The special called council meeting was called to order by Mayor Don Nelson at 5:00 p.m. We were led inj prayer by Mayor Nelson. The Pledge of Allegiance was led by Mayor Nelson. Roll call was taken by Marcy Brown. Present at the meeting was Mayor Nelson, Wendy Lynch, Harold Parmer. Marcy Brown, City Clerk and City Attorney Daniel Mims. Mark Howell was absent. Item #1 - New Business a. Approval of Garbage Proposal Bid - Mayor Nelson wanted to let the record show that other than tonight, and the opening of the bids, he had no contact with any oft the bidders or their representatives regarding the proposed garbage contract. Mayor stated that he had previously spoken to the owner of EcoSouth but it. was about a different matter. Mayor confirmed with the city clerk that she also had no contact with the garbage companies other than normal city business regarding the proposals. City Attorney Danny Mims stated that we had four (4) companies that bid on the garbage and trash contract. Waste Pro, EcoSouth Services, Waste Away Group (Waste Management), and McDuffie Sanitation. Of the four bids, Waste Away Group (Waste Management) and McDuffie EcoSouth Services came in at $16.65 per can per month which is al little bit lower than the Waste Pro bid which was $20.75 per can, which also included trash pickup for both companies. However, after reviewing the matter, the recommendation to the mayor and city council by the City Attorney is to award the contract to Waste Pro of Alabama, Inc., as the lowest Responsible bidder. The recommendation is made based largely on the fact that the bid specifications Sanitation were higher which left us with EcoSouth Services and Waste Pro. required a variety of things to be submitted along with the sealed bids, including evidence that the Contractor is in good standing under the laws of the State of Alabama, and evidence, in form and substançe satisfactory to the City, that the Contractor firm is in good standing with all applicable regulatory agencies, including but not limited to the Alabama Department of Environmental Management (ADEM) and the Alabama Department of Transportation. Mr. Mims reported that there is a permit that is required to be issued by the health department for collection and transportation of Solid Waste (Garbage). Waste Pro provided a permit from the Mobile County Health Department along with its' bid. However, Eco South Services did not provide such a permit. Mr. Mims further stated that he had contacted the appropriate representative at the Mobile County Health Department and had been advised that Eco South had not been issued such aj permit for collection and transportation ofsolid waste. Therefore, since no permit was provided indicating that Eco South was properly permitted to perform the work at the time the bid was submitted, it was recommended that the Mayor and Council deem the bid of Waste Pro of Alabama, Inc., as the lowest responsible bid, subject to negotiation of the contract, and the City attorney be authorized to forward a notice to proceed letter to Waste Pro of Attorney Danny Mims wanted to let the record reflect that he was not indicating that all other bidders were unqualified, but that but Mcduffie and Waste Away were higher. Mr. Hadaway made a motion, based on the recommendation oft the city attorney, to award to contract to Waste Pro at a cost of$20.75 per month. Mr. Parmer seconded the motion. Kendal Hadaway - Yes; Cody Chambless - Yes; Wendy Lynch - Yes; Harold Parmer - Yes Alabama, Inc., again subject to the negotiation of contractual matters. ROLL CALL: Mark Howell - Absent; Mayor Nelson - Yes Alli in favor and the motion was carried. b. Approval ofTractor forl Public Works Department - After a discussion on the problem with the tractor, it can be repaired for $4,350. Mr. Parmer made a motion to approve the cost of the repair oft the tractor for $4,350 to be paid to Sun South. Mr. Hadaway seconded the motion. All in favor and the motion was carried. Mrs. Lynch made a motion to adjourn the meeting. Mr. Chambless seconded the motion. All in favor and the motion was carried.
