CALLTO ORDER The meeting was called to order by Mayor Wilkins at 5:30. PM. B. PROPOSED ORDINANCE 2024-( 05 FENCE LAND DEVELOPMENTCODE Ms.] Patty Kulak, representing RVi Planning +l Landscape Architecture, delivered a concise presentation on Ordinance 2024-05, a recent amendment to the Fence Land Development Code initiated by the city several months ago. This amendment introduces straightforward modifications tot the City'sr regulations concerning walls and fences. Ms. Kulak provided an annotated copy oft the ordinance, highlighting revisions made collaboratively by herself, the city attorney, and staff. One significant update addressed in the ordinance is thei inclusion of an amnesty clause for previously erected fences, ai matter previously raised by the board. This clause now ensures coverage under the updated fence ordinance. Therefore, we have reinstated this section oft the code, specifying that barbed wire is prohibited in certain zoning districts--sperificaly, residential and commercial properties--while permitting its use in industrial contexts. Additionally, we have included general language mandating that all future fences in LaBelle must obtain al building Ms. Kulak advised there was some ambiguity in the previous code regarding the necessity of permitting, this amendment clarifies the requirement unequivocally. Moving forward, all fences and walls in LaBelle: must obtain al building permit. Non-compliance with this requirement incurs a penalty equal tot the permit fee plus an additional twot times that amount. A discussion ensued. Mayor Wilkins recommended amending line 127 oft the ordinance to allow for fences to connect to the house. Additionally, at line 167, where it currently references the superintendent of public works, this responsibility actually falls under the purview oft the building department, specifically Ms. Kulak responded affirmatively that she will incorporate these comments into the document, revise accordingly, and ensure iti is redistributed promptly toj proceed with the next steps. Motion made by Commissioner Ratica to approve Ordinance 2024- 05 of being in compliance with the comprehensive) plan with recommended. amendments, Second by Commissioner Spratt.
