QUEENSTOWN COMMISSIONERS February 26, 2021 Special Meeting A special meeting was held in the Town Office for thej purpose ofholding a work session to discuss potential changes to the boat slip rental agreement, rental fees, and boat landing fees and President Willis called the meeting to order at 1:03 p.m. Participating were. President Tom Willis, Commissioner Al Hardee, Commissioner Bryon Callahan, Town Attorney Lyndsey Ryan, Town Ms. Moore provided an email received from Paul Cain with questions and concerns regarding the Ms. Moore provided al briefhistory on changes made tot thel boat slip agreements in 2016 and 2017. She also advised that in November 2013, Lane Cole was appointed as Dockmaster and remained such until retirement a couple years ago. Unfortunately, the duties of dockmaster were never appointed to anyone. Mr. Cole is listed on website as. Dockmaster and has continued to coordinate Commissioner Hardee stated for the record that he did not approve oft the way the Town Manager and Commission President were personally attacked by a resident at the last meeting regarding The Commissioners went through the current lease agreement by paragraph and made changes 1. Discussion: Commissioner. Hardee: inquired whether we: should require thei renter have boat insurance. Ms. Ryan advised that insurance is not required for boats, but town could require to protect other renters. After some discussion, it was agreed to leave as is. No 3. To add: "Extension may be granted by the Town Office for an additional 30 days". 4. Discussion: Commissioner Hardee stated we should not lease to someone who does not own a boat. Ms. Moore advised that we currently do not lease to anyone without a boat. They must own a boat when offered a slip or acquire one within 30 days. Once acquired, To add: Notwithstanding any other provision ofthis Agreement, in the event that the slip remains vacant and unoccupied by the vessel identified in this Agreement for a period of nine (9) months or more during the one-year term ofthis Agreement, this Agreement shall automatically terminate, and no refund for the unexpired portion of the term shall bei made, 6. Change to: "The boat using said slip must be kept afloat, operational, seaworthy and in good repair. Any boat showing signs of disrepair may be required to undergo a Coast Guard Courtesy Inspection. The inspection will determine the remedial action to be taken regulations. Discussion: Commissioner Hardee stated' Town needs to appoint a Dockmaster. Hes spoke to Matt Reno to see ifhe would be interested should one be appointed. Mr. Reno stated he'd be willing to serve. Commissioner Callahan was in agreement but stated a job description needs to be drafted and position should be an annual appointment. Further discussion included 1) no payment or free slip for serving (Commissioners agreed there shall be no compensation or free slip given for the position), 2) monitors the docks and boat ramps, looks for maintenance and safety issues, and brings concerns and violations to the Town Manager. Since oversight to include more than just docks, position will be titled Harbormaster. ** All references to Dockmaster will be changed to Harbormaster. To add: "Marina and landing operations will be monitored and managed by the Harbormaster". 14. No changes or additions 15. Discussion: to allow Lessee's to pay in two payments To add: "Lessee may pay annual rent in two or more payments, with a minimum ofhalf the: rent being paid by January 31stofthei rental year, and the remainder paid in full by May 31sb. 16. New section: Discussion - waterman givel back to the community and may need use ofas slip not being occupied "Lessor may allow use ofa slip for up to thirty (30) days with approval from the Harbormaster. Consideration will be given to waterman who may need to utilize slip for a longer period oftime". Commissioner Hardee suggested that waterman have first rights to a slip, as Queenstown has a history of being a maritime town with working full-time waterman. They would have to be Queenstown residents with a valid commercial license. After some discussion, it was agreed to There was a discussion on the slip rental fees. Currently the fees cover the costs associated with operations at the docks, such as trash collection and electric. We will look in dock expenditures There was a discussion on the proposed boat ramp: fees of$15 for town residents and $50 for out- of-town users. This was first proposed by a resolution, yet to be adopted. Commissioners discussed problems that arose with users oft the ramp inj prior years. President Willis motioned to close the boat ramp and parking area to everyone but Town resident. Motion seconded by Commissioner Callahan. Vote: 3-aye, O-nay. All in favor. It was further discussed and agreed to charge Town residents an annual user fee of$25 fora aj permit ift they want to park and utilize the boat ramp and parking area. An ordinance will be drafted to bei introduced at the next meeting. In regards to the email from Paul Cain discussed earlier in the meeting, the Commissioners instructed the' Town Manager to contact Mr. Cain and thank him for his input. The Commissioners did take his, and others, concerns into consideration and reviewed the current boat slip agreement There being no further business, President Willis motioned to adjourn the work session at 3:37 p.m. Motion seconded by Commissioner Callahan. Vote: 3-aye, 0-nay. All in favor. keep the structure oft the waiting list as is and make no changes. and revenues and see if an increase may bei needed for next fiscal year. and rental process and addressed concerns that were raised.
