MINUTES TOWN OF COPPER CANYON REGULAR TOWN COUNCIL MEETING MONDAY, MAY 13,2024 7:00 P.M. The Town Council of the Town of Copper Canyon met in regular session on Monday, May 13, 2024, at 7:00 p.m. in the Council Chambers at Copper Canyon Town Hall, 400 Woodland Drive, Copper Canyon, Texas, whereupon the following items were considered: L.CALLTO ORDER Mayor Robertson called thei regular meeting ofthe Copper Canyon Town Council to order at 7:00 on the 13th day of May 2024. Andrews Chase Lybbert Larry Johnson Staff Present Troy Meyer Sheila Morales Mayor Pro Tem Deputy Mayor Pro Tem Council Member Council Member Council Member Town Administrator Town Secretary A quorum of the Town Council was established. Allegiance to the U.S. and Texas Flags. Mayor Robertson and Council Members led meeting attendees in the Pledge of Mayor Robertson briefly explained the history of creating the Town of Copper Canyon's Police Department which began over one and al halfy years ago. He thanked Former Town Administrator Donna Welsh, Mayor Pro Tem Hill, Deputy Mayor Pro Tem Castillo and Town Administrator Meyer for all the hours they worked at creating the Copper Canyon Police Department. Earlier this month, Copper Canyon received the final certification needed from the State ofTexas thereby making the Police Department official. Mayor Robertson also thanked Denton County Judge Andy Eads, County Commissioner Bobbi Mitchell and the Denton County Sheriff Office for all the help they contributed in the creation oft the Copper Canyon Police Department. II.POLICE CHIEF - OATH OF OFFICE Mayor Robertson administered the Oath ofOffice to Chief Roger Tighe. IV.PUBLIC! INPUT Citizens can make comments to the Town Council during this section of the meeting agenda. We ask citizens who wish to speak on agenda items tos sign in ont the sheet provided on the table at the back of the Council Chambers. There is a 3-minute time limit for each speaker. Pursuant to State Open Meetings law, the Town Council cannot discuss or take action on items not posted on the agenda. Drive) thanked the Council Members fori their service and for all the hours they have worked and decisions they have made to make Copper Paula Castillo, Neighborhood Watch Chair spoke about the following: Canyon what it is today. her meeting with ChiefTighe, Creek Subdivision thel Neighborhood Watch Program and the need for representation from Copper her meeting with ESD Communications Director Meagan Reynolds regarding the Winning the Fight" education program In addition, she questioned the April 2024 $615 Neighborhood Watch' expenditure and then thanked ChiefTighe. Minutes-Town Council Meeting 5/13/20241 Page 2of8 V.STAFF, MAYOR, AND COUNCIL REPORTS ON ITEMS OF COMMUNITY INTEREST (Pursuant to Texas Government Code Section 551.0415 the Town Council may report on the following items: (1) expression of thanks, congratulations, or condolences; (2) information about holiday schedules, (3) recognition ofi individuals; (4) reminders about upcoming Town Council events; (5) information about community events; and (6) announcements involving imminent threat to public health and safety. No deliberations and actions will be taken. Mayor Robertson proposed creating a crime control board now that Copper Canyon Mayor Pro Tem Hill stated that the Financial Advisory Committee is ready to go and has a Police Department. two residents will be appointed at the next council meeting. VI,PUBLICHEARING The Town Council will conduct a Public Hearing for the purpose of hearing any and all comments and consider a recommendation from the Copper Canyon Planning and Zoning Commission regarding the Copper Knoll Estates Development Plan, allowing for the development of approximately twenty (20) acres, and to allow for the development of eighteen (18)s single family lots and one (1)HOAI lot, located at 1700. Bishop Lane, Copper Canyon, Texas 76226. Mayor Roberston opened the public hearing at 7:33 p.m. Holly Frenzel (320 Orchid Hill Lane) explained current drainage issues and expressed concerns relating to possible future drainage issues on the proposed Jeff Crannell (President of CCM Engineering) briefly discussed the current drainage issues for the proposed Copper Knoll Estates development and stated that Copper Knoll Estates property. any excess water due to the development will be retained. Mayor Robertson closed the public hearing at 7:38 p.m. VIL.STAFF REPORT Town Administrator Town Administrator Meyer gave the following update: New Police building is progressing and should be enclosed by the end of May Newly formed Development