THE TOVNO BUENA VISTA CO MINUTES OF THE BUENA VISTA BOARD OF TRUSTEES REGULAR MEETING Tuesday, June 11, 2024 MINUTES OF THE MEETINGS OF THE BOARD OF TRUSTEES ARE A TRANSCRIPT OF THE GOVERNING BODY'S ACTIONS RATHER THAN A VERBATIM RECORD OF DELIBERATIONS. Work Session at 6:00 PM- Planning Director. Joel Benson and Public' Works Director Shawn Williams Mayor Libby Fay, Trustees Maggie Huyck, Gina Lucrezi, Andrew Rice, Micha Rosenoer, Devin Rowe, and Cindie Swisher attended the work session. Also present were Town Administrator Brian Berger, Planning Director Joel Benson, Public Works Director Shawn Williams, and Town Planning Director. Joel Benson shared with the Board that the Planning team members include Benson reviewed the Planning Department Staff works with property owners and prospective owners, developers, contractors, the Department of Corrections, Colorado Parks and Wildlife, the Upper Arkansas Water Conservancy District, Chaffee County Fire Protection District, Buena Vista Sanitation District, and various Chaffee County governmental agencies. The team processes a variety of permits and applications from signs to sheds to utilities, temporary vendors, special uses, readjusting lot lines, building accessory structures, commercial site plans, publicimprovements, review easements, recording plats, change of use, demolitions, landscaping, zoning and rezoning, and annexations, mapping, Comprehensive Planning, policy Benson is responsible for tracking how much water the Town has, how it uses it, and where to acquire more while coordinating with capacity and production. The department is vital to the Historic Preservation and Planning and Zoning Commissions. The department's more prominent projects include the Comp Plan, the Water Augmentation Certificates plan, Chaffee Housing Authority, Proposition 123, Triview Annexation, Bray-Allen, Dryfield, and the Colorado Parks and Wildlife land swap. Developments include The Crossing, Homestead, Boulders, The Farm, South Main, Sunset Vista, Northside, Busy Bees, and the Boys and Girls Club. Benson stated the challenges the department is encountering include staff capacity and high work volume, inefficient building layout, continued work on developing processes and billing Clerk Paula Barnett. Williams provided ai thorough report on the progress ofthe water treatment plant expansion project and the challenges of getting Well Three online. Williams stated that with the installation oft the new pipes, the water infiltration gallery isc currently not meeting the average production of 800 gallons of water per minute. Water Supervisor Joe Pedrie and his team, which includes Rick Sako, Hawk White, and Aron Fox, have been able to meet current water demands by utilizing the water gallery and Wells Two and Williams shared the projects Parks Supervisor Chris Hartley and his team, which includes Alison Hopkins, Michael Kirchhof, Lonnie Smith, seasonal employees Matt Sweeney, and cemetery groundskeeper Jesse Saar, are currently working on. Street Supervisors Tyler Owens and Mike Dickens are working on various street projects. Fleet Mechanic. J Case is busy with normal operations and summer equipment tune-ups. Custodian Jackie Krueck and Building Maintenance person Norm Nyberg maintain normal operations and clean all the town relationships with other agencies. Three. facilities. A dedication ceremony and various events will be held on June 28th from 3:00 pm to 6:00 pm. Buena Vista Chamber of Commerce Director Liz Morgan, 125 South San Juan, updated the Trustees on the Chamber's activities, including the plans to re-open a Welcoming Center. PRESENTATIONS Chaffee Housing Authority Ballot Committee Chaffee Housing Authority (CHA) treasurer and ballot committee chair Eric Warner stated that CHA will propose two ballot measures in the November 2024 election. The de-brucing measure would allow CHA to retain revenue from all sources, including the state, beyond limits allowed by the Taxpayer Bill of Rights (TABOR). The other measure would increase sales taxes by 0.5 percent to help fund the CHA, eneratingapproxmate'y $3.5 million in the first Warner reviewed with the Board that CHA is not trying to play developer. They are an independent government organization formed in late 2020 through a joint agreement between Chaffee County, the City of Salida, and the Town of Buena Vista. CHA's purpose is to be a community leader partnering for inclusive and secure housing. CHA envisions a thriving community with housing for all, and its mission is to deliver housing units and stability through partner-driven development, education and advocacy, and impactful programming. Warner stated the money is needed to close the Capital Gap (70-80% of funds). Even with low- interest loans resulting from CHA partnerships, rising interest rates, and the cost of building a housing unit, housing is still out of reach for most of Chaffee County's workforce. Money from the proposed sales tax would close this gap. While funding from municipalities and lodging tax iss substantial, it isn'te enough to solve the crisis. The CHA must be able to develop a deed- restricted program, procurement, rental compliance, and oversight for 1100 units. CHA must function independently and be a reliable resource for partnerships. Creating the proposed 250 units over ten years will take human resources and legal and professional fees. It will also support the CHA's independence from the county organization. Riggs stated that the County, the City of Salida, and the Town of Buena Vista must each refer the measures to Mayor Fay stated she recently became a town representative on CHA and supported the ballot questions. Trustee Lucrezi and Trustee Huyck stated they appreciate that if the ballot question passes, the additional .05% sales tax collection will sunset in ten years. Selby and Hylton-Hinga stated the ballot language is still being drafted, and the sunsetting clause may change. the ballot fori them to be on the November 2024 ballot. BUSINESS ITEMS Water Advisory Board 2024 Function and Focus Buena Vista Water Advisory Board (WAB) member Jeff Ollinger reviewed the WAB's functions and focus for 2024 with the Trustees. Kelly Collins, Chair of the WAB, also attended the session. Ollinger stated the WAB has identified their