The Board of Zoning Adjustments oft the City of Athens, Alabama meti in special session int the City Council Chambers on January 18, 2024 at 5:301 PM, after a short work session. RollCall. Board Members Present: Greg Greene, Jeff Bass, Al Wassum, Jim Emest, and John Fowler. Erin Tidwell, City Planner and Paigel Parker, Planner were also in attendance. Minutes. Al Wassum offered the following resolution and moved its adoption: "BEITR RESOLVED BY THE BOARD OF ZONING ADJUSTMENTS OF THE CITY OF ATHENS, ALABAMA, that the minutes for thel November 16, 2023 meeting be approved." John Fowler seconded the motion, and the vote was unanimous of the voting members present. Old Business: None. Items Withdrawn from This Month's Agenda: None. New Business: Public Hearing. Request ofRoss White regarding a variance to Zoning Ordinance Table 5-51 to reduce the required rear setback, located at 20097 Executive Drive (Parcel #: 44.1602040001-17400 and zoned R-1-1 -) Low Density Single Family Residential District. Ms. Tidwell described the applicant's request, and explained that Staff does not understand how Mr. Ross White (24628 Silent Spring Drive) explained that the final plat oft the subdivision, originally approved in 2007, does not clearly show the rears setback requirement. In addition, only the garage oft the proposed residence would encroach into the setbacks. Mr. White stated that the subdivision's architectural committee has approved the garage plan. Mr. Greene confirmed that Mr. Ernest asked Mr. White ifhel had to submit aj plan to the subdivision's architectural committee when he purchased the lot. Mr. White answered that he did, and the committee approved it. Mr. Greene asked ift the subdivision plat has been on record since 2007. Ms. Tidwell answered that the subdivision plat was approved in 2007; the zoning setbacks in this location have not Mr. Greene stated that the subdivision's architectural committee can approve things, but that approval does not supersede City requirements. Zoning Ordinance Table 6-2 and' Table 6-3 to reduce the required number of parking spaces, located directly north ofU.S. Highway 72 West and directly west of] Brownsterry Street (Parcel #: 44.100.47-4-00/.01.00) and zoned B-2- General Business District. Ms. Tidwell described the applicant's request, stating that the applicant was requesting a reduction ofs six parking spaces. Due to restrictions placed on this property by ALDOT and topographical constraints, Staffb believes the criteria for a hardship has been met. Mr. Coddington answered that the smaller building wouldn't! be utilized right away. Mr. Greene asked about the. ALDOT restrictions being imposed on this site. Mr. Coddington answered that they will have to remove the entrance onto U.S. Highway 72; traffic will come in Mr. Greene asked about needed improvements and if the site will have upgraded green space. Ms. Tidwell answered that the company will have to submit a site plan and bring the site up to have. and other, similar products. and out through the entrance on Brownsferry Street. current Zoning Ordinance standards.
