Absent were Others in attendance included Borough Secretary Roland Price, Treasurer Carol Councilwoman Joann Brennan and Councilman Norm Diehl. Sutzko, Police Chief William Dempsey and Barbara Artz. PUBLIC COMMENT - No public comment. President Dempsey discussed receiving a complaint in the early morning concerning the dumpster picking up Delcamp's garbage at 1:56 a.m. Our Code Enforcement Officer contacted the company and gave them a window from 6 a.m. - 8 p.m. We have no recourse to fine them. An amendment may have to be made to the Dumpster Ordinance limiting the pick-up times, which would make it illegal to pick up outside those predetermined times. Another option would be to purchase a decibel reader to confirm they are too loud. The situation will be addressed with the solicitor. After review of the Zoning Officer's report, a question of a proposed Air B&B address of 15 W. Hancock Street was questioned. Councilwoman Stednitz called the Zoning Councilman Klazas complimented President Dempsey on handling situations in the Borough by keeping everyone informed by text messaging. Councilman W. Dempsey receives phone calls. Everyone gets on it and has their say. Councilwoman C. Dempsey agreed and mentioned that the only concern is that everyone should respond. President Mayor Tomko stated that the draft Amusement Ordinance was very complicated to enforce and implement. It is cumbersome and complex. The main concern of the Amusement Ordinance is the hours of operation and the licensing fees for the Borough. Officer for clarification. The address was incorrect. Dempsey agreed. Stednitz-Julian responds when she is finished work. Borough Secretary Roland Price presented the Secretary's Notes. The issue with the Comcast Licensing fee of $99,200 has been resolved. Representatives from the Street Department, Sewer Authority and the Schuylkill County Municipal Water Authority will be in attendance. Engineer Jim Tohill will be in attendance in lieu of Engineer Council should consider adopting a resolution appointing Roland Price Borough Secretary as a representative to the Pennsylvania Municipal Power Agency. The PMPA was formed many years ago and St. Clair Borough was one of the original members. The agency has the power of an authority to engage in different projects that would benefit the borough. Answering the roll call were council persons: Bill Dempsey, Cheryl Dempsey, Norm Diehl, Judy Stednitz-Julian, Tony Klazas, Council President Thomas Dempsey, and Mayor Richard Tomko. Absent was Counciwoman Joann Also, present included Solicitor Edward Brennan, Engineer Brian Baldwin, Borough Secretary Roland Price, Treasurer Carol Sutzko, Electric Light Superintendent Bob Petrozino, Police Chief William Dempsey, Fire Chief Frank Uhrin, Barbara Artz, Dr. Erin Portland, Adrian Portland, Rich Cost, Joshua Sophy, Emil Pangonis, Bridget Klazas, Vaughn Vesay, Mike Boyer, Jeff Third Street, St. Clair. The meeting began at 6:30 p.m. Brennan. Searfoss, and Dave Resnick. Pledge of Allegiance Council member Tony Klazas read the council prayer. Copies of the minutes of the previous council meeting have been given to Mayor Tomko and borough council members, are there any errors or corrections? If not, they stand approved. PUBLIC COMMENT Rich Cost questioned a few specific bridge' 's weight limits. Engineer Baldwin explained all seven bridges are inspected every two years, the eighth bridge on Hancock Street, is the responsibility of the Commonwealth. The bridge specifications are driven by these reports. Cost asked if we could post a bridge to prevent landfill trucks from using them, but Solicitor Brennan explained it is illegal. Emil Pangonis of N. Fourth Street questioned how four vehicles were towed away on May 15 without notice. He claims that each vehicle towed cost $350.00 to be reclaimed. Police Chief said there was no common courtesy extended to the Police Department in this matter. With permission of council, Solicitor Brennan will send a letter concerning towing cars from borough streets. Dr. Erin Portland was speaking as a member of the community. She attended the May Work Session and was pleased that council voiced opposition to the landfill and supported the people they serve. She asked council to allow an address of Department of Environmental Protection placed in the monthly newsletter, in order for residents to send additional comments concerning the landfill. She also verified that council received an invitation for the rededication ofVeteran's Memorial Stadium this August. 