function as supporting the Board of Trustees in developing, updating, shepherding, and scoping water resource plans and issues and communicating with other Town and related water resource agencies. Ollinger reviewed the focus oft the WAB, including: Town Water Conservation Plan: help consultant scope issues andapproaches Source Water Protection Plan (SWPP) Implementation: research grant opportunities to update SWPP, create emergency notification cards for emergency agencies dispatch offices, deploy SWP District signs Source Water Protection District Regulations: review for possibleupdatels) Water distribution system modeling BOARDO OF TRUSTEES OFT THET TOWN OFE BUENAV VISTA Page 5of10 June: 11, 2024 Regular Meeting Ongoing Projects and Programs include: Town Trustees and' Water System Staff support and advice on direction Coordinate and communicate with the Town and related watera agencies Evaluate and advise on water quantity, quality, and dependability topics/issues Watershed protection: Be aware of, review, and comment on activities with the potential to affect water resources in the South, Middle, and North Forks of Cottonwood Creek. e.g., wildfire/ fuel management/post-ire debris flow mitigation, riparian zone and floodplain impacts, surface flow timing (annual hydrograph), and US Forest Service projects. The Zoom connection of the meeting encountered technical difficulties at approximately 7:50 pm during the WAB session, which resulted in that portion oft the meeting not being recorded. Billy Cordova Memorial Park Should the Board of Trustees approve the adoption of Resolution No. 51, Series 2024, entitled, "A RESOLUTION OF THE BOARD OF TRUSTEES FOR THE TOWN OF BUENA VISTA, COLORADO, AUTHORIZING THE RECREATION DEPARTMENT TO ENTER AN AGREEMENT FOR GENERAL CONSTRUCTION OF BILLY CORDOVA MEMORIAL PARK." Overview Recreation Director Shane Basford reviewed that Staffi is requesting approval from the Board to move forward with an agreement for General Construction for Billy Cordova Memorial Park with Summit Construction Group following the review and scoring of the RFPS for the project. With the completion of the final design and receiving the bids for the Construction RFP, the cash price is estimated at $1,552,322. However, the estimated total cost fori the project exceeds the amount budgeted fori the project in the 2024 Budget, resulting in an estimated Basford stated that due to this shortfall, Staff met with Summit Construction Group to discuss areas ini their proposal that would be possible options for value engineering. They identified a few places to reduce expenses but have not yet had the chance to explore the most significant cost savings with them. The park design calls for a large amount of concrete, boulders, and various types of rocks for the project. ACA Products has expressed interest in contributing to this project. Basford plans to schedule a meeting with the ACA Products management team, members from Summit, and their subcontractors to discuss possible discounts on materials. Additionally, Staff has identified two sources of boulders ini town that could be utilized for only shortfall of $106,685. the cost of loading and transportation. Basford said they have received many donations for the project, have remaining funds from the Walton Loop project, and could utilize the Park Fee in Lieu payments that developers have made over the past few years. Staff plans to use the park benches as an opportunity to honor local first responder agencies and raise funds. Recreation Staff will request that the Chaffee County Commissioners reallocate the Conservation Trust Fund amount budgeted for the Arizona Street Bridge to this project. The Staff has not had the opportunity to finalize the plans for the bench sponsorship and will present the reallocation of county funds to the Board of County Basford said that the Recreation Stafffeels iti is critical to complete the entire construction of Billy Cordova Memorial Parki in 2024. Significant community momentum is behind the project, Basford stated that Staff had identified several available funds to commit to the project, but additional resources are still needed to serve the full scope of the project. Basford stated that the Staff believes there are four viable options to proceed with and reviewed the Commissioners on. Staffi is requesting approval fromi the Trustees to enter a construction agreement. Then, the Staff will request a Trustee Rice asked Basford if he was proposing not to do the doors and ADA openers at the Community Center. Basford stated the Help America Vote Act (HAVA) Grant funding for ADA openers does not look as lucrative as envisioned. If the Board approves transferring the allocated $30,000.00 for doors and ADA openers to the park, the project could be done in a future budget year. Trustee Rice stated that door openers serve a different group of people and that he does not want the project cut from the 2024 budget. Trustee Swisher echoed Trustee Trustee Rice asked Town Treasurer Phillip Puckett his thoughts on pulling unbudgeted funds from cash reserves. Trustee Lucrezi expressed her concerns about how the Triview Annexation revegetation will be handled and what chemicals will be utilized since creeks and homeowners are nearby. Benson briefly reviewed the process and stated that Triview is aware oft the concerns and ist taking Berger reviewed that the Town currently has an agreement with the School District to utilize the parking lot behind the School Administration building as public parking during the summer. Due to the construction occurring at the McGinnis Gym, the size of the lot has decreased significantly. Berger met with School Superintendent Lisa Yates and discussed transferring the parking agreement to the school-owned "Arch" property for parking, with the understanding the area near the Arch would be roped off, preventing drivers from parking close toi it. The Trustee Lucrezi expressed her concerns about extended-length vehicle parking on East Main Street and the traffic hazards they create for motorists, bikers, and pedestrians. Town Attorney. Jeff Parker stated he would review the Town traffic code, enforcement ability, and precautions. Board agreed to the change in parking locations. any necessary code changes.