Process Review Committee met during the fourth week of April. Chief Vaughan gave the following update: Congratulated ChiefTighe The first community advisory meeting is scheduled for April 18, 2024 An new fire engine was put in service for Station 3 on May 1,2024 Ar new: ambulance has been ordered Saturday, from 8 a.m. - 2 p.m. Carry the Load event (including a fire station open house) is scheduled for Deputy Mayor Pro Tem Castillo requested a weekly update from Town Administrator Meyer considering all that is going on in the Town. Mayor Robertson stated that he has requested al biweekly report and if more information is needed, then a weekly report will be required. Council Member Johnson agreed that this information would bel helpful. VIII. CONSENT Items on the Consent Agenda are routine and administrative in nature. As such, thesei items are considered for approval by a single motion and vote generally without discussion. Council Members can remove an item or items from the agenda, SO it can be considered separately and/or add action or discussion agenda posted as part of the Consent Agenda. 2. Approve the 2023 Annual Contract for Miscellaneous Pavement Repair and Deputy Mayor Pro Tem Castillo requested that all the Consent Agenda Items except Item Drainage Improvements Work Order #2, dated May 3, 2024. #1 be removed and he questioned the following: Item #2 included the resolution from Item #5 Item #3 account totals for Town Administration, retirement, payroll tax totals, as well as Law Enforcement salaries were higher in March as compared to prior months. (During March there were three pay periods thereby increasing the amount Item #4 Account total for Engineering services was higher than usual (Current developments required more engineering inspections; these costs will be invoiced Item #4 Account total for Audit services total was higher than usual (Two fiscal year audits overlapped, thereby increasing the costs for the account.) Item #4 Account total for Covid19 Expenses was higher than usual. (This amount included a large expenditure for constructing the PD building.) Item #4 Account total for Law Enforcement Contract was higher than usual. (A monthly payment previously missed in a prior fiscal year, as found by the auditor, was issued thereby increasing the amount in that account.) Town Administrator Meyer answered the concerns (see verbiage above in parentheses). Mayor Pro Tem Hill made a motion to approve Consent Items #1-4, with the understanding that that the April 15, 2024, Minutes should not have a resolution Deputy Mayor Pro Tem Castillo seconded the motion as stated by Mayor Pro attached to them. Deputy Mayor Pro Tem Castillo noted that the resolution included as part of Consent Item #2, should go with Consent Item #5. Council Member Andrews stated that he and Town Administrator Meyer and Town Engineer Hartke drove the Town looking at various roads and assessing the repair needs. The bollards at the roundabout will be deleted from the proposed work. Discuss, consider, and take action regarding a recommendation from Copper Canyon Planning and Zoning Commission regarding the Copper Knoll Estates Development Plan, allowing for the development of approximately twenty (20) acres, and to allow for the development of eighteen (18) single family lots and one (1) HOA lot, located at Town Administrator Meyer briefed the Council regarding the Planning and Zoning Commission's conçerns relating to the Copper Knoll Estates Development Plan including questions/concerns regarding perimeter fencing, proposed retaining wall, Jeff Crannell (President of CCM Engineering) and Daneil Lozano (Copper Knoll Council Members Johnson and Andrews raised questions regarding the drainage Town Engineer Hartke stated that at the level of the Development Plan he is comfortable with the proposed ponds. Additional pond details and calculations will be considered at the Preliminary Plat stage in the development process. EXECUTIVE SESSION Town Council convened into closed executive session pursuant to Section 551.071, Tex. Govt. Code at 8:27 p.m. to seek legal advice from the Town Attorney regarding: 1. A proposed institutional facility within a residential district in the Town's 2. Property for aj proposed residential development within the Town'sjurisdiction. 3. Zoning compliance and permitting requirements for an accessory building in the jurisdiction. Town'sjurisdiction. XI.CONSIDERATION OF EXECUTIVE SESSION Town Council reconvened into open session pursuant to Section 551.071,Tex. Govt. Code at 9:05 p.m. No action was taken. XIII.
