and told him that the possibilities ofal hardship case because it had been done before. Mark Howell states that he doesn't believe this haskeferBeen done before, putting a manufactured home to be moved in al Planned Subdivision. Mark_Howell states we' ve granted variances by fire or some type Creola then we follow the procedure and they dismiss themselves and leave. John White states he will always hold integrity. ToE 4 Cm 11.29.18 ofc catastrophe. Mayor Criswell states Mr. and Mrs. Mathers did for his mother. Mark Howell states he did, and they had to move it. Councilwoman Greene states that was one oft the stipulations, that ity would have to be moved. Mayor Criswell states that when this was done, the guy came in, presented it and we put the stipulations on it, but we never got to that point of notifying anybody. Mark Howell asked the Mayor if it would have gotten to that point would we have gotten a notification. Mayor Criswell states the approval had some restrictions, the intent was to put out some type ofi information to the citizens for feedback and then we found out there was covenants William Bruce Winfield states if there had been any kind of notification then they could have brought the covenants forward sO there wouldn't be any added issues amongst the neighborhood now and he welcomes the Owens family, they have great kids and he doesn't want any problems. Its should have been posted, sO it wouldn't have got to this point and there could have been a Kathy Camilleri states she spoke with Councilwoman Greene on the telephone and when it was approved, she did not have to notify the citizens when it was al hardship case and that is why Kathy went ballistic because you should notify the ones whose personal property would be affected. Councilwoman Greene states that when she was secretary on the past board or past council, we did not have to notify anybody. Kathy Camilleri states that she did notify the citizens when she was on al board here, we sent out letters, whetheri it was common courtesy, we didi it. Councilwoman Greene states there were a lot ofs stipulations and believes this was blown way out of proportion. Greg Owens states his initial plan was to build a structure and the other option that he presented was to move in a cottage that was not a trailer. Don Moss, Building Inspector, told Mr. Owens that would not work, and they researched further and looked into other buildings that were livable buildings. Mr. Owens states he never intended or wanted to: move a trailer onto his property. All Mr. Owens wanted to do was create a situation where his mother could move to Creola because she is alone where she is now. Mr. Owens states with his work situation, child care situation it makes things harder. Mr. Owens states that he never intended on moving a trailer in the subdivision nor did he want his subdivision turning into a trailer park, he would like to work with his community on this matter. Mr. Owens states he was willing to build onto his home to make this happen. Mr. Owens had aj plumber come to inspect his plumbing and it turns out that the previous owners ofthe house installed a bar sink when they closed in the garage and made the garage into a game room. The bar sink has a drain and goes out into the creek. Mr. Owens states they have not used the sink and do not plan on using the sink, he doesn't like the fact the drain comes out into the creek. Mr. Owens is against pollution in any way and they are going to get rid ofthat drain. Mr. Owens states the plumber made sure that all the sewer, all the drain water goes into the septic tank. Mr. Owens states nothing but this one: sink drains in and iti is fed of the spigot line. Mr. Owens states he isl here to answer all questions from the community, he believes in complete transparency. Mr. Owens states all he's st trying to doi ist to motherl his mother to the community andt to be able to look after her. Mr. Owens does not want tor move: at trailer intot the neighborhood, he doesn'twant his own property value, much less the beautiful homes that they' 're building to lose property value. Mr. Owens states they have not moved forward and have not purchased any buildings. Mr. Owens states his neighbors will notice that he is clearing the side ofh his property off, he did that to clear the property because it was overgrown with vines, broken glass and bottles from previous owners and it is very dangerous for his small children and dogs. Mr. Owens states there is no need to worry, they have Charlene Harris, citizen, states she has al home and lives on Theophilus Road that has been for sale foraf few years. Ms. Harris states the couple that was renting her home on Theophilus Road had to and they found out that he did not have sewer properly. discussion. not tried to move: forward at all. 5 Cm 11.29.18 file bankruptcy therefore Mrs. Harris is giving her up her Cinderella castle in Saraland and is moving back into her four bedroom, two in-half baths on Theophilus Road because she can'tsell her home on Theophilus Road. Ms. Harris states her mother is al hardship case and her mother has had to move in with her because she is a hardship case. Ms. Harris states to Greg Owens that he Charlene Harris asked the council what type ofinformation was passed around to the community Mark Howell states it clearly states on the covenants that there can be no double dwellings in the neighborhood. It speaks specifically to square footage, the base floors for a multi-family would have to be ai minimum square footage, but under the covenants you can'tadd anything. Greg Owens states he read the original covenants from 1961 that were in the real property books from the county and there was a couple of other listings. Mr. Owens states that Ms. Guthrie stated that covenants would expire in ten years ifr not renewed and anything after that Mr. Owens could Mark Howell and Kathy Camilleri states, they don't see anything on their covenants about Statue Kathy Camilleri asked the council how the information was passed along to the other members of their subdivision about the request. Mayor Criswell states they never got to that point, once the inspection was made by the inspector then we would have determined there was covenants and then might want to consider moving his mother in with him. that gave their subdivision the information because. she didn'tgeti it. not find it. ofLimitations. this issue would not have been allowed. RESOLUTIONS, ORDINANCES