2 Jeff Searfoss of Morris Street brought to council his ongoing issue with his neighbors. The first issue being the ruts created by the dirt driveway potentially creating a water problem in the Searfoss foundation and the neighbor's yellow driveway line that was painted six inches onto his property. Light projections from the neighbors on the side of Searfoss house, crops growing up the siding, rocks being tossed against the siding and garbage cans located next to the corner of the porch are also of concern. Pictures were presented for each situation. Solicitor Brennan suggested he survey his property and consult his personal attorney. Burn permits and the potential Driveway Ordinance were also discussed. Dave Resnick living at 26 S. Mill Street discussed his civil suit against his neighbor. Resnick claims rain from his neighbor's roof is damaging his front porch and an outside receptacle. He presented a video. Council will have the Code Enforcement investigate for code violations. MAYOR'S REPORT 1. A heartfelt thank you is extended to the Street Department Superintendent Kevin Dempsey and all the members of the Street Department for the excellent work done in erecting a flag pole at the historic Borough Cemetery as well as preparing the cemetery grounds for Memorial Day. The new flag pole was donated to our Borough by Hydro Extrusion North America. 2. As vacation time is up coming, residents are reminded that they may obtain a Vacation Form from the St. Clair Police Department. Once the form is completed and returned to the Police Department, patrols could increase and the police could contact residents should there be an emergency at their property. Mr. Anthony Irwin, a local resident, helped to fence the lot and was the caretaker for several years. Almost 20 years later, land developers Carey, Lee, and Hart, deeded the lot to the Borough ofSt. Clair after its incorporation as a borough; to be used as a community cemetery. There are no existing records of burials from 1831until 1850. The burials under the Borough's governance can be found on the Borough of St. Clair's website. The next two cemeteries founded for residents of St. Clair were located west of the Borough in New Castle Township and were religious in nature. St. Boniface Roman Catholic Cemetery in 1858 and St. Mary's Roman Catholic Cemetery in the early 1860's. A new community non-denominational cemetery was dedicated in 1867 in the eastern part of the Borough by the Independent Order of Odd Mayor Tomko commended Superintendent. Since National Night Out will interfere with the August Council Meeting, council agreed to move the meeting. He mentioned first responders will be there and asked council to participate. He requested a stipend to purchase promotional materials. Chief Dempsey mentioned this event could grow each year possibly adding therapy dogs, a DJ, games, dunk tanks and other fun ideas. 5 On a motion by C. It was decided that the Borough would submit a CFA GTRP grant application to construct a new' youth (small-scaled) basketball court in the vicinity of thet tot playground att the Third Street Recreation Complex. The total project costs including two rim systems, asphalt paving, court markings, vinyl fence, design, inspection, and administration costs are $75,500with the Borough's 15% local match being $11,325. Our office submitted this grant application on behalf of the Borough on May 31, 2024. 2024 Commonwea'th Financing. Authority (CFA): Multimodal Transportation Fund (MTF) This year's CFA MTF grant round is open with applications due on. July 31, 2024, Typically, this program requires a 30% match, but this requirement is once again waived for municipalities. However, projects with committed funds typically receive favorably ratings. We prepared. some conceptual project cost estimates fory you consideration for a few projects that were previously discussed: Thwing Street Bridge replacement, Ann Street rehabilitation, Second Street streetscape. St. Clair Little League Project (31226.20) At the May7,2024, Council Meeting, Council motioned to conditionally award the project to SLC Excavating, LLC, as the apparent low bidder. The primary condition of this award was the commitment of additional funding from DCNR. Our office assisted with the preparation and coordination of this formal request to DCNR, and on May 28, 2024, the Borough was informed by DCNR that the additional funding was approved.
