BOARD OF TRUSTEES VILLAGE BOARD MEETING Village Hall Board Room 118 W. Cook. Avenue Libertyville, IL 60048 Tuesday, June 11, 2024 at 8:00 PM MINUTES 1. Roll Call Mayor. Johnson called to order a meeting of the Board of Trustees at 8:00 p.m. Those present were Mayor Donna Johnson, Village Trustees Scott Adams, Pete Garrity, Matthew Hickey, Casey Rooney, and Jim Connell. Trustee Matt Krummick was absent. Also in attendance were Village Attorney Hart Passman and Clerk Margaret Clark. Recognition of Father Trout of St. Joseph's Catholic Church Trout was presented with a community service award. Mayor Johnson recognized Father Trout, pastor of St. Joseph's Church. Fr. Trout is moving on to a new assignment and Mayor Johnson thanked him for his service to our community. Fr. Fr. Trout thanked the Village for the award and for the collaborative relationship between the Village and the St. Joseph parish. - Proclamation: Pride Month Mayor Johnson read the proclamation recognizing June as Pride Month. Presentation of Certificate of Achievement for Financial Reporting/Triple Crown The Village of Libertyville is now one of 32 governmental agencies in Illinois to receive the Government Finance Officers Association of the United States and Canada (GFOA) Triple Crown Award. This award recognizes government entities that have received the GFOA's awards for budget presentation and financial reporting. According to GFOA, the Triple Crown designation represents a significant achievement of all three separate award programs that each recognize governments for producing reports that communicate their financial stories in a transparent manner that meets applicable standards. This recognition highlights the Village's commitment to transparency and excellence in budgeting and financial reporting. Mayor Johnson recognized Director of Finance Denise Joseph and Village Administrator Kelly Amidei for their excellent work in helping the Village achieve this status. 2. Cierra Hall, resident of Libertyville, highlighted race inequality and homelessness in Libertyville. She equated the death and destruction happening in Gaza to how those numbers would convert to Libertyville numbers - it would be 62 dead children in Libertyville. She said a difference can be made by calling for a ceasefire in Gaza. She wants to make her voice heard minutes here at the local level. VILLAGE OF LIBERTYVILLE Board of Trustees Village Board Meeting Minutes June 11, 2024 Mansoor Quueshi of 898 Bluebird Street is here to ask for a ceasefire to be put ont the agenda. There seems to be some progress being made in a call for a ceasefire and the reason for that is because of small steps such as a local government calling for a ceasefire, he said. Beenish Tanvir of Hoffman Estates asked some questions of the group if quotes were from a Zionist or nazi. She said she hopes all are watching the news and will stand on the right side of Farzeen Hanuarani of Palatine came because some people accused her and her group as un- American. She respects people's right to protest and discussed some contradictions. Jihad of 665 Diamond Pointe Drive said he works and plays in Libertyville. He is from a village in Palestine and discussed how his family was forced to leave due to settlements. He asked for a resolution calling for a ceasefire. This ceasefire is for us - SO that the Palestinians here know their lives have meaning, he said; and to show that this town believes in peace. He talked about Imam Azfar said he wants all hostages to be released: Israeli and Palestinian. As a human being we should want all oft the hostages to be freed, he said. Gaza has the largest population of children with amputees in the world and the. American government is still supporting this. The US ini the singular force stopping the UN from stopping this. REPORT OF THE HISTORIC PRESERVATION COMMISSION, (HPC 23-08), Certificate of Appropriateness for New Building Facades, Landscaping, and Lighting, Vee Enterprise, Authorized Agent for Chicago Trust Company, N.A. Trust #SBL-4983 - 708 N. Milwaukee Avenue Mayor Johnson asked if the owner of this property was present. Murray Lewison, attorney for the owners of the property, was present tonight. He did not have a Mayor Johnson said the board requested that a representative that has the binding contractual authority to speak on behalf of the ownership. Mr. Lewison said his word is his proof. Mayor Johnson asked Mr. Lewison if he was representing this evening that he had the authority to speak on their behalf regarding this project. Mr. Lewison said that is correct. Mayor Johnson read the following summary into the record: formal engagement letter. At the conclusion of the Village Board