MAGISTRATES Linda Hoiles Christie Bryant Minutes oft the City of Creola Council Meeting Thursday, January 14, 2021 Creola SAIL Center Meeting 6:00 P.M. The Council of the City of Creola, Alabama, met in the Creola SAIL Center at 5:30 p.m. A workshop was held before the Council Meeting, from 5:30-6:00pm. Present at the meeting was Kendal Hadaway, Cody Chambless, Mayor Nelson, Wendy Lynch, Harold Parmer, Mark Workshop Items: The financials, FY 2021Budget, Line of Credit with United Bank, and the Hurricane Zeta debris cleanup were discussed. The meeting was adjourned at 6:00 p.m. Howell, and Marcy Brown, Administrative Assistant. The meeting was called to order by Mayor Nelson at 6:00 p.m. We were led in prayer by John Roll call was taken by Marcy Brown. Present at the meeting was Kendal Hadaway, Cody Chambless, Mayor Nelson, Wendy Lynch, Harold Parmer, Mark Howell, and Marcy Brown, White. The Pledge of Allegiance was led by Mayor Nelson. Administrative Assistant. Danny Mims, City Attorney, was also present. Item #5 -Approval of the Minutes = The minutes of the December 10 and December 16, 2020, meeting was reviewed. A motion was made by Mr. Howell to accept the minutes of December 10, 2020 with the correction ofa date on Item 8 Section C. The motion was seconded by Mr. Parmer. All in favor and the motion was carried. The minutes of the December 16, 2020 meeting were reviewed. A motion was made by Mr. Chambless to accept the minutes of December 16, 2020 as written. The motion was seconded by Mr. Hadaway. All in favor and the motion was carried. Item #6- Financials- The financials were discussed during the workshop, held before the council meeting. If any would like to see the reports, they are welcome to stop by the city hall. Mr. Parmer made a motion to accept the financials. Mr. Chambless seconded the motion. All in favor and the motion was carried. Item #7- Bill List- Mr. Parmer made a motion to accept the bill list. Mr. Chambless seconded the motion. All in favor and the motion was carried. Departmental Reports- Police Dept.- Nothing newi to report. Fire Dept. Nothing new to report but would like to put a lockbox on the climate control switch for the gas/Spire and kept at a constant temperature. Park Dept. - Would like to see ai timer put on the park lights. Mr. Chambless made a motion to put a lockbox on the control switches for both the Fire Department and the Public Works building. Mr. Howell seconded the motion. All in favor and Mr. Howell made a motion to investigate the cost of a timer for the park lights. Mr. Parmer SAIL Center Dept - Mrs. Lynch stated that she had a contact at Sherwin Williams Paint that was going to donate paint for the SAIL Center. She also discussed some upgrades regarding the the motion was carried. seconded the motion. All in favor and the motion was carried. curtains, and awnings. Item #8-New Business- a. Human Trafficking Proclamation- Mayor Nelson read the proclamation declaring the month ofJanuary as Human Trafficking Awareness month. b. Tires - Mr. Steve Bell donated some tires to the Poliçe Dept. c.2 20/21 FY Budget - Discussion was made on the adoption of the 20/21 FY budget. Figures were taken from the prior year and raised by approximately three (3) percent. Mr. Howell made a motion to approve the 20/21 FY budget. Mr. Parmer seconded the motion. All in favor and the d. Mrs. Lynch to remove Brandy Davis from all bank accounts seconded the motion. All in favor and the motion carried. was Mr. Parmer made a motion to add Mr. Chambless Bank and to have viewing access to those Mr. Howell made a motion to accept the standing. Item #9-Old Business- Item #11- Mayor Comments- Citizens to Address Council- Mr. Chambers Policers that come to his house looking for his addressed the council regarding the Satsuma While the matter had been handled, Mr. Mims son over a matter that was a misunderstanding. said he would look into it. Executive Session - Attorney Danny Mims read the Executive sessions stating that following exert from Alabama Code 36-25A-7 purposes: they may be held by a governmental body only for regarding the following (1) To discuss the general reputation and competence, or mental health discuss the job performance of ofindividuals, certain character, physical condition, professional or, subject to the limitations set out herein, to elsewhere in this section, discussions oft public the employees. However, except as provided specific public employees may not be discussed job performance of specific public officials or appointed public official, an appointed member in executive session ift the person is an elected public employee who is one oftl the classification ofas state or local board or commission, ora or ofeconomic interests with the Alabama Ethics of! public employees required to file a statement Except as provided elsewhere ini this section, the Commission pursuant to Section 36-25-14. specific public officials or specific public salary, compensation, and job benefits of employees may not be discussed in executive session. (2) When expressly allowed by federal law or state law, to consider the discipline or dismissal of, or tol hear formal written complaints or charges brought against a public employee, a student at aj public school or college, or an individual, corporation, partnership, or other legal entity (3) To discuss with their attorney the legal ramifications of and legal options for pending litigation, controversies not yet being litigated but imminently likely to be litigated or imminently likely to be litigated ifthe governmental body pursues aj proposed course of action, or to meet or confer with ai mediator or arbitrator with respect to any litigation or decision concerning matters within the jurisdiction oft the governmental body involving another party, group, or body. Prior to voting to convene an executive session under this exception the governmental body shall receive a written opinion or oral declaration reflected in the minutes from an attorney licensed toj practice law in Alabama that this exception is applicable to the planned discussion. Such declaration shall not otherwise constitute a waiver of the attorney- client privilege. Notwithstanding the foregoing, ifa any deliberation begins among the members ofthe governmental body regarding what action to take relating toj pending or threatened litigation based upon the advice of counsel, the executive session shall be concluded and the deliberation shall be conducted in the open portion of the meeting or the deliberation shall cease. (4) To discuss security plans, procedures, assessments, measures, or systems, or the security or safety of persons, structures, facilities, or other infrastructures, including, without limitation, information concerning critical infrastructure, as defined by federal law, and critical energy infrastructure information, as defined by federal law, the public disclosures ofwhich could reasonably be expected to be detrimental to public safety or welfare. Provided, however, that when the discussion involves critical infrastructure or critical energy infrastructure information, the owners and operators of such infrastructure shall be given notice and an opportunity to attend (5) To discuss information that would disclose the identity of an undercover law enforcement agent ori informer or to discuss the criminal investigation of a person who is not aj public official in which allegations or charges of specific criminal misconduct have been made or to discuss whether or not to file a criminal complaint. Provided, however, that prior to such discussions a law enforcement officer with authority to make. an arrest or a district or assistant district attorney or the Attorney General or assistant attorney general shall advise the governmental body in writing or by oral declaration entered into the minutes that the discussions would imperil effective law enforcement if disclosed outside of an executive session. Mr. Howell made ai motion to leave the regular session and enter Executive session for purpose of discussing pending litigation against the city and a former employee situation and then to adjourn after the executive session is over. Mr. Parmer seconded the motion. All in favor and subject to the regulation of the governmental body. the session. the motion was carried.
