1 QUEENSTOWN COMMISSIONERS June 19,2019 PRESENT: President Thomas B. Willis, Jr., Commissioner Al Hardee, Commissioner Holger Schuster, Town Attorney Lyndsey Ryan, Town Planner Peter. Johnston, and Amy Moore, Town Manager/Clerk. PUBLIC HEARING CALLED TO ORDER AT 7:00 P.M. Ordinance No. 19-01 - AN ORDINANCE OF THE TOWN OF QUEENSTIOWNTOREPEAL INTHE ENTIRETY AND REENACTTHE QUEENSTOWN ZONING MAP Town Planner, Peter Johnston, provided an overview oft the zoning map changes proposed. These changes are: reflective of public comment received at a previous hearing. The changes include expanding a 100 ft. buffer to remain in the Countryside: zone. This forestalls any concern for public marinas. The Planning Commission expanded the QRD zone based on discussion with the golfo course on concepts of development, as they were experiencing a drop in rounds of play and were looking at ways to increase their revenue. There was also ai residential component discussed. Thel Planning Commission was sympathetic tol keeping the property viable and active. Public comments received: Don Regenhardt, 7009 First Ave. -i is concerned with the: motivation to make these changes now, before any plans have been presented. Growth. Allocation (GA) was granted on the Chester River side to protect Queenstown Creek. Ifthey wanted lodging, entertainment etc., then they would need to come to the Town and ask. Feels town is putting the cart before the horse and we will lose a lot ofleverage. Suggests the town be pre-emptive and requests that George Plumbo, 7003 First Ave. - golf course have been great neighbors. Until they provide plans and what it would mean for the town, doesn'tagree with changing zoning. Not sayingi it Paul Cain, Steamboat Ave - what steps must golf course take to develop further? Mr.. Johnston advised that they would need to come ini for additional GA. Town can deny the request ifd don't approve the plan. To get GA, it goes before the Critical Area Commission. There: is a transparent process to go through that is morei rigorous. It starts with a concept plan. Mr. Johnston noted that a zoning change is not carte blanche for them to develop. Lori Sharer, 7003 First. Ave. - Why come to the town now without aj plan? Mr. Johnston advised that the area proposed was talked about in the Comprehensive Plan. John Anderes - General Manager, Queenstown Harbor GolfLinks - the Birney's have always been a good neighbor to Queenstown and will continue to do SO. For them to do a conceptual plan for development there, it would cost them tens oft thousands ofdollars. All they are asking is that the town approve the zoning. Vote: 3-aye, 0-nay Correspondence/Other: - Clerk Letter from Jeff and Kim Ennis regarding their concerns with the garage being built next door to their property on Olde Point Lane. Clerk advised the builder is building it above the 16ft. height restriction. They have been advised and have filed for a variance with the BOA. Commissioner Hardee inquired about the status oft the covenants and restrictions ofthe Queenstown Village development since the HOA had been disbanded several years ago. Pat Bowell updated on the variance request from Alton MacIntosh, Comegys Lane, for a fence. Mr. MacIntosh changed the location and it was determined a variance was not required. ORDINANCE 19-01 - AN ORDINANCE OF THE TOWN OF QUEENSTOWNTO REPEAL IN THE ENTIRETY AND REENACTTHE QUEENSTOWN ZONING MAP After discussion, and finding thei map to be consistent with the Comp Plan and the Zoning Ordinance, President Willis motioned to adopt Ordinance 19-01 as was amended and presented during public hearing on June 19, 2019. Motion seconded by Commissioner Schuster. Vote: ORDINANCE 19-02 - AN ORDINANCE OF THE TOWN OF QUEENSTOWN ADOPTING A GENERAL BUDGET FOR THE FISCAL YEAR BEGINNING JULY 1,2 2019. AND ENDINGJUNE: 30, 2020. AND ESTABLISHING A TAX: RATE OF.1744 PER $100 OF ASSESSED REAL PROPERTY VALUE AND A TAX: RATE OF .44 PER $100C ON ALL COMMERCIAL OR BUSINESS PERSONAL PROPERTY AND PUBLIC UTILITIES; AND ALSO. ADOPTING AN ENTERPRISE BUDGET FOR THE TOWN'S WATER AND President Willis motioned to adopt Ordinance 19-02 as presented during the public hearing on June 12, 2019. AMEND THE TOWN'S WATER AND SEWER CHARGES TO INCREASE THE MONTHLY WATER USAGE RATE. AND SEWER USAGE RATE BY FIVE PERCENT PER YEAR FOR THE NEXT THREE FISCAL YEARS, COMMENCING JULY 1,2019. OLD BUSINESS = 3-aye, O-nay SEWER OPERATIONS JULY 1,2022 NEW BUSINESS - None presented ATTORNEY UPDATES - Lyndsey Ryan Property maintenance case was settled in court 4 PUBLIC COMMENT- Paul Cain - thank you to the Town for help in thej property maintenance case. Joel Kelkowski - asked ifc other properties in town werel being made to clean up. He was informed that yes, we have a Code Enforcement Officer working on that. He also asked who thei mayor was for Queenstown. He was informed that Queenstown does not have a Mayor. Our commission is set up with three Commissioners, with one being elected each year as President.