discussion on April 9, 2024, the proposal was continued to allow the petitioner the opportunity to have a representative of the owner present at the meeting. John Snow of 809 Liberty Bell Lane came to address Agenda Items 4 &5. He said he wants to make sure the Trustees recognize that the look of the buildings is incompatible with our historic district and the architect has not made any changes to be compatible with the Village's historical district. This needs to be part of the discussion. This would help build support for this project. Mayor Johnson asked for Board comment: Trustee Adams said he is very disappointed. At the ARC meeting in March, he did not have a big problem with how the buildings looked, but in two months' time nothing has been done. There has been nothing from the ownership. He thinks there is a lack of vision. There have been many comments about neighboring buildings and the ownership has done nothing to address these concerns, he said. He suggested moving the building to the north and make a safer pedestrian crossing. All this was suggested, and nothing has been changed, Trustee Adams said. Trustee Garrity said there is a lack of trust between the Board and the owner. The owner has not been willing to come forward and the Village is not able to have a dialog. Since the ownership has been in place there has been a lack of willingness to work with neighbors and the fabric of the Trustee Garrity continued: the bottom line is that the Village was hopeful that tonight the person coming would be able to speak to all of the issues with this project; for instance, construction complications, the village wanted to have a conversion of how we can work together. This is a key community. The property looks horrible, he said. VILLAGE OF LIBERTYVILLE Board of Trustees Village Board Meeting Minutes June 11, 2024 part of the entrance to our downtown and the residents and the Board are very frustrated with this. The Village is trying to move this forward. The architect cannot answer all questions that the Village has. The Village does not feel like this can be settled at a high level. The Village wants to move forward in a collaborative way, and the owner has taken an adversarial approach, he said. Mr. Lewison responded that these points are well taken. He said that the owner is willing to work with Green Room and Singh's Kitchen: they will be given fobs and will be given access to trash collection. Trustee Hickey asked if access is in perpetuity. Mr. Lewison could not answer. Trustee Garrity said he was glad some areas are showing improvement but no really good Trustee Hickey asked Mr. Lewison what the client's instructions were for this evening. Mr. Lewison said they wanted to assure the Village that they are working with adjacent owners. Trustee Hickey asked Mr. Lewison how long he has been engaged. Mr. Lewison replied one month, month and a half. Trustee Hickey asked if the owners told him to reach out to staff as the Trustee Hickey said he has never seen anyone ever not know how to move a project forward like this. This has nothing to do with the Village, this is squarely on the owners, he said. They need to Trustee Hickey suggested that Mr. Lewison should look at the meeting from April and meet with staff to address those issues. The owners need to think those issues through and then come back. Trustee Hickey said he is frustrated that the Board gave the architect constructive criticism that the owners failed to respond toi it. He said many efforts have been made by the Village to Mayor Johnson said that the architect has presented in good faith, but this is like you are building the house but only showing us one room. There are sO many pieces missing, she said. The Board has been very patient and now wants answers to those questions. They want to have answers Mayor Johnson said the Board is showing frustration as staff cannot go any further without the answers that have been asked for over and over again. This is a collaboration. This is our community, and we expect a demonstration from the owner that they are committed. She wants to see a community positive approach with the neighboring business owners. Trustee Rooney said she agrees with previous comments. She reviewed that the ask tonight is for ac certification of appropriateness. Shed thanked the HPC for their comments on this and said their reasoning for denying it was that the architectural compatibility was not there. She reminded Mr. Lewison that this Board offered several suggestions, and they were not received. Her concern is that this demonstrates an unwillingness to work with the community and respond to reasonable Trustee Connell said he would submit that it