ORDINANCE 2024-09 related to the International Fire Code An ordinance of the City of Irondale to modify the Municipal Code ofthe City of Irondale, Alabama Section 1. AMENDMENTTOCHAPTER 4, ARTICLE II, DIVISIONI.SEC. 4-41OF1 THE MUNICIPAL CODE OF THE CITY OF IRONDALE. Chapter 4, Buildings and Building Regulations, Article II, Codes and Standards, Division 1, Generally, Sec. 4-41, Fire Codes, of the Municipal Code of the City of Irondale is hereby amended by deleting Sec. 4-41 in its entirety with no replacement. The remainder of Division 1 shall remain unchanged. Section 2. AMENDMENTTOCHATTERASECEIOFTNE MUNICIPALCODEOF THE CITY OF IRONDALE. Chapter 6, Fire Prevention and Protection, Sec. 6-1, Code adopted, oft the Municipal Code ofthe City of Irondale is hereby amended by deleting Sec. 6-1 in its entirety and replacing it with the following: Chapter 6 - Fire Prevention and Protection Sec. 6-1.-Code adopted. (a) The International Fire Code, 2021 Edition, including all appendix chapters, a copy of which is made a part of this section by reference as iffully set out herein, is hereby adopted ini its entirety as the fire code of the city for regulating and governing the safeguarding of life and property from fire and explosion hazards arising from the storage, handling and use of hazardous substances, materials and devices, and from conditions hazardous to life or property in the occupancy of building and premises in the city and providing for the issuance of permits for hazardous uses or operations; and each and all of the regulations, provisions, conditions and terms of such International Fire Code, 2021 Edition, published by the International Code Council. The National Fire Protection Association (NFPA) Codes and Standards, most current edition adopted by NFPA, including all appendix chapters, acopy ofv which is made a part of this section by reference as if fully set out herein, is also hereby adopted. (b) Amendments to the fire code. Section 510.1 Insert the following exception at the end of the currently listed exceptions in Section 510.1: Exception #4: One-story buildings not exceeding 12,000 square feet (1115m2) with no below-ground area(s). Section 3. ORDINANCES REPEALED. All ordinances or parts of ordinances in conflict Section 4. SEVERABILITY That if any section, subsection, sentence, clause or phrase of this ordinance is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Irondale hereby declares that it would have passed this ordinance, and each section, subsection, clause or phrase thereof, irrespective oft the fact that any one or more sections, subsections, sentences, clauses Section 5. LEGAL RIGHTS NOT IMPAIRED. That nothing in this ordinance or in the Code hereby adopted shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed as cited in Section 3 of this ordinance; nor shall any just or legal right or Section 6. ORDINANCE CUMULATIVE: COMPATIBILITY WITH OTHER REGULATIONS. This ordinance shall not be construed to modify or to repeal any other ordinance, rule, regulation, or other provision of law. The requirements of this ordinance are in addition to and cumulative to the requirements of any other ordinance, rule, regulation, or other provision of law, and where any provision of this ordinance imposes restrictions different from those imposed by any other ordinance, rule, regulation, or other provision oflaw, whichever provision is more restrictive or imposes Section 7. PUBLICATION OF ORDINANCE. That the City Clerk of the City of Irondale is hereby ordered and directed to cause this ordinance to be published as provided by law and that a copy Section 8.