AND OTHER BUSINESS Mayor Criswell states the Carney Road Resolution is on the agenda. Danny Mims, city attorney, Mayor Criswell states the December 13, 2018 Workshop will be at 4:30pm, the Council meeting Councilwoman Greene would like to make a motion to have the meeting at 5:00pm on December 13, 2018. Councilman Hadaway seconded, all favored, none opposed, motion carried. Mayor Criswell states we, are improving the court, we run as high 578 cases in court. Mayor Criswell states we. have two people working the court, Christie and Linda working full time. The court is held at the SAIL Center (Senior Center) and Christie sets up with her computer, takes the information from the court, transferred over to the main frame computer here. Mayor Criswell states they were. having problems with the data going from the SAIL Center back tot the main frame computer. We have looked at a Mediacom solution with fiberoptic which was too costly, around $5,000.00. Mayor Criswell states wel have aj proposal from Data Byte Corporation (Jason Peacock) and CTS (Don Perryman). Mayor Criswell states we can do it wirelessly with two antennas for Mayor Criswell states this is something they would like to do and to improve our court and those funds will come out oft the court fund. Mayor Criswell states we have a Mediacom contract that we are going to turn over to the City Attorney, Danny Mims for review and to make sure that we are clear on everything that we are doing for the police department. Mayor Criswell states this is to upgrade from Windstream that has been here for twelve years. PLANNING AND ZONING COMMITTEE Councilwoman Greene states the Planning and Zoning workshop will be December 18, 2018 at 5:00pm to continue working on revising the planning book and the regular meeting will be at 6:00pm. Councilwoman Greene states there is only one person on the agenda, Mr. John Townsend fora a home business. Councilwoman Greene states the Planning and Zoning Board will hear it and then it will be turned over and with maybe a special exception and will be turned over to Zoning Board of Adjustments. ZONING BOARD OF ADJUSIMENIS Nothing to report PARKS AND RECREATION 7 Cm 11.29.18 Major Holt states two weeks ago they finished their Fall 2018 season with 318 players from ages of 3yrs old up to 13yrs old with 27 different teams. The gender breakout was 104 girls and 213 boys. Major Holt states these kids came from 11 different communities surrounding here, all the way from Vinegar Bend to right here in Creola. The kids were also from twenty-four different schools that support our North Mobile area. Major Holt states they are taking a break right now to do some field maintenance. The Spring registration will be the end of. January and once daylight Major Holt states that he is working on several grants sO that we can go ahead and get lighting on the fields. Cara Stallman, grant writer, states that last meeting she came to talk to the council about the opportunity we have and to talk about a grand plan for lighting. Cara Stallman states Major Holt has some good ideas, he would like to reach out to some partners to figure out a good Phase I. Cara Stallman suggest, if possible to have what we had with the bus grant, aj public meeting the night of the December 13th council meeting, advertise it on the council meeting the night of December 13th council meeting, have it and get people to sign it at the dinner across the street and then you would adopt a Resolution. Cara Stallman states by that time you would have al budget and grant money to go: forward with on the project, ifthat is something the council wants to do. Councilwoman Moss asked Major Holt how long it would take to get the other companies as partners. Major Holt states it would take a couple of weeks. Major Holt states we want to meet the deadline of this grant that is coming up, the other grants that Major Holt is looking at is a February time frame for submission and by that time Major Holt would be able to see what Alabama Power could provide toi the park. Major Holt states he would like to lay the structure out, ifA Alabama Power could give the poles and cables then thel lights come much cheaper. Major Holt states that they have looked at what the needs are, and they believe it would be four phases and that will be addressed one phase ata at time. Major Holt states thej pressing need is for the older kids because they only have one: field with six teams. Major Holt states they must end their season because of savings daylight. Danny Mims, city attorney, states that we should know and see the terms of the grant before we hold a public hearing. Councilwoman Moss asked Major Holt if he knows an amount oft the cost for the lights. Major Holt states this is if we have the lighting company to do everything it would between $170,000.00 to $180,000.00. Major Holt states if we can get in-kind money than the amount would ber reduced. UTILITIES AND SENIOR CITIZENS Councilwoman Moss states the Senior Citizen Christmas party will be held on December 14, 2018. Councilwoman Moss states that Lisa's Cleaning Service will be coming on Tuesday, December 4, 2018 to clean the floors at the SAIL Center (Senior Center), she cleans the floors twice a year and the amount for her services will be $300.00. BUILDING INSPECTOR Mayor Criswell states we are working with the manufactured home owners on Bentley Road and 407 Dead Lake Road. The manufactured homes will be doublewides and there are 250 manufactured homes going in the two trailer parks and all the old trailers are being removed. The manufactured homes willl be a gated community, paved streets, sidewalks, carports on each trailer, will be on sewer and potable water. The manufactured homes will be about $850.00 per month and in 10 years the person will own the manufactured home but lease the property. Mayor Criswell states if you came to the last Zoning Board meeting the owners were here and presented this information to inform the citizens what they were doing. Iti is already zoned for R3 as a trailer park, the zoning was already there, and we didn't tamper with it and we needed to know what the developers were doing. Mayor Criswell was told by the owners that within 45 days, thirty-one new homes will appear on Bentley Road. Mayor Criswell states on Ellison Avenue there were eleven trailers, the guy from the State of Alabama turned down five of those trailers, they are being disassembled, put into dumpsters and moved out.