would not take ai ton of work to get the project over the hump. There has been some impassioned feedback, and he invited the owners to not get overwhelmed with all the information. The HRC has standard that Connell supports, he said. The Village wants the best project sO the owner can be successful, and it can be a lasting development. While it can be deemed painful up front, it is worth it when it becomes a project that will stand for al long time because all have done their due diligence. Trustee Rooney invited the agreement int the immediate vicinity that is meaningful. Village requested. VILLAGE OF LIBERTYVILLE Board of Trustees Village Board Meeting Minutes June 11, 2024 Having said that, Trustee Connel continued, the only way to geti it over the hump is to be at the table, listen, do the work. The Board welcomes debate and encouraged them to stay at the table. Putting something forward and then just putting the same thing forward is a waste of time. Trustee Connell said thinks it can be done and the Board is rooting for this project, but the process must be honored and the collaboration consistent. It has not been there. Trustee Connell encouraged the ownership to continue the process and do some of the work. Trustee Adams added that he did not mean to come off as harsh as he did. He echoed Trustee Connell's comments. The Village wants to work together but has not seen collaboration from the other side come forward. The Village is receptive, but we must work to come together. Mayor Johnson said to Mr. Lewison that at this point the Board is being asked to vote on the report and recommendation of the HPC. REPORT OF THE APPEARANCE REVIEW COMMISSION, (ARC 23-66), New Landscaping and Fencing (Trash Enclosure), Vee Enterprise, Authorized Agent for Chicago Trust Company, The Appearance Review Commission (ARC) met on December 18, 2023; January 15, 2024; and March 18, 2024, to review a request for approval for new landscaping and fencing (trash enclosure) for 708 N. Milwaukee Avenue. The area reviewed by the Appearance Review Commission is east of the Downtown Historic District and includes a newi trash enclosure, The Appearance Review Commission voted to deny the proposal with a vote of2-3. Village of Libertyville, Applicant VILLAGE OF LIBERTYVILLE Board of Trustees Village Board Meeting Minutes June 11, 2024 The Village of Libertyville is requesting a Text Amendment to allow Public Administration as a permitted use in the C-2 Downtown Community Commercial District. The amendment would give more flexibility to future locations of Village offices. The Plan Commission heard the request at the April 15, 2024 meeting. Members of the Plan Commission noted that the amendment would exclude use of correctional institutions in the C-2 District. ORDINANCE NO. 24-0-34: An Ordinance Amending the Annual Budget of the Village of Libertyville, County of Lake, State of Illinois, for the Fiscal Year Beginning May 1, 2024 and On April 9, 2024, the Village Board adopted the Fiscal Year 2024-25 Budget that began on May 1, 2024 and will continue through April 30, 2025. Following the adoption of the Fiscal Year 2024-25 Budget there were several expenditures that were originally part oft the prior year budget that were either not completed or were only partially completed as of April 30, 2024 due to a delay in delivery Ina accordance with generally accepted accounting principles, these items must be accounted for in the year in which they are physically received and completed. It is important to note that because these items were originally budgeted in Fiscal Year 2023-2024, all funds that are required to accommodate these expenditures are available from resources that were previously budgeted and In addition, as discussed with the Village Board on May 28, 2024, the Fiscal Year 2024-25 Budget amendment, amends the Village's Classification & Compensation Plan. The position of Village Engineer is reclassified to Deputy Public Works Director/Village Engineer. The salary impact to the budget is $13,595 in aggregate split across three funds (General, Utility and Stormwater Funds). The financial impact for the total Fiscal Year 2024-25 Budget amendment is $1,326,906 in aggregate (all funded from reserves). Each recommended adjustment for Fiscal Year 2024-25 is The ordinance is in compliance with the requirements set forth in the Budget Officer Act. He said it was gross to listen to that tonight. He has no words to say how angry and upset he was. He was sO offended. Trustee Rooney thanked Chief Pakosta for the fire house tours. Trustee Connell offered congrats to Director Joseph. Mayor Johnson wished all a happy father's day. She remembered her dad's impact on her